It was noted that this is a special case due to the applicant's receipt of non-consistent information. The property is described as part of Government Lot 1, Section 25 of Dead Lake Township on Dead Lake. Michael J. Doyle represented the applicant at the hearing. Letters from Wally Morton, Michael J. Doyle and Ray Rau were read for the record. The audience was polled with Wally Morton and R. L. Freeman speaking in favor of the variance request. The applicant informed the board that he has removed the porch from his building plans and is turning the dwelling so that the longer dimension of the dwelling will face the water frontage. After consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a variance of 158' from the required ordinary high water level setback of 200' and a variance of 58' from the required shore impact zone setback of 100' for the construction of a two bedroom cabin with an attached garage 42' from the ordinary high water level. Wayne Froslle - Denied Wayne Froslle, Rothsay, MN, requested a variance of 4' from the required side lot line setback of 10' for the construction of a 1 O' 11" addition to the north side of an existing structure and for the construction of a deck in the front of the existing structure and for the construction of a deck in the rear of the existing structure being approximately 6'from the side lot line. The property is described as Lot 15, San-Dee-Cove- Beach, Lake Lida in Lida Township. The audience was polled with Conrad Posz, Monica Stutsman, and Marie Posz speaking to the granting of the variance request. After additional consideration, motion was made by John Everts, seconded by Craig Anderson, and carried with Cecil Femling voting no, to deny the variance as requested as no adequate hardship had been shown. , Eickschen - Denied Daniel J. Eickschen, Perham, MN. requested a variance of 19' from the required road right-of-way setback of 20' for the location on an existing fence 1' from the road right-of-way. The property is described as part of Government Lot 6, Section 31 of Corliss Township on Little Pine Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and earned with George Walter voting no, to deny the variance as requested. The property is described as Lots 1,2, 3 and 4, Ethel Beach, Ethel Lake in Girard Tcrivnship. The audience was polled with no one speaking for or against the request. Helen Sayer - Approved Helen Sayer. Cooperstown, ND, requested a variance of 67' from the required ordinary high water level setback of 200' for the construction of an addition to an existing structure 133' from the ordinary high water level and a variance of 82' from the required ordinary high water level setback of 200' for the addition of a roofed deck on the lake side of the existing structure 1 18' from the ordinary high water level. This deck would replace an existing open air deck which is 122' from the ordinary high water level. The property is described as the West 200' of the East 1,52.0' of Si /2 of NE1 /4, Section 9 of Eagle Lake Township on Middle Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling. seconded by Randall Mann and carried with John Everts abstaining, to deny any additions (Covered Deck) that extend closer to the ordinary high water level than the existing dwelling. The applicant can build no closer than the existing dwelling, After additional consideration, motion was made by Craig Anderson, seconded by Randall Mann and carried with John Everts abstaining, to permit additions to the existing dwelling with the condition that they be no closer to the ordinary high water level than the existing structure. Loren Hoffman - Approved Loren Hoffman, Desert Hot Springs, CA, requested a variance to subdivide a parcel of less than 2,5 acres from an existing 5 acre parcel. The new parcel would be approximately 2.1 acres. The property is described as part of Sub Lot A of Government Lot 5, Section 28 of Girard Township on West Battle Lake. The applicant was represented at the hearing by Micheal Centers. The audience was polled with Dennis Barron addressing the variance request. A letter from Dennis and lone Barron was read for the record. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a variance that would permit the subdivision of a parcel of less than 2.5 acres from an existing 5 acre parcel with the conditions that a registered surveyor's drawing will be provided for both parcels, a letter indicating that there are no property line disputes must be provided at the time of the recording and that the remaining parcel would not be subdivided any further.
