Taberys are requesting a variance to allow them to acquire title to the vacated roadway lying between the Weis and Scherkenbach property and lying behind Lot 5. Taberys cannot construct a mounded drainfield system on their existing Lot and Land & Resource Management has approved the construction of a drainfield system on the vacated roadway when Tabery acquires title to the vacated roadway. The proceedings to vacate this portion of the roadway were recently completed and the Order Directing the vacation has been issued by the Court. Taberys are requesting that they be allowed to acquire the vacated roadway from Weis and Scherkenbach with the vacated roadway to be permanently attached to their tract, never to be severed therefrom. In order to properly evaluate the situation, please provide as much supplementary information as possible, such as: maps, plans, information about surrounding property, etc. APPLICIANT SHALL BE PRESENT AT THE SCHEDULED HEARING. I understand that I have applied for a variance from the requirements of the Shoreland Management Ordinance of Otter Tail County.
