Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, November 23, 1999 at
10:43 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair;
Virginia Portmann, Malcom Lee, and Roger Froemming present. Commissioner Andy Lindquist
was absent.
Approval of Agenda
Motion by Portmann, second by Froemming, and unanimously carried to approve the County
Board agenda of November 23, 1999 with the following changes:
Remove Rick West from the agenda
Add Carol Stender to the agenda
Approval of Minutes
Motion by Lee, second by Froemming, and unanimously carried to approve the County Board
minutes of November 16, 1999 as mailed.
Approval of Lease
Motion by Portmann, second by Lee, and unanimously carried to approve the lease of a Polaris
snowmobile by Law Enforcement which is already included in the budget.
Approval to Pay Bill
Motion by Lee, second by Froemming, and unanimously carried to reimburse Jail Administrator,
Gary Waskosky, for expenses incurred while attending an out of state training seminar.
State Building Codes
Land & Resource Director, Bill Kalar, informed the Board of Commissioners of the existing state
mandate for counties to be responsible for the Accessibility Code in unincorporated areas, and
cities to be responsible for enforcement in incorporated areas. The Accessibility Code applies to
new building construction and expansion of existing buildings. It does not apply to residential or
existing non-commercial buildings. To administer the Accessibility Code, counties need to receive
plans and applications for work, review plans for compliance with Accessibility Code, permit
issuance and fees, site inspection, final approval and record keeping. First, counties will need to
obtain certification, determine who will administer (county/joint powers/contractual) and then set up
the process. Legislative action on this issue will not occur until 2001 at the earliest.
J^CUP 56-84 Modification
Land & Resource Director, Bill Kalar, reported that Tim Lueders would like to modify CUP 56-84.
The original CUP was for building a wood working shop near Long Lake with the condition that
there be three parking areas. At the present time he will not be building the shop but would like to
use the existing building.
Motion by Froemming, second by Lee, and unanimously carried to approve the modification of
CUP 56-84 to allow the use of the existing building for a wood working shop with the condition that
there be three designated parking areas. This will not need to go to the Planning Commission.
IOtter Tail County Employees’ Committee
Motion by Portmann, second by Lee, and unanimously carried to extend the term of County
Employees’ committee members from two years to three years and set up formal by-laws. The
first year will be for learning, the second year for doing, and the third year for training.

Use Permit to relocate a cabin and increase the size of the cabin on Ottertail Lake (Sec. 29,
Twp, 134N, R. 39W, 56-242, Otter Tail Township) as presented.
Conditional Use Permit - Timothy & Tammy Lueders:
Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use
Permit to operate a woodworking shop on Long Lake (Sec. 23, Twp. 134N, R. 39W, 56-201 Otter
Tail Township) with conditions as recommended by the Planning Commission.
Conditional Use Permit - Thomas Prieve/Sue Wika:
Motion by Lee, second by Portmann, and unanimously carried to approve a Conditional Use
Permit to level an area for horseback riding on Unnamed Lake (Sec. 34, Twp. 135N, R. 42W,
56-743, Maplewood Township) with conditions as recommended by the Planning Commission.
Bid Award - 1999 Countywide Seal Coat Project
After previously advertising. Highway Engineer Rick West, opened the following bids at 1:00 p.m.
on February 10, 1999 for the 1999 Seal Coat Project:

Motion by Lindquist, second by Lee, and unanimously carried to award the 1999 Countywide Seal
Coat Project (SAP 56-602-05 & Etc.) to the low bidder, Morris Sealcoat & Trucking, Inc. of Morris,
MN in the amount of $800,883.14.
Legislative Discussion
The Highway Engineer presented a draft letter addressing the proposed reduction in vehicle
registration fees and resulting affect on transportation funding for commissioner’s review.
Commissioners directed Mr. West to send the letter as presented to local legislators.
4-H Update
Extension Educators, Steve Handegaard and Donna Geiser, updated board members regarding
4-H activities. They reported on Cluster Project Days, Cluster Communications Contest, and the
annual Creative Sewing Expo as well as Conservation Days (attended by all 5^'^ graders in the
County) and Youth Health Day (attended by all 9^*^ graders in the County).

This letter is in response to a phone call made to me by Marcia of your office in regard to the conditional
use permit granted me by the county board on 2-16-99. It is permit number 5684. I am requesting that I
be permitted to temporarily use the existing 30’ by 36’ garage to operate my woodworking business. The
permit as granted specified that I was going to operate in a 30 by 48 building that was to be attached to
the existing structure. I would still plan on building in the future, so the request is for temporary
permission. Please address this as soon as possible. I would like to be able to begin the business
immediately.
