minimum lot sizes under the Shoreland Management Ordinance.

The Otter Tail County Board of Adjustment met Thursday, May 3, 2001, with the following persons in

Call to Order - Randall Mann, Chair, called the meeting of the Board of Adjustment to order at 6:30 p.m.

Hearing no corrections or additions the minutes of the April 12, 2001 meeting was approved as mailed.
The following variance requests were heard:

Laura Johnson, Perham, MN, requested a variance to subdivide, by metes and bounds description, .5 acre
parcel from an existing 11.14-acre parcel. The proposed tract does meet the minimum size required for
platted lots on a general development lake, but does not meet the 5 acre minimum size required for metes
and bounds subdivision within the shoreland area. The property is described as part of Government Lot 3,
Section 30 of Corliss Township by Little Pine Lake. The audience was polled with no one speaking for or
against the request. After discussion and consideration, motion was made by Steve Schierer, second by Mark
Steuart, and unanimously carried, to deny the variance as requested as no adequate hardship unique to the
property had been shown that would allow for the granting of a variance from the platting requirements of the
ordinance.

Enclosed in the folder is a legal description for the tract of land that you are
purchasing from Laura Johnson. Also enclosed is a copy of Certificate of Survey T3084-
15R showing its location. I had earlier sent a copy of the survey and a legal description
for your tract and also for Pam Redezke's tract to Attorney Terry Karkela. We have set
survey markers as shown on the survey. A wood lath with orange flagging has been set
by each marker. We have shown the buildings and the proposed 66' wide access road as
requested. We have also surveyed and described a 20' wide road easement to the tract.
We had earlier described an easement across your tract and across the Berry tract to
connect with the existing road easement coming from the east. Janelle Berry contacted
me and stated that they were not in favor of that and requested that I remove it from the
drawing which we have now done. Terry Karkela should handle everything from hereon.
Also enclosed is a statement for professional services. If you have any questions
regarding our survey, please feel free to contact my office. Thank you for the
opportunity to provide our services.

parallel with the northerly line of Govt. Lot 3, 75 feet; thence southerly

the riparian rights as pertain to said tract of land which contains 0.37 acre,

of Tract 10A with the condition that it will be permanently attached to the property to the north. After additional
consideration, motion was made by Randall Mann, seconded by Rod Boyer and unanimously carried, to approve the
subdivision of Tract 3 and 10 with the condition that they are permanently attached and become one lot for
development purposes. After additional consideration and discussion, motion was made by John Everts, seconded by
Cecil Femling and unanimously carried, to approve the proposed subdivision of Tract 11 subject to the dedication of a
public road for ingress and egress from Tract 11 to the township road. It should be noted that a registered surveyor’s
drawing is required for all three proposed subdivisions.

John Bleichner and has had a residence thereon since approximately
1960. Tract 3 alone has 100 feet of lake front and has more than
20,000 square feet and is over one acre when combined with Tract

Dean Jorgenson, Erhard, MN, requested a variance to split a 6.83 acre parcel, as shown on the
surveyor’s drawing dated April 13, 1999, into two parcels of less than 5 acres. Parcel A as indicated on
the registered surveyor's drawing is approximately 3.51 acres and Parcel B would be 3.32 acres. It
should be noted that a survey dated September 15, 1993 indicated a total of 8.5 acres. The property is
described as part of Government Lot 5, Section 28 of Maplewood Township by Crystal Lake. The
audience was polled with no one speaking for or against the applicant’s request. After consideration,
motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to approve
the proposed subdivision as requested with the condition that a registered surveyor’s drawing must be
provided at the time of recording. It was noted that there is adequate space for two on-site septic
systems and that each parcel has public road access.
