Our immediate family has owned this property since 1946 and our grandmother owned it for many years
before that. We understood that our lot was able to be divided into two lots with 75 feet of lakeshore each,
which has been the case for the other lakeshore owners until 1992 when the requirements changed. The
named in this application are the owners of the lot but our father James J. Pauly, who is elderly, was living
at the lake home. He must have received notice of the change in lakeshore requirements increasing to 100
feet per buildable lot but did not understand its significance nor inform us. We the children and owners
were never directly notified and none of us live in the Otter Tail/Perham area so we were unaware of these
changes until the lake home burned down in January of 2003 changing our father’s living arrangements.
We then inquired about dividing the lot so that we could move forward with what was best for the family
and discovered the change in the requirements. Given the unusual circumstances described above
requesting that a variance be granted to allow two buildable lots with 75 feet of lakeshore per lot. Also the
access to the property is a road easement and not 66 feet which does not allow us to comply to the plating

After consideration and discussion, Cecil Femling made a motion, second by Rod Boyer and unanimously carried, to
deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for
the granting of the variance as requested and the granting of the variance as requested would establish a precedent
that the Board of Adjustment does not desire to establish.

Township, requested a variance of 35’ from the required ordinary high water level setback of 75’ for an
addition to an existing structure 40’ from the ordinary high water level. Randall Mann, Chair, polled the
audience with no one speaking for or against the variance as requested. A phone call from Jan Tubandt in
support of the variance as requested was noted for the record. After consideration and discussion, Steve
Schierer made a motion, second by Michael Conlon and unanimously carried, to approve a variance of 35’
from the required ordinary high water level setback of 75’ for an addition, as depicted on the applicants’
drawing dated February 9, 2005, to an existing structure 40’ from the ordinary high water level (channel).
Hardship is water on two sides of the applicants' property.

by Rod Boyer and unanimously carried, to deny the variance as requested as no adequate hardship unique
to the property had been shown that would allow for the granting of the variance as requested and the
granting of the variance as requested would establish a precedent that the Board of Adjustment does not
desire to establish.
Tim Deuel - Approved with a condition. (7:38 p.m.)
Tim Deuel, part of Government Lot 7, Section 10 of Star Lake Township by Star Lake, requested a
variance of 2T from the required ordinary high water level setback of 75' for an 18’ by 18' addition to an
existing structure located 54’ from the ordinary high water level. Randall Mann, Chair, polled the audience
with no one speaking for or against the variance as requested. After consideration and discussion, Steve
Schierer made a motion, second by Paul Larson and carried with Cecil Femling voting no, to approve a
variance of 2T from the required ordinary high water level setback of 75’ for an 18' by 18’ addition to an
existing structure located 54’ from the ordinary high water level with the condition that an existing shed
must be placed in a location that complies with the setback requirements. The proposed addition is no
closer to the lake than the existing structure and the proposed addition will not obstruct the adjacent
properties view.

Dear Dianne,
All property owners within 500' of the applicant's property were notified of the hearing. There were 15
different properties that were notified. In addition, the following were also notified:
Otter Tail County Cola,
Otter Tail County Highway Department,
Department of Natural Resources, and
Township Board of Supervisors.
Your interest in attending would be to either support or oppose the applicant's request for variance. The
letter indicating minimum lot sizes was included with the property tax statements back in 1992.
The applicants have a single piece of property. They want to create two lots. Each lot would have
approximately 75' of lake frontage/width. The minimum size when creating platted lots on a general
development lake is 100' of frontage and 20,000 square feet of area. When subdividing metes and
bounds property the minimum size is 5 acres. The applicant's property is approximately 2 acres.
Lots that have less than the required frontage and less than the required area can be built on if the
setbacks are met. If the setbacks cannot be met, then that property owner has the right to apply for a
variance for the setback standard(s) that is/are not being met.
Not receiving the letter noted by the applicants is not a reason for granting the variance. The six member
Board of Adjustment looks at a number of factors when deciding whether or not to grant a variance. For
example,
1. onsite inspection of the property,
2. existing conditions in the immediate area,
3. applicant's ability to use the property without the variance,
4. input from those notified ,
5. hardship unique to the property that would justify the granting of the variance etc.

just a couple of questions regarding the requested variance at the above property address, i live next
door and am wondering how many people did get a letter regarding the requested variance, i'm new to
the process and am not familiar with these things, according to the directions on how to get to fergus falls
from "mapquest" from the internet, it is 183.06 miles from my home, why would i want to attend? should
i? reading the statement at the bottom of the letter, i don't recall ever getting a letter from the county
advising me that 100' is now required to build on. does that make it okay to get a variance? i don't know,
that's why i'm asking for your patience, i think the lake environment is the important thing here, rather
than for our convenience, but like i said, i've never been to a hearing, and.......
