Requesting a variance to construct an addition ft from OHWL, required setback is 75ft. Addition will
be in line with and no closer than existing dwelling. Requesting to increase shore impact zone
impervious surface area to 1,032 sq ft. Current shore impact zone impervious surface is 632 sq ft,
maximum allowed is 260 sq ft.

David & Robyn Wolf - Approved Variance Request with Condition (6:30 p.m.)
After consideration and discussion, Darren Newville made a motion, seconded by Michael Donoho and unanimously
carried to approve the variance request to construct an addition to the existing cabin 38’ from the ordinary high water
level with the condition that once they have the well sealing certificate/log they will need to supply a copy of it to Land
& Resource Management. This decision is also based on the Findings of Fact and Decision Form, which contains the
criteria reviewed and the Board’s finding have been attached to and incorporated as an official part of the minutes
which have been placed on file with the Land & Resource Management Department. The variance as approved does not
directly or indirectly grant any other variances for fumre development.

1The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

Jon & Marcy Hager - Approved Variance Request with Condition (6:23 p.m.)
Jon & Marcy Hager, Lot 8 Blk 4 of Bonita Beach & CAC St. Adj., Otter Tail Lake (56-242) in Everts Township requested the
following: The variance request we are making is the cabin is built on a narrow 50’ wide lot and is 5’ off the existing property line.
With an existing structure and accessing that structure on the opposing side any further buildout would hinder the access and shared
parking with the neighbor. We are requesting an addition on the small cabin and keeping the addition in line with the existing cabin
being 5’ off the existing property line. The required setback is 10’.
Jon Hager, property owner represented the variance application. The audience was polled with no one speaking for or against the
variance application.
After consideration and discussion, Douglas Larson made a motion, seconded by Darren Newville and unanimously carried to approve
the variance request to construct an addition to the existing cabin and replace the roof on the existing cabin being 5’ from the lotline.
This decision is also based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s finding
have been attached to and incorporated as an official part of the minutes which have been placed on file with the Land & Resource
Management Department. The variance as approved does not directly or indirectly grant any other variances for future development.

Other Discussion
Chris spoke with Rick West, Director in regard to variances for lots which are permanently attached and possibly allowing these to be
approved through the Land & Resource Management Office. It was noted that this is a type of request has been denied by the Board of
Adjustment. Chris is keeping track of the number of variance types that are approved.

My wife, Elsa and I arc immediate ncighbois on the north and to the west of David and Robyn Wolf,
the applicants requesting this variaoce.
Our home is situated back from the lake and straddles thelot In question so that any construction W'ould
partially block our view of the lake. My undeistai^ing of die proposed cdnstruction is that it would be
a twenty-five by twenty-five foot two story additton on the west of tlic existing: home. This would
directly impact our property, ground water and die water quality of Ottertail Lake.

Wc purchased our home about 15 years ago &om a group of ncighbois (hat had purchased the oiiginal
larger parcel from the original owners. Piares of the larger property were sold off to neighbors^ That
larger holding included the lot over which Cbe variance is ba'ng lequ^ted. It was not part; of (he
oripnal holding on which (he cabin was built at 42500 Plcasuic Park Rd.. The rem^der of the larger
property was put on the market for sale in 2005 and;is the property wre purchased. The ^fcesperson
representing all the owners for that piece of property w'as Gaiy Flombom, the owner of the hofloe that
David and Robj-n eventually purchased (heir property from, in the fall of 201S. At (he time we
purchased our home we were told by Mri Plombom that the lot in front of us would have nothing
higher lhan an omamental planter placed; on the property line. He w^hed only to have additional
shoreline for their family boats. And that is what has transpired over the |«st 15 years smoe wr;
purchased our home on the lake.
The proposed project will have a footprint of <SS sq.fb (25'x25'X R will add 1,250 sq. ft. of living space
incorporating a hunily room and a master btxlroom and (at least one) bathroom on the sccondRoor.
Tliere has been no distmasion on how the existing septic tank will handle the additional sewage load
and the impact to the groundwater and Me water.
Tire entire project will be built w'ithin the 75 foot setback area which is subject to hi^ groundwater
from Ottertail Lake. Also (he project will be eonsttucted om the existing water well. The proposed
construction includes two patios, one to the rear and the other to the frontw^cst comerhoth adding to
the impervioas soil area which already cx^eds that allowed in Otter Tail County. These topics nccdl to

My wife. Elsa, and i mxist bcliev'e that the building restrictions on the propetty w'erc well known prior to the recent purchase. We do not want to deoy our nejgbborsT enjoyment ofiihe their ptoperty nor the
lake. However, Elsa and I want to continue the enjoyment wc have as well. Wc have to trust fliat
restrictions placed on construction fay the Board of Adjustment will ensure the continued health of the
lake, grotmdw^ater, and sairrounding propeiiy.
