After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve a variance of 30’ from the required ordinary high water level setback of 100’ for the placement of dwelling (proposed size of 37’ by 25’) at least 70’ from the ordinary high water level with the condition that the applicant must either removed the existing dwelling prior to receiving a site permit for the new dwelling or obtain the proper approval from the Planning Commission for a cluster development. David and Shayla Durick - Tabled Per Applicants’ Request. David and Shayla Durick, part of Government Lot 9, Section 2 of Edna Township by Little McDonald Lake, requested the following; The road we want to butt up against is outside the easement and is on our property. The 20’ setback has been pushed south. Because of that we are requesting a 20’ variance from road right- of-way setback. When we first got excited about the opportunity to have a 4 season home there, we submitted a plan for a 50' X 56' dwelling with a two car garage and a new driveway coming off Cozy Oak Drive. The driveway option was assessed and approved by the township board in the fall of 2014. Due to the narrow shape of our lot, most of that project was not able to be in the build-able space we have on our land. We asked for a variance which was then tabled until we could come up with a proposal that would be more within your guidelines. After exploring several possibilities such as waiting to see if county policy was changing, looking into building at a different location on the lot, or adding an addition to the existing rustic cabin, we have settled upon what we believe can be a workable solution. What we propose is to be able to build in the same area as the initial site plan, but to down size considerably. Instead of a 50'x56' home, we would like to be allowed to build a 37' x 25' building. It would be located in the far NE comer of our lot, with as much of it as possible within the strip of build- able land. With it's smaller size, more than one third of the building would be in compliance. Our initial plans had the home about 60 ft from the lake. The new plan would now be as much as 85' from the lake shore. Access to the lake would remain as it is currently, with no additional dock, and no aquatic or shoreline vegetation would be disturbed. We would make every effort to protect the landscape and remove only the trees necessary to build the home, maintaining as much privacy and natural environment as possible. Our local builder, Rick Bladow, has assured us that there would be room for a drain-field, thus finally bringing modem sanitation to the property. It has been our good fortune to have enjoyed that area since 1974 and we have the utmost respect for Long Lake and it's fish, birds and other wildlife. As you know, there is another small cabin on the property. It is a 22.5'x 24' seasonal cabin with no running water. It has been there since 1934. The variance we ask for would allow us to build a second stmcture (4 season home) on the lot, one which would be 85' off the lake instead of the required 100 ft. and to have 600 sq.ft, of the home in a non-compliant zone. We would need this to be classified as a cluster development and the new home would be outside of the 50' set back required. ..wiir ^ The entire footprint of both buildings, the old cabin and the new home, would only be 1485 square feet on a lot that according to Anderson Land Surveying Inc., has 69,716 sq. ft. and could certainly support two structures. Without the ability to build a 4 season home on our property, we will have to look elsewhere, with the added expense of buying property that potentially could take us outside of the Ottertail city area. In the 40 years our family has been coming to this area, we have developed many friendships and relationships that we value and want to maintain. Over these many years, the Kohler family have become a large part of the community and the natural resource environment of the area. They appreciate Long Lake and the opportunity to continue enjoying the property that their family has owned over the years. From the original plan of 50’x56’, they have reduced the cabin size to 37’x25’. This reconfirms for me how important it is for them to be able to stay at this location. After considerable discussion and consideration, Paul Larson made a motion, second by Jack Rosenthal and unanimously carried, to approve the proposed garage development as depicted on the last page of the June 11, 2015 packet 87’ from the ordinary high water level and 32’ from the back of the existing cabin with the condition that the proposed garage cannot exceed 1200 square feet or 30’ by 40’ in size and with the condition that the proposed garage cannot exceed 20’ in height. The proposed development will not obstruct the view from the adjacent properties. The variance as approved will provide the applicants with a reasonable use of their property. It was decided to table our request until we could come back with a new proposal for adding a year around home on our Long Lake property south of the town of Ottertail. At this time, my wife and I would like to ask for an extension of that table until early next spring. It is our understanding that during the winter meetings of the County Board, some of the new construction restrictions will be discussed and considered for changes, which could potentially give us a better chance to build on our lot and in the most desirable location. If that occurs, we will revisit the variance request in the spring or early summer. If by next spring the rules have not changed, we will then have our lot divided and platted showing at minimum 40,000 square feet on the side that contains the existing seasonal cabin and another 40,000 square ft. minimum for the balance of the lot where we hope to build. Sanitation requirements and area would be marked out and at that time any variance needed will be added. Thanks again for your time and expertise on this issue. My wife, family and I have the utmost respect and reverence for Long Lake and it's shores. We simply hope to be allowed to live there year roimd.
