Motion was made by Cecil Femling, seconded by Randall Mann and carried with John Everts and George
Walter voting no, to approve a variance of 4” from the required lot line setback of 10’ and a variance of 20’ from
the required road right-of-way setback of 20' for the placement of an existing pole shed 9’ 8” from the lot line
and 0’ from the road right-of-way or 47’ 6" from the edge of the road’s traveled surface noting a non-centered
road and three other non-complying permitted structures. The Board of Adjustment directed the Land and
Resource Department to send a written statement to" the contractor reminding the contractor of the
requirements of the County’s ordinances.

Re: Shoreland Requirements
Dear Mr. Foltz,
As a condition for George and Judith Tabery’s variance approval, our office was to “send a written
statement to the contractor reminding the contractor of the requirements of the County’s Ordinances.”
Mr. Tabery informed me that Foltz Building Company was the contractor. Therefore as directed by
the Ottertail County’s Board of Adjustment, you are hereby reminded of the County’s Ordinances.
Please refer to the enclosed copy of the Shoreland Management Ordinance.
The following are some brief facts and history to help clarify this letter. On July 26, 1997, George
Tabery of Lot 5 Nelson’s Perfect Beach on Pine Lake applied for and received a Site Permit to build a
30x50 building. On November 26, 1997, in response to our expiration letter, he notified us that the
project was ready for inspection. On December 7,1997, we inspected the buildings location and found
it to be too close to the road right-of-way and too close to the lot line
I contacted Mr. Tabery and informed him of the problems and various options to resolve them were
discussed. Mr. Tabery chose to try and obtain a variance as the first option. The variance was
approved on May 15,1998 (see attached copy of variance approval). This letter completes that
variance.

This is a reply to your letter dated January 9'“’ concerning the pole shed Foltz Building
company erected on our property.
First, you stated it “appears” the building is placed incorrectly. Three of us neighbors
received permits during the same year to place pole sheds on our road. 1 purposely
wanted my building set back as far back as 1 could get it. If you measure all the sheds on
my road you will find the pole shed I had built by Foltz is set back farther then most of
the others. I haven’t talked to them to see if you approved their sheds. I would like to
discuss this with them before I comment on this.
Second, you stated the building is too close to the neighbors. I was on the job site when
they placed the 4 poles at the rear of the building and remember measuring about 11 or 12
feet from the old line. I remember it well as we went to Fargo and helped our friends
with the sand bagging operation last spring. When I returned a few days later, the
building was erected. I assumed at that time you folks were contacted by Foltz and the
building was approved. I was there for six months last year and never dreamed this
building was incorrectly placed. I was surprised when you sent me a letter in November
that the final inspection wasn’t made yet. Are we talking feet? Inches? You never
mentioned really what the real problem is here. I know the lot was staked out for 66 feet
before I purchased the land from my neighbor and my deed says I own 68 feet. I really
never cared about the other two feet so I decided to build with the old 66 feet survey. So
if your talking inches, there is another two feet on that property to play with. Personally, I
don’t want it and don’t need it. I will be retiring there next year and have pretty much
completed all improvements.
