MOTION AS FOLLOWS:
fiction was made by John Everts, seconded by George Walter and unanimously carried, to deny
the variance as requested as no adequate hardship had been shown, the granting of the
variance request would establish a precedence and the location of the garage might cause
problems for snow removal. The applicants were granted until June 1st, 199S, to either
remove the 10’ by 28' structure or to place the 10' by 28' structure in a location that
complies with the setback requirements of the ordinance.

Carlton Sperry Oilman - Denied
Carlton Spexry Oltinan, Richville, KN, requested a variance of 30’ from the required road
riglit-of-vay setback of 40’ for the placement of a 10’ by 28’ garage 10’ from the road
right-of-way. The property is described as the South 1/2 of the North 1/2 of the
Northwest 1/4, Section 7 of Otter Tail Township. The audience was polled with no one
speaking for or against the request. A letter from the Otter Tail Township speaking to
the variance request was read for the record. After consideration, motion was made by
Cohn Everts, seconded by George 'rialter and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown, the granting of the variance request
would establish a precedence and the location of the garage might cause problems for snow
removal. The applicants were granted until June 1st, 199&, to either remove the 10’ by
28’ structure or to place the 10' by 28’ structure in a location that complies with the
setback requirements of the ordinance.
Peggy Elliott - Approved
Peggy Elliott, St. Paul, MN, requested a variance of 7’ from the required 50’ setback for
the location of a proposed holding tank 43’ from an e>£isting well and a variance of 6’
from the required road right-of-way setback of 20’ for the placement of a 4’ by 4’ by 5’
well house 14’ from the road right-of-way. The property is described as Lots 10 and 11,
Parkdale Beach, Swan Lake in Dane Prairie Township. The audience was polled with no one
speaking for or against the request. A letter from the Minnesota Department of Health
addressing the variance request was read for the record. After consideration, motion was
made by John Everts, seconded by Leslie Estes and unanimously carried, to approve a
variance of 7' from the required 50’ setback for the location of a proposed holding tank
43’ from an e>tisting well and a variance of 6' from the required road right-of-way setback
of 20' for the placement of a 4’ by 4' by 5’ well house 14' from the road right-of-way.
It should be noted that the variance is granted based on the recommendations and opinions
of the Minnesota Department of Health in their letter dated October 16th, 1995. Hardship
being a substandard lot of record.
Daniel A. Schell Approved
Daniel A. Schell, Bismarck, ND, requested a variance of 3’ from the required road right-
of-way setback of 20’ for the location of a garage 17’ from the road right-of-way. The
property is described as Lot 2, Block 1, Forest Hills, Lake Lida in Lida Township. The
audience was polled with no one speaking for or against the request. After consideration,
motion was made by Craig Anderson, seconded by Cecil Feraling and unanimously carried, to
approve a 6’ variance from the required road right-of-way setback of 20' for the the
location of a garage 14’ from the road right-of-way. Hardship being the unique shape and
terrain of the applicant’s property. It should be noted that the structure is setback
170’ from the ordinary high water level and the placement of the garage in this location
will not create problems for snow removal. It was also noted that the applicant will be
driving forward onto the public, road from the lot side opposite of the garage location.
