SPECIFY VARIANCE REQUESTED The request is to locate a 12' X 45'cabin
38' from the high water mark on lot 1 & 2 of Big Pine Lake.
(COMMENTS) My previous application for a variance was denied on Sept. 14,2000.
As a result of that meeting, I have tried to address the objections of the
board. The purposed structure is 38 feet from the high water mark of the lake.
It is also 5 to 10 feet farther back from the lake than almost all of the
homes on Evergreen Beach. I have reduced the size of the building to fit better
on the lot. The total improvements only 5.7% of the lots. The holding tank
and small storage building will be located so they will not require a variance.
I feel that this building a very minimal use of the lot and still allow me
to use the properity in a way similar to the other lots on Evergreen Beach.
I UNDERSTAND THAT I HAVE APPLIED FOR A VARIANCE FROM THE REQUIREMENTS OF THE SHORELAND
MANAGEMENT ORDINANCE/SUBDIVISION CONTROLS ORDINANCE OF OTTER TAIL COUNTY.
I ALSO UNDERSTAND THAT OTHER PERMITS MAY BE REQUIRED, IT IS MY RESPONSIBILITY TO
CONTACT LAND & RESOURCE MANAGEMENT REGARDING THIS MATTER.

Ralph Heidorn - Approved with condition.
Motion was made by Steve Schierer, second by Cecil Femling, and unanimously carried, to approve a variance of 37’
from the required ordinary high water level setback of 75’ for the placement of a 12’ by 45’ structure 38’ from the
ordinary high water level with the condition that one of the two existing shed must be removed and the remaining shed
must be placed in the location as indicated on the applicant’s drawing. It was noted that the granting of the variance
as requested would provide the applicant with a reasonable use of his property. Hardship is a substandard lot of
record.
