Hardship being a substandard lot of record and the granting of the variance will allow reasonable use of the applicant's property. V- \ May 16, 1994 Otter Tail County Board of Adjustment \ /VMH Ri resource RE: Government Lot 5 Fire #'s - #24744 and #24745 Section 25, Township 134, Range 39 - Township Name - Otter Tail, Lake No. 56-139, Lake Name - Gourd, Class - NE, Owner - David Koppe Dear Sirs: In response to the Board's concerns on my May 5th variance request for the above property, I have made the following variance revisions or have provided additional information as follows: 1) The original variance request was for a 120' variance from the required high water level setback of 200'. My amended request is now for half of the original request, or a 60' variance - thus the new structure would be 140' from the high water mark. (I have placed a sign at the 140' mark on the property.) Please note that the existing house was originally designated to be 68' from the high water level. Since the May 5th meeting, Tim Griep from Land Sc Resource Management and Terry Lejcher from the DNR jointly measured the existing house to be 88' from the high water level. 2) At a 140' setback the new structure would be entirely within what is now a small cornfield and would extend back another 34' to 174' from the high water mark. 3) Since the May 5th meeting, I also did research and obtained a wetlands map (attached) which validates my concerns about the ability to place the new structure 200' or more back from the high water mark. The land slopes to the west and at 200' the new structure would approach, or perhaps be in, the "wetland" as designated by the attached map. It is very wet at that side of the field and if a dwelling were placed near the wetland I would have concerns about the stability of the footings and, in dry years, the fire hazard which could be posed by the wetland grasses. The attached wetland map also displays the characteristics of my entire property. The only land access I have to the water's edge on the whole property is on the "peninsula" of land on which the current building is built - with wetlands to the west and wetlands and open water to the east. Otter Tail County Board of Adjustment Page 2 In requesting this variance and placing the new structure 140' back from the official high water mark the new building would be about 285' from open water to the east and less than 70’ to the wetlands to the west. At this 140' location no new roads would need to be built and no wetlands would be disturbed. 4) I would be completely removing the existing house at 88', and also no doubt would be improving the environment by removing its septic system and installing a new septic system up to standards at the 140' location. 5) If necessary I would also be more than willing to agree, and to carry out the actions necessary to indicate, that the parcel will not be subdivided, thereby removing any concern of improper development during my ownership or after my ownership ceases. Thank you for tabling this matter until the June 2, 1994 Board meeting, and allowing the additional time for you to review the site and for me to provide this amended request and additional information. This letter is intended to provide you with general background information regarding this request. After reviewing this information, I would appreciate it if you would you please let me know, via letter or phone, what the next steps are for me to secure the necessary approvals, permits, and/or variances to begin the building process. Description of Property and Existing Structures My property is about 167 acres along the northeast corner of Gourd Lake. About 90 acres is tillable and rented to a local farmer. I rent the farmhouse and metal shed on the property to a local family. I've owned the property for about a year and a half and have used the existing cabin on the point for hunting and getaways from Minneapolis. The existing cabin is 'comfortable' with a furnace, bathroom, running water, etc., but at this time I would like to either move it off the property or tear it down and build a log cabin in it's place. Description of Site hand drawn 'site setback' drawing is attached to show the rough easurements between the existing cabin, the vegetation, and water's edge. It subject to interpretation, but the high water mark is probably any where from 5’ to the closest corner of the existing cabin's foundation. Description of Proposed New Cabin Site Layout Also attached is a hand drawn 'site layout' to show dimensions of the existing cabin and the overlay of the desired new cabin. As you can see by the drawing, the foundation of the new cabin is set back an additional 10' to 12' from the existing cabin corner closest to the high water mark. I drove up to the property last weekend to get more detailed site measurements and also left three conduit pipes drilled into the ground assuming it was necessary for you or other county officials to review the site at some point in this process. Description of Proposed New Cabin The new log cabin's concrete block foundation outside dimensions would be 28' X 34' with an additional 10' x 14' enclosed porch built on decking. There would be one bathroom and one bedroom with an open half loft. I would plan on drilling a new well and building a new septic system to meet necessary code. The old shallow well would be properly sealed. The well and septic would run out to the backside of the new cabin (away form the lake).
