Motion by Lee, second by Block, and carried with Froemming opposed, to approve a Conditional
Use Permit to construct a tennis court according to the Revised Plan of May 22, 2002. The
property is described as Blyberg’s Point First Addition Lot 2 BIk 1 in Section 17 of Dunn Township,
Fish Lake (56-768).

“Clear Lake LandIng’VBarbara Jo Nelson - Tabled To July 10, 2002:
A Preliminary Plat of “Clear Lake Landing” consisting of 9 single family residential lots, 1
block. The property is described as R GL 1 lying NWly of Ed’s Clear Lake Beach,
Section 23 of Tumuli Township; Clear Lake (56-559), RD.
Tom Athens (Attorney) & Jim Peterson (Anderson Land Surveying) represented the
Application. Donovan Olson expressed concerns regarding Clear Lake’s ability to handle
these additional lots & questioned the environmental impact of these lots (i.e. the
drainage ditch, septic systems, fertilizers, etc.). Bud Nelson indicated that the proposal
would have a minimal impact on the lake and the environment.
Motion/Failed: A motion by Zimmerman, second by Bergerud to approve with the
following conditions: 1. Lot 8 be eliminated and incorporated into Lots 7 & 9. 2. Provide
Land & Resource Management with a Preliminary Title Opinion that has been prepared
by an attorney. 3. The developer identifies any drain tiles that maybe onsite. Voting
Yes: Bergerud, Olson & Zimmerman Voting No: Boyer, Estes, Lachowitzer, Maske, Sha
& Schwartz.
Motion: A motion by Sha, second by Maske to table, with the Applicant’s approval, to
July 10, 2002 to allow the Applicant to: 1. Stake the lots onsite. 2. Provide a new plat
plan showing the elimination of Lot 8 (add the area to lots 7 & 9). 3. Provide Land &
Resource Management a Preliminary Title Opinion that has been prepared by an
attorney. 4. Include on the new plat plan any existing draintiles. Voting; All Members in favor.

Recess: At 7:50 P.M., the Commission took a 15 minute break.
“Sunshine Village’7Steven & Sherri Halstensgaard - Approved With A Condition:
A Preliminary Plat of ’’Sunshine Village” 2 Lots 1 BIk. (Lot 1 - single family residence. Lot
2-15 residential lots and 1 non-buildable lot). We have recently purchased Sunshine
Resort on Big Pine Lake. We are seeking to convert the resort into a private cluster
development (Association) which would include separate parcels for the 5 existing
cabins, 1 mobile home, 8 building sites and the existing house and the garage we plan to
eliminate 20 existing RCU sites. We also will relocate the existing fish cleaning house to
a new location away from the lake and propose to build a detach garage/storage/hobby
building (near existing house and garage). The laundry building will also be eliminated.
Common areas will be controlled by a owners association with mandatory membership
and assessments for all expenses. We also wish to moor only 20 boats. This will cut
back on our present boat mooring which is unregulated. The property is described as GL
1 ex trs (34.07 AC) Sunshine Resort in Section 23 of Pine Lake Township; Big Pine Lake
(56-130), GD. (It was noted that the May 8, 2002 Minutes indicated the incorrect request, the
Minutes reflect the error.)
Steven & Sherri Halstensgaard represented the Application.
Motion: A motion by Estes, second by Lachowitzer to approve with the condition that
the driveway for Lot 1 is moved approximately 15’ to the east. Voting: All Members in
favor, except Zimmerman.
Boosalis Trust - Approved Revised Plan:
A Conditional Use Permit Application to - The Boosalis Trust respectfully request a
Conditional Use to allow the regrading of their site in excess of the allowable 300 cubic
yards. The grading is required for the construction of a tennis court and future gazebo
building. The amount of soils moved is approximately 430 cubic yards. These soils,
removed from the high side of the proposed tennis court, will be used to fill in the low
portion of the tennis court. This will result in approximately balancing the cut/fill for the
site. Any excess soils will be relocated to the low point of this portion of the site to
minimize erosion problems and will be in accordance with governing ordinances. Silt
fencing shall be installed at the eastern limits of construction until new vegetation is
established (as per plans on file at Land & Resource Mgt. Office). The property is
described as Blyberg’s Point First Addition Lot 2 BIk 1 in Section 17 of Dunn Township;
Fish Lake (56-768), GD.

Motion: A motion by Schwartz, second by Boyer to approve the Revised Plan (received
