After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to approve a variance of approximately 4' from the required side lot line setback of 1 O' for the location of a 26' by 36' addition, with a tuck under garage, approximately 6' from the side lot line. This addition will be no closer to the lake than the existing structure and can be no closer than 6' to the property line of Reserve Lot E. The finished floor of the garage will be higher than 3' above the water table. It should be noted that Reserve Lot E is presently not developed. Reserve Lot E is low and perhaps not a buildable lot. After additional consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve an 8' by 20' attached deck to be considered as the water-oriented accessory structure for this parcel. The property would have 500'bordering US Highway 10,400' bordering a township road and 375' bordering adjacent agricultural land. The property is described as part of the Northwest Quarter of the Southwest Quarter, Section 9 of Newton Township. The audience was polled with no one speaking for or against the request. After consideration, motion was by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the variance as requested with the condition that a registered surveyor's drawing will be provided at the time of the recording. The parcel is approximately 1.5 acres and should not require any additional variance for use as a building site. The hardship being that the tract is separated from the applicants other property by the roads described above. % I ■'i Erhardt W. and Janet L. Rosen - Approved Erhardt W. and Janet L. Rosen, Perham, MN, requested a variance that would allow the applicants the right to construct a dwelling on a contiguous substandard lot acquired after the enactment of the February 5th, 1992 ordinance. After consideration, motion v/as made by Carl Johnson, seconded by Cecil Femling and unanimously carried to approve the variance as requested, The applicants indicated that they were in the process of acquiring this property prior to February 5th, 1992, A purchase agreement had been signed in November of 1991, but because of the death of the property owner the property transaction was delayed until after February 5th, 1992, The granting of the variance request will allow the applicants to enjoy the same rights as those individuals who acquired property prior to February 5th, 1992. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling to deny the variance as requested as no adequate hardship had been shown and the granting of this variance would create substandard lots. After additional consideration and discussion the applicants requested that they be allowed to withdraw their variance request. The request to withdraw the variance application was granted by the board.
