existing substandard cabin, small shed & old concrete sidewalks equivalent to approx. 1010 sq ft. &
replace with a new, approx. 2100 sq ft, one level dwelling at at same distance of approx. 22 ft. from the
river channel as current cabin. Requesting setback variance on Lot 36 to build a approx. 2500 sq ft
storage shed/workshop at 95 ft. from OHWL. Proposal includes removal of current old septic holding
tank & installing an approved new code compliant drain field septic and also drilling a new deep well.
These lots are permanently attached and were recorded prior to Oct. 15, 1971, the size, shape and

the applicant’s permission to table the request until the July 14, 2022, Board of Adjustment Meeting. Applicants will need to

motion, seconded by Thomas Lee and carried to approve the variance request as modified to allow the replacement dwelling
to be 22 feet from the ordinary high-water level, no larger than 1200 sq. ft. and no further south than the existing dwelling.
Also approve a variance to construct a wood shop being 95 feet from the ordinary high-water level This decision is based

determination that a practical difficulty exists is based upon consideration of the following criteria:

it makes it difficult to meet the structure setbacks.

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

The meeting was held in person and via Microsoft Teams.

Minutes Approved - Rick West made a motion, seconded by Terry Marthaler to approve the June 9, 2022, Meeting Minutes.
The Board of Adjustment considered the following application(s) for variance:
David & Cindi Strand -Variance Application Approved as Requested (6:03 p.m.)
David & Cindi Strand, Lots 2 & 3 Blk 2 Ex The W 4’ of Lot 3 of Crystal Lida Beaches, Lida Lake (56-747) in Lida Township
requested the follow ing: We’d like to build a garage 10 feet from the road right of way. The required setback is 20 feet.
David & Cindi Strand, propert)' owners, represented the variance application.
The audience was polled with no one speaking for or against this application.
Matthew Yavarow, County Highway Department submitted a letter in opposition of the variance as requested. Judy & Paul Korsmo
submitted an email in support of the variance as requested. All correspondence was forwarded to the Board of Adjustment Members.
After consideration and discussion, Terry Marthaler made a motion, seconded by Darren Newville and carried to approve the variance
to construct a garage being 10 feet from the road right of way. This decision is based on the Findings of Fact and Decision Form,
which contains the criteria reviewed and the Board’s findings have been attached to and incorporated as an official part of the minutes
which have been placed on file with the Land & Resource Management Department. The variance granted shall expire five (5) years
from the date of approval. The expiration date of this variance approval is July 14, 2027.

single level addition to the existing house will have a setback the same as the existing house, which is 73 feet. The current ordinance
specifies a 75-foot setback.

addition is 10 feet from the lotline. This decision is based on the Findings of Fact and Decision Form, which contains the criteria

Michael Shea -Variance Application Approved as Requested (6:48 p.m.)
Michael Shea, PT GL 3 Bg 509.4’ N & 2858.6’ of SW Cor GL 3..., Sybil Lake (56-387) in Hobart Township requested the following:
Proposing to construct an addition to dwelling (attached garage) being 42’ from the OHWL. Required setback is 100’. Currently the
shore impact zone impervious surface coverage is 36.79%. We will be reducing the shore impact zone impervious surface coverage to
28.3% with the reduction of the driveway in the shore impact zone. The shore impact zone impervious surface coverage allowed is not
to exceed 15%.

request to construct an addition to the dwelling (attached garage) being 42 feet from the ordinary high-water level and allow' the shore
impact zone coverage to not exceed 28.3% (currently it is 36.79%). The property owner w ill reduce the shore impact zone impervious
surface coverage by reducing the square footage of the drivew ay in the shore impact zone. This decision is based on the Findings of
Fact and Decision Form, which contains the criteria reviewed and the Board's findings have been attached to and incorporated as an
official part of the minutes w hich have been placed on file w ith the Land & Resource Management Department. The variance granted
shall expire five (5) years from the date of approval. The expiration date of this variance approval is July 14, 2027.

Susan £^7, Lot 32 of Dee Lake Beach, Deer Lake (56-298) in Everts Township requested the following: Current dwelling has 5 ft.
setback from east property line. Propose adding 16 ft. addition across the north side of the dwelling that would also have 5 ft. setback.
Neighbors to east (Brian & Kim Melton) & west (Jeff & Eileen Elage) are supportive of approving variance. Addition that aligns with
current dwelling walls and roofline would be aesthetically desirable. Slightly less than V2 current dwelling and current deck are located
within the SIZ and slightly exceed the impervious surface limit of 15% (15.4%). Propose current deck removal & replace with smaller
patio to decrease impervious surface in SIZ to 14.8%. Propose adding Vi story bonus room above addition & current dwelling.
Addition going up would not add any sq.ft, to impervious surface. Total impervious surface with proposed addition would be 16.8%.
The existing dwelling is 39’ at the closest point to the OHWL (verified by Land & Resource).

addition being 5’ from the east lotline and 39’ from the ordinary high-water level. This decision is based on the Findings of Fact and
Decision Form, which contains the criteria reviewed and the Board’s finding have been attached to and incorporated as an official part
of the minutes which have been placed on file with the Land & Resource Management Department. The variance granted shall expire
five (5) years from the date of approval. The expiration date of this variance approval is June 9, 2027.

Bossert spoke in opposition to the variance request indicating that her property will be directly impacted.

presented to construct a new dwelling being 9'8" from the North property line and 9’8'" from the South property line. This decision is
based on the Findings of Fact and Decision Form, which contains the criteria rev iewed and the Board's finding have been attached to
and incorporated as an official part of the minutes which have been placed on file with the Land & Resource Management

This property is outside of the OTWMD jurisdiction. This property would fall under the Land and Resource Management
Jurisdiction. Looking at One Gov it looks like Mike and George were out there in 2014 for an inspection for the
abatement program.
