Planning Commission Recommendations
Conditional Use Permit - Patrick & Stephanie Hockett:
Motion by Lindquist, second by Huebsch and unanimously carried to approve a Conditional Use Permit to
build a commercial duplex (rental) as presented with the modifications. The proposal is located Pt of GL 4,
(13.42 Acres), Section 02 of Otter Tail Township; Buchanan Lake (56-209), General Development (GD).
Land & Resource Management Fee Schedule
Motion by Rogness, second by Lindquist and unanimously carried to approve the Land & Resource Fee
Schedule effective January 1,2019, as presented by the Land & Resource Management Director. Director
Chris LeClair indicated that there will be a contractors’ seminar January 4, 2019, where the updated fee
schedule will be provided.
Red Eve River One Watershed One Plan (1W1P1
Ben Underhill from EOT Soil & Water Conservation District (SWCD) presented the Red Eye River 1W1P
Memorandum of Agreement. The Red Eye River Watershed covers about 50% of Otter Tail County by area.
Motion by Huebsch, second by Lindquist and unanimously carried to authorize the appropriate County
Officials’ signatures to execute the Memorandum of Agreement for 1W1P for the Red Eye River Watershed.
The agreement is dated 12/18/18 and includes the counties of Otter Tail and Wadena and the Becker, East
Otter Tail and Wadena SWCDs.
Aguatic Invasive Species (AlSt Task Force
Motion by Rogness, second by Huebsch and unanimously carried to approve payment of $2,000 to support
the 2019 Otter Tail County Visitor Profile which will include AIS frequently asked questions in the profile.
The funds will be appropriated from the AIS Education/Awareness program.
Planning Commission Appointment
Motion by Rogness, second by Lindquist and unanimously carried to appoint Judd Fischer to the Otter Tail
County Planning Commission effective January 1,2019, for a three-year term.
Budget and Lew Public Hearing Minutes
Motion by Rogness, second by Murphy and unanimously carried to approve the Budget and Levy Public
Hearing minutes of December 11,2018, as presented by the Auditor-Treasurer and attached as Exhibit B
PAYABLE 2019 OTTER TAIL COUNTY GROSS AND NET PROPERTY TAX LEVY RESOLUTION

The following resolution was offered by Commissioner Huebsch who moved for the adoption of Otter Tail
County’s Payable 2019 Gross and Net Property Tax Levies:
WHEREAS, the OtterTail County Board of Commissioners recognized the requirement to adopt, on or before
Monday, October 1, 2018, a proposed Payable 2019 Property Tax Levy and to select a date for a public
meeting for the purpose of discussing and receiving public comment regarding the Proposed Property Tax
Levy, which must be held during the period of November 25*^ through December 28*^; and
WHEREAS, the Otter Tail County Board of Commissioners on Tuesday, September 25, 2018 adopted Otter
Tail County’s proposed Payable 2019 Gross and Net Property Tax Levy and selected Tuesday, December
11,2018 as the date for the public meeting; and
WHEREAS, the Otter Tail County Board of Commissioners at 6:00 p.m. on Tuesday, December 11, 2018
held the required meeting; and

6:30 P.M. in the Commissioner's Room, Government Services Center, Fergus Falls,
Minnesota.
Roll Call:
Members Present: Loren Bailey, Rod Boyer, Brent E. Frazier, Richard Gabe, Bert Olson,
Bruce Stone, David Trites, David Wass and Rick Wilson.
Members Absent: Jack Rosenthal.
Michelle Eldien represented the County Attorney's Office and Chis LeClair represented the
Land & Resource Management Office.
Minutes of November 14, 2018: A motion by Stone, second by Gabe to approve the
November 14, 2018 Minutes as presented. Voting: All members in favor.
Patrick & Stephanie Hockett - Approved As Modified:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Build
and use 4 Commercial Buildings for rental purposes. A. 1 Monitor Style Barn at 80’x90’ with
Duplex Living Quarters and Storage (Unit #4) B. 3 Storage Buildings at 60’x170’ each (Unit
#’s1,2, &3) C. Exterior lighting to Illuminate Parking Areas D. 2 Signs to be installed a
maximum size of lO’xlO’ each, to be lighted E. Dock with 2 slips. The proposal is located
Pt of GL 4, (13.42 Acres), Section 02 of Otter Tail Township: Buchanan Lake (56-209),
General Development (GD).
Patrick Hockett represented the Application.
Written correspondence was read into the record.
Mike Wolf indicated he has no problem with the dock, expressed concerns with the rental use
and spoke against the Application. Karen Wolf had questions on the residential commercial
/ rental use. Denise Callander expressed concern on the rental use. Tim Callander expressed
concerns expressed concerns on the commercial use. Shawn Herman expressed concerns
on the commercial use and future expansion of the use. Eric Herman expressed concerns on
the commercial use and future structures, noise, the access road (traffic), the sign, the size of
the garage, the effect on the residential area, expressing opposition.
Motion - November 14, 2018: A motion by Trites, second by Frazier to table (at the
Applicant’s request) to December 12, 2018, to allow the Applicant to address: 1. The
compatibility with an existing residential area. 2. The depth of the lake in area of proposed
slips. 3. The use of commercial lighting. 4. The hours of operation. 5. Suitable area for a
compliant septic system. 6. The potential for run-off into the lake. 7. The proposed lighted
sign(s). Information from the Applicant must be submitted to the Land & Resource office by
November 26, 2018.
A motion by Wass, second by Gabe, to approve the Application with theMotion:

Pt of GL 4...(13.42 Acres), Section 02 of Otter Tail Township
Request the application for Conditional Use Permit on such property listed above be
denied. We are unable to attend hearing, however Mike Wolf can speak on our
behalf.
We purchased the property at 33364 Breezy Shores Rd, Ottertail, MN in September
2017 for our retirement Before purchase, we confirmed that all property along
Breezy Shores Rd was zoned for residential use, single dwelling only. This is where
we plan to retire and we did due diligence to ensure that the property around the lot
we purchased was not going to be for commercial purposes.
If this request is approved, it would not only affect our property value, but it would
be detrimental to the noise (multi dwelling quarters, storage, dock) and light
(exterior lighting for parking area) environment of the area on Buchanan Lake. We
purchased this because of the quite environment of the bay and single dwelling
properties to spend our retirement years at and have an investment in it and the
area.
Again, request the Otter Tail Planning Commission deny this request for Conditional
Use Permit

follow the Otter Tail County Dock and Riparian Use Ordinance
5. The following information is being presented as a result of concerns of my
fellow neighbors and planning commission members present during the
November 14, 2018 meeting. The majority of the neighbors with concerns
own land between and including the addresses of 33472 Breezy Shores Rd and
33250 Breezy Shores Road. These 11 lots average in size of 1.17 Acres and
each have approximately 150 feet of shore line. I will call "BSR Lots" from this
point forwarded.
a. Individuals expressed concerns of noise and light from this property.
i. Please see Item 2.
ii. The nearest residential building to the proposed building is
approximately 1200'. Many of BSR Lots' buildings are closer to
the potato barns west of State Hwy 78 than the proposed
building.
iii. All the structures on the BSR Lots are closer to buildings on the
adjacent lots rather than the proposed building.
iv. The approximate average distance between buildings on
adjacent lots is 150'.

vi. Basically the sound from a lawn mower at 100' is the same as the
sound from a rock concert at 1200'. Both are less than the sound
level of a normal conversation. Lawn mower is 90 dB, Rock
Concert is 110 dB. Lawn mower is 55 dB at 100', Rock Concert is
55 dB at 1200' and a normal conversation is 60 dB.
vii. Since noise is major concern of the neighbors, we would comply
with any township and county regulation pertaining to this area
b. Individuals expressed concerns with the road in front of subject lot and
additional traffic to and from of their homes.
i. I am currently working with the land owners of the 7 lots north of
33472 Breezy Shores Rd to dedicate land to Ottertail Township
for a road to continue north to 338*^ St. The existing road was
built to meet the specification of Ottertail Township.
ii. Traffic in front of the BSR Lots should remain the same as it
would be unusual for new traffic to travel south of 33472 Breezy
Shores Rd unless they had business or know people in those lots
as it is a dead-end road.
c. Individuals expressed concerns with proposed dock and 2 slips,
shoreline modifications, extra boat traffic, and the ability to get boats in
and out of shore line in the bay.
i. Please see item 4.
ii. It is very common for other land owners on Buchanan Lake and
many other lakes in the area to have 2 slips for various types of
recreational boats.
iii. All laws will need to be followed for any shoreline modifications,
just as all current land owners must do. No plans at this time
besides dock and slips.
iv. There is a public boat landing on Buchanan Lake, so additional
boat traffic will be hard to limit.
V. It appears that the bay is very accessible for almost any type of
recreational boat as almost all the land owners in the bay keep a
dock and slips in the water during the spring, summer, and fall
months.
vi. Please see attached map of water depths.
d. Individuals expressed concerns with adequate surface area and soil type
to install and maintain a septic system.
i. The soil type does not change that quickly in this area of the
county. The lot size is over 580,000 SF and a minimum area of
2500 SF is required for an 8 bedroom structure as proposed. It
will be less than >1% of the total area.
iK Please see attached soil test results for verification and septic
design. This work was completed by Scott Ellingson of Scott's
Septic Services, LLC.
e. Individuals expressed concerns with environmental impacts of the
conditional use permit application request.
i. The request falls well below the limits the county has for
impervious area. Please see Impervious Surface Calculation
Work Sheet.
ii. This lot will have less impervious area by percentage than most
of the BSR lots with homes and out buildings.
iii. Proposed building is set back from the lake, farther than other
dwellings on BSR Lots
iv. Storm water run-off into the lake would be very minimal as
contour maps showing the majority of the land drains to the
westerly direction.
V. I don't believe an environmental impact study is required at this
time.
f. Individuals expressed concerns with compatibility to residential area.
i. Planted 1500 trees around the property in May of 2018 and have
plans to plant another 500 in the future.
ii. My family and I will be using half of the duplex, ourselves. My
wife and I will keep a safe and fun property for our family and
our guests.
iii. We also plan to retire on the properties we own, just as the
people that own the BSR Lots ‘ Vs_iJ

V. The structure will be permanent in nature, we will not allow

This management plan will identify the operation and maintenance activities necessary to ensure long-term
performance of your septic system. Some of these activities must be performed by you, the homeowner. Other
tasks must be performed by a licensed septic service provider.
Homeowner’s Management Tasks - Should Be Checked Every 6 months:
Leaks - Check (look, listen) for leaks in toilets and dripping faucets. Repair leaks promptly.
Surfacing sewage - Regularly check for wet or spongy soil around your soil treatment area.
Effluent filter (if applicable) - Inspect and clean twice a year or more.
Pump Tank Alarms - Alarm signals when there is a problem. Contact a service provider any time an alarm signals.
Holding Tank Alarms - Can be either an electronic or a manual float, when activated, service (pumping) is required.
Event counter or water meter (if applicable) - Record your water use.
Vegetative Cover - Establish and maintain a vegetative cover over the sewage system.

A Preliminary Plat of “Tri-Lake Estates Backlots First Addition”, consisting of 9 Non-
Residential Non-Riparian Lots to be Permanently Attached to Riparian Lots, 4 Blocks. The
proposal is located in Pt of GL’s 2 & 3 of Section 9 and PtofGL 3 of Section 10, Lida Township:

Patrick Hockett represented the Application.
Written correspondence was read into the record.
Tim Callandar spoke in opposition and expressed concerns regarding noise, request of a
duplex, traffic/safety and request of 2 proposed boat slips. Scott Raymond had questions
regarding the proposed septic system, impact on the lake, traffic, effect on property taxes and
the proposed lighting. Mike Wolf spoke in opposition to the request, expressing concerns on
safety. Eric Herman spoke in opposition to the request for a commercial use, traffic, impact
on the lake & fowl and maintenance of the property: asked if there has been an environmental
impact study done. Kevin Gode expressed concerns on traffic/safety, legal access and if an
environmental impact study had been done. Scott Thompson expressed concerns on trash,
maintenance of the property, lighting: sating he is not in favor of the commercial use. Denise
Callandar expressed concerns of the impact on the lake. Linda Hanstad expressed concerns
on the commercial use.
Motion: A motion by Trites, second by Frazier to table (at the Applicant’s request) to
December 12, 2018, to allow the Applicant to address: 1. The compatibility with an existing
residential area. 2. The depth of the lake in area of proposed slips. 3. The use of commercial
lighting. 4. The hours of operation. 5. Suitable area for a compliant septic system. 6. The
potential for run-off into the lake. 7. The proposed lighted sign(s). Information from the
Applicant must be submitted to the Land & Resource office by November 26, 2018. Voting:

Request the application for Conditional Use Permit on such property listed above be
denied. We are unable to attend hearing, however Mike Wolf can speak on our
behalf.
We purchased the property at 33364 Breezy Shores Rd, Ottertail, MN in September
2017 for our retirement. Before purchase, we confirmed that all property along
Breezy Shores Rd was zoned for residential use, single dwelling only. This is where
we plan to retire and we did due diligence to ensure that the property around the lot
we purchased was not going to be for commercial purposes.
If this request is approved, it would not only affect our property value, but it would
be detrimental to the noise (multi dwelling quarters, storage, dock) and light
(exterior lighting for parking area) environment of the area on Buchanan Lake. We
purchased this because of the quite environment of the bay and single dwelling
properties to spend our retirement years at and have an investment in it and the
area.
Again, request the Otter Tail Planning Commission deny this request for Conditional
Use Permit.
