VARIANCE REQUESTED IS: Allow 8 foot setback from permanent structure (new garage) to septic system holding tanks.
* Two tanks (1000 and 1500 gallon) were installed and certified in 1987.
* A variance is being requested as part of the process to receive a permit to install a three
bedroom drain field in May 1994.
* Allowing present system to ro»in in place will place the holding tanks in the optimum position
for the configuration of this 75' lot.
* Alternatives are available but extremely limited in lieu of the certified tanks and location
already in place.
* Following Information has been secured for the septic system permit process:
- copy of present permit (1987)
- Approval by Corliss Twp. to cross twp. road
- Notarized letter of understanding by property owner where drain field will be located
— Perculation test data by A. Jorgenson, Perham, MN
- Preliminary discussions with Butler Hardware on drain field installation

MOTION AS FOLLOWS:
Motion was made by Carl Johnson, seconded by Craig Anderson and unanimously carried, to approve a variance
of 2' from the required 1 O' setback for the location of a 26' by 30' garage 8' from the existing septic system
holding tank. It should be noted that adequate area exist for the maintenance and servicing of the existing septic
system.

water level setback of 100' and a variance of approximately 2' from the required 50' shore impact zone
setback for the construction of a new dwelling approximately 48' from the ordinary high water level mark.
The property is described as Lot 48 and an adjacent tract. Rainbow Lodge, East Battle Lake in Girard Township.
The audience was polled with no one speaking for or against the request. After consideration, motion was made
by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the variance as requested.
The applicant will be 10' further back with the new structure.

Terence J. Moore and Bonnie L. Burgess, Perham, MN, requested a variance of approximately 2' from the
required 10’ setback for the location of a 26' by 30' garage 8' from an existing septic system holding tank. The
property is described as Lot 4, Johnson Beach, Little Pine Lake in Corliss Township. The audience was polled
with no one speaking for or against the variance request. After consideration, motion was made by
Carl Johnson, seconded by Craig Anderson and unanimously carried, to approve a variance of 2' from the
required 10' setback for the location of a 26' by 30' garage 8' from the existing septic system holding tank. It

Todd Corey Smedstad - Approved
Todd Corey Smedstad, Fergus Falls, MN, requested a variance of approximately 4' from the required side lot
line setback of 10'for the location of a 26' by 36'addition, with a tuck under garage, approximately 6'from
the side lot line; a variance of approximately 4’ from the required side lot line setback of 10' for the
construction of an 8' by 26' attached deck approximately 6' from the side lot line and a variance of
approximately 53' from the required ordinary high water level setback of 100' and a variance of
approximately 3' from the required shore impact zone setback of 50' for the construction of an 8' by 26'
attached deck approximately 47' from the ordinary high water level mark. The property is described as Lot
23, Cedar Park Club, Swan Lake in Dane Prairie Township. The audience was polled with no one speaking for
or against the request. After consideration, motion was made by John Everts, seconded by Cecil Femling and
unanimously carried, to approve a variance of approximately 4' from the required side lot line setback of 1 O'
for the location of a 26' by 36' addition, with a tuck under garage, approximately 6' from the side lot line.
This addition will be no closer to the lake than the existing structure and can be no closer than 6' to the
property line of Reserve Lot E. The finished floor of the garage will be higher than 3' above the water table. It
should be noted that Reserve Lot E is presently not developed. Reserve Lot E is low and perhaps not a buildable
lot. After additional consideration, motion was made by John Everts, seconded by Craig Anderson and
unanimously carried, to approve an 8' by 20' attached deck to be considered as the water-oriented accessory
structure for this parcel. No side lot line variance is being granted for the 8' by 20' deck.

Einar and Ruth Piippo, New York Mills, MN, requested a variance to subdivide a parcel of less than 2.5 acres to
be used as a building site. The property would have 500'bordering US Highway 10,400' bordering a
township road and 375' bordering adjacent agricultural land. The property is described as part of the
Northwest Quarter of the Southwest Quarter, Section 9 of Newton Township. The audience was polled with no
one speaking for or against the request. After consideration, motion was by Craig Anderson, seconded by Cecil
Femling and unanimously carried, to approve the variance as requested with the condition that a registered
surveyor's drawing will be provided at the time of the recording. The parcel is approximately 1.5 acres and
should not require any additional variance for use as a building site. The hardship being that the tract is
separated from the applicants other property by the roads described above.

Erhardt W. and Janet L. Rosen - Approved
Erhardt W. and Janet L. Rosen, Perham, MN, requested a variance that would allow the applicants the right to
construct a dwelling on a contiguous substandard lot acquired after the enactment of the February 5th, 1992
ordinance. The property is described as part of Government Lot 3, Section 31 of Corliss Township on Big Pine
Lake. The audience was polled with no one speaking for or against the request. After consideration, motion v/as
made by Carl Johnson, seconded by Cecil Femling and unanimously carried to approve the variance as
requested, The applicants indicated that they were in the process of acquiring this property prior to February
5th, 1992, A purchase agreement had been signed in November of 1991, but because of the death of the
property owner the property transaction was delayed until after February 5th, 1992, The granting of the
variance request will allow the applicants to enjoy the same rights as those individuals who acquired property
prior to February 5th, 1992.
Allen H, Sother and Corrine Johnson - Withdrawn
1Allen H. Sather and Corrine Johnson, Minneapolis, MN, requested a variance to resurvey three existing
parcels, as shown on the copy of the half section map on file with the County Auditor's office, into three lots as
shown on the copy of the surveyor's drawing on file with the County Auditor office. Parcels A, B and C as shown
on the surveyor's drawing would not have the required 150' of lot width and lots A and B would not meet the
required 40,000 square feet of lot area for platted lots on a recreational development lake. The property is
described as part of Government Lot 4, Section 16 of Candor Township on Leek Lake. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Craig Anderson,
seconded by Cecil Femling to deny the variance as requested as no adequate hardship had been shown and the
granting of this variance would create substandard lots. After additional consideration and discussion the
applicants requested that they be allowed to withdraw their variance request. The request to withdraw the
variance application was granted by the board.
