Motion
March 26,1998 meeting - After consideration, motion was made by Craig Anderson, seconded by
John Everts and unanimously carried, to approve a variance of 6’ 4” from and 18 maximum height of a
non-dwelling structure for the construction of a 56’ by 63’ shop having an overall height of 24’ 4”. After
additional discussion and consideration, motion was made by Craig Anderson, seconded by Les Estes
and unanimously carried, to table the remaining portion of Mr. Ziolkowski’s variance request until the
April 2, 1998, meeting while he reviews the requirements for a performance bond. April 2,1998
meeting - After discussion and consideration, motion was made by Craig Anderson, seconded by John
Everts and carried with Leona Zimmerman abstaining, to approve a variance of 20’ from the required
ordinary high water level setback of 200’ for the construction of a dwelling 180’ from the ordinary high
water level and to permit the existing dwelling to remain in use during the construction period and to
allow a reasonable period of time after the construction of the new dwelling for the demolition of the old
dwelling by the applicant with the condition that the applicant must provide a performance bond when
the site permit for the new structure is obtained and the performance bond must be in an amount and
for a period of time as specify by the Land and Resource Department.

Norman and Shirley Long - Denied
Norman and Shirley Long, Erhard, MN, requested a variance of 25’ from the required ordinary high
water level setback of 100’ for the placement of a 10’ by 24’ roof over an existing deck and to screen in
the side walls both above and below the existing deck. The existing deck is approximately 75’ from the
ordinary high water level. The property is described as part of Government Lots 8 and 9, Section 10 of
Friberg Township by Heilberger Lake. The audience was polled with Gordon Hanneman speaking in
favor of the variance request. After consideration, motion was made by George Walter, seconded by
Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship
had been shown, the granting of the variance would place the structure closer to the ordinary high
water level than the existing structure and the applicants already have a water - oriented accessory
structure.
Stephen Austvold - Approved
Stephen Austvold, Fergus Falls, MN, requested a variance of 55’ from the required ordinary high water
level setback of 100’ and a variance of 5’ from the required shore impact zone setback of 50’ for the
addition of a foundation and for repairs to the roof of an existing dwelling or for the placement of a new
dwelling on the current site which is 45’ from the (lake) ordinary high water level. It should be noted
that if a new foundation were placed under the existing dwelling the structure would be moved to
comply with the 10’ side lot line setback. The property is described as part of Government Lot 3,
Section 24 of Buse Township by Swan Lake. The audience was polled with Gene Wells stating no
objections to the variance as requested by the applicant. After consideration, motion was made by
Randall Mann, seconded by Craig Anderson and unanimously carried, to approve the use of the string
line by the applicant for the proposed development.
Peter Ziolkowski - Approved/Tabled
Peter Ziolkowski, Perham, MN, requested a variance of 40’ from the required ordinary high water level
setback of 200’ for the construction of a dwelling 160’ from the ordinary high water level and a variance
of 6’ 4” from the 18’ maximum height of a non-dwelling structure for the construction of a 56’ by 63’
shop having an overall height of 24’ 4”. The property is described as part of Government Lots 6 and 7,
Section 31 of Corliss Township by an unnamed lake (Robinson). The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig Anderson,
seconded by John Everts and unanimously carried, to approve a variance of 6’ 4” from and 18
maximum height of a non-dwelling structure for the construction of a 56’ by 63’ shop having an overall
height of 24’ 4”. After additional discussion and consideration, motion was made by Craig Anderson,

Wayne Pudwill - Withdrawn
Wayne Pudwill, Detroit Lakes, MN, requested a variance to cover 31% of the total lot area with
impervious surfaces. The new addition and concrete will add approximately 782 more square feet.
There will be one driveway taken out equaling about 429 square feet. The 782 square feet added less
the 429 square feet removed leaves a net increase of 353 square feet. The addition of 353 square feet
to the remaining impervious surfaces equals 9,282.8 square feet or 31% of the total lot area. This
compares to 29.9% of the total lot area, which is presently covered, with impervious surfaces. The
property is described as Lots 19, 20 and 21, Midland Beach, Pelican Lake in Dunn Township. March
26,1998 meeting - The audience was polled with no one speaking for or against the request. After
discussion and consideration, motion was made by Randall Mann, seconded by Craig Anderson and
unanimously carried, to table the applicant’s request until the April 2, 1998 meeting to allow the
applicant an opportunity to consider other alternatives and plans. April 2,1998 meeting - After
discussion and consideration, the applicant requested permission to withdraw his variance application.
The Board of Adjustment acknowledged and accepted this request.

It was noted that the applications of Eric Wm. Gronner and Stanley and Marcella Silbernagel schedule
for a public hearing at the April 2, 1998 Board of Adjustment meeting had been withdrawn by the
request of the applicants prior to the scheduled meeting date. The Board of Adjustment acknowledged
and accepted these application withdrawals.
