Motion
Motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to deny the variance
as requested as no adequate hardship had been shown. It was noted that there is adequate room to construct
the proposed garage 10’ from the lot line, as understood when the applicant purchased the property, or 10’
from the lot line as agreed upon between the two adjacent property owners. It was noted that the applicant
has a fairly level lot with other alternative building sites available.

Background of McLeod Property
Purchased in 1993, lot width 110 feet.1.
3 property line markers were found; missing marker was on west lot
line at lake.
2.
Subsequent survey indicated width of lot to the west was less than
recorded in abstract.
3.
Dispute arose; lawsuit evolved.4.
With encouragement from a mediator, I tentatively agreed approving
4.5 feet less in center of my lot, taper back to the original lot line at
ends.
5.
My agreement is subject to approval by variance committee of a 5-
foot setback from proposed property line.
6.
Property owners of the lot to the west have agreed to support this
request.
7.
Lawsuit is stayed until the results of the variance request are known.8.
No other buildings within 25’ of proposed garage and its improbable
another would be built.
