Plarming Advisory Commission ^ Malcom Lee Ottertail County Co^^rth.ouse Fergus Falls, Minnesota ^(^531 Re: James Ahlfs Special Use Permit Application - Gourd Lake 56-I39 Ottertail County Dear Malcom; The Soil Conservation Service has prepared a plan for a primary and secondary settling basin for the above mentioned Special Use Permit Application. We have determined that the primary settling basin will have an efficiency of 87% for removing very fine silt and an efficiency of 12/o for removing medium clays. The secondary settling basin will then have an efficiency of 99^ for ronoving very fine silts and an efficiency of 35% for removing medium clays. There is no exact soils data available at this site to determine the amount of silt or day size fractions that exist. The applicant has indicated that only a trace of fines exist, and the general soils information we have does not conflict with the applicants cl^im. The applicant claims that all the water will infiltrate through the bottom of the settling basins, which is most desirable. He has also indicated that he would re­ move the fines in the settling basin, in the event inadequate infiltration begins to cause an overflow problem. Mr, Ahlfs also was present, Mr, Burge and I made several measurements and have estimated that the site of the proposed washing ponds is within 500 feet of the lake. Box 70 Ottertail, MN 56571 Dear Mr. Ahlfs: COMMISSIONER'S ORDER, P.A. 85-1073,(^RD LAKE,) OTTER TAIL COUNTY The Department of Natural Resources has reviewed your application for a permit to construct a roadway, for fish rescue work, across a bog fringe in the public waters of Gourd Lake, Otter Tail County, at your property located in the SEh Sec. 24, T 134N, R 39W. It has been determined that your application as proposed must be denied. As you know, the Department of Natural Resources Section of Fi.sheries is aleady conducting a fish rescue operation on the lake and they have suitable access elsewhere that does not require any placement of fill. Additionally, 6 MCAR § 1.5021 B.4.c. and e. requires a stable supporting foundation, v^hlch does not exist and this proposal is not a minimum impact solution when compared to other reasonable alternatives. Minnesota Statutes, Chapter 105.45, quotes in part as follows: "In all permit applications, the applicant has the burden of proving that the proposed project is reasonable, practical, and will adequately protect public safety and promote the public welfare." In view of our observations, we cannot conclude that your proposal is indeed reasonable, practical, and will promote the public welfare; therefore, the proposal presented in the application is in all respects denied. Pursuant to Minnesota Statutes, Section 105.44, Subd. 3 and 6, the applicant, the managers of the watershed district, the board of supervisors of the soil and v/ater conservation district or the mayor of the city may demand a hearing on the Order provided the demand for hearing and the bond required by Subd. 6 be filed with the Commissioner within 30 days. No bond or security is required of a public authority which demands a hearing. The statutes further provide that if no demand for hearing be made or if a hearing is demanded but no bond is filed as required by Subd. 6, the Order shall become final at the expiration of 30 days after mailed notice thereof and no appeal of the Order may be taken to district court. Gourd Lake is an excellant waterfowl-muskrat production area, as well as the best northern pike natural reproduction area in Ottertail County. We have operated a very sucessful N. Pike rescue trap on the outlet between Gourd and West Leaf Lakes for many years, from which N. Pike are supplied to various lakes throughout the CoLinty.
