The Board of Adjustment considered the following applications for variance: James E. and Janice T. Hallberg - Variance application approved as requested with a condition. (6:32 p.m.) James Brand Janice“TTHallbergrLots*8"and^9rGirard"Beach”and'part^oTGovernmenttori7Section'30'of'Girard Township by West Battle Lake, requested a variance from the 5 acre minimum metes and bounds described parcel requirement within 1000’ of a lake. A one-time split into approximately 1 acre backlot and an approximately 1 acre lake lot. Both lots to be considered single family residential buildable lots. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration. Ward Uggerud made a motion, second by Paul Larson and carried with Steve Schierer voting no, to approve the proposed subdivision as described in the variance application dated November 7, 2014 and as depicted on the drawing submitted with the application noting that both lots would be considered single family residential buildable lots and with the condition that a registered surveyor’s drawing must be provided at the time of conveyance. The member voting no expressed concern with the establishment of a single family residential backlot noting that many other backlots in this immediate area are used for secondary storage buildings and additional area for future septic systems. The variance as approved does not directly or indirectly grant any other variances for future development. Rob and Sharon Snorek Tst - Variance application approved as requested. (6:40 p.m.) Rob and Sharon Snorek Tst, part of Government Lot 3, Section 24 of Buse Township by Swan Lake and an unnamed lake, requested a variance of 60’ from' the required ordinary high water level setback of 100’ and a variance of 88’ from the required ordinary high water level setback of 200’ for the placement of a new dwelling with attached garage and storm shelter 40’ from the ordinary high water level of Swan Lake and 112’ from the ordinary high water level of an unnamed lake. (6:45 p.m.) Patricia Piekarski Leitch, Lot 7 Blue Heron Beach, Otter Tail Lake in Otter Tail Township, requested the following: There is approximately 15’ 8” of property between my home (Piekarski/Leitch) and Douglas and Dallas LofTs house. Loff’s house is just inches away from the property line. Their roof line actually hangs over on my property. I would like to give 5’ of property to Loffs. This would provide them with more area to maintain their property without trespassing. This would still leave 10’; of property on the west side of my home. Douglas Loff appeared with the applicant at the public.hearing. An unsigned letter expressing concerns with Patricia Piekarski Leitch’s property . ownership was read for the record. Mark and Tammy Jossart - Variance application approved as requested. (6:52 p.m.) Mark and Tammy Jossart, Lots 61,62, 63 and 64 Sater-Humphrey Ranch Camp, Ten Mile Lake in Tumuli Township, requested a variance from the public road right-of-way setback requirement to build a 24’ by 24’ addition to the north end of an existing garage to increase garage size. Proposing to place a 24’ by 24’ addition to existing detached garage proposing to be 8” from road right-of-way. Requesting a 19’ 4” variance from the required 20’ setback. Keith Sellner appeared with Mark Jossart at the public hearing. The audience was polled with Keith Sellner speaking in favor of the applicant’s proposed location. After discussion and consideration. Ward Uggerud made a motion, second by Thomas Lee and carried with Mike Harris voting no, to approve a variance of 19’ 4” from the required road right-of- way setback of 20’ for the placement of a 24’ by 24’ garage addition 8" from the road right-of-way. The member voting no had suggested a possible alternative site. Charles and Elaine Blixt - Variance application approved as requested. (6:57 p.m.) Charles and Elaine Blixt, part of Government Lot 5 and part of the Southeast Quarter of the Northwest Quarter, Section 4 of Friberg Township by Tonseth Lake, requested the following; Build up on existing footprint previously subject to setback variance to increase roof pitch and add loft area. Current structure 65’ from lake. No change in current setback. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Ward Uggerud and unanimously carried, to approve a variance of 135’ from the required ordinary high water level setback 200’ for the placement of the proposed development as described in the variance application dated November 15, 2014 65’ from the ordinary high water level. It was noted that the proposed development will be no closer to the ordinary high water level than the existing development. Henry Kohler - Tabled. Henry Kohler, part of Government Lot 2, Section 23 of Otter Tail Township by Long Lake, requested the following: I am requesting a variance of 40’ from the ordinary high water level setback of 100’ to construct a home 60’ from the lake. In the case that this variance is granted I would be turning in a request to the Planning Commission asking for a permit for a cluster development allowing me to construct the home without the removal of the existing cabin. October 9, 2014 Meeting - The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion and with the applicant’s verbal consent, Thomas Lee made a motion, second by Steve Schierer and unanimously carried, to table this hearing until a future meeting date to allow the applicant an opportunity to consider other alternatives, for example - platting. November 13, 2014 Meeting - No action taken by the Board of Adjustment as prior to the November 13, 2014 meeting Mr. Kohler had submitted a letter, dated October 21,2014 requesting that his application continue to be tabled until Spring of 2015. December 12, 2014 Meeting - Application remains tabled until a future meeting date.
