After additional consideration and discussion, motion was made by Randall Mann, seconded by Mark Steuart and
carried with Cecil Femling abstaining, to deny the variance as requested as the applicants have an alternative to a
metes and bounds subdivision.

David and Glenda M. Bengtson, Pelican Rapids, MN, requested a variance to subdivide a parcel of
approximately 40,384 square feet from an existing 3.25 acre parcel. Minimum size required is 2.5
acres. The property is described as the East 430’ of the South 10 Acres of the Southeast Quarter of the
Southeast Quarter, Section 23 of Norwegian Grove Township. The audience was polled with James
Marty and Harold Marty expressing concerns with additional residential development in a generally
agricultural area and with Jerry Varholdt expressing concerns with how close this new development
would be to existing property owned by members of his family. Although, Harold Marty is an officer of
Norwegian Grove Township, it should be noted that he was addressing the Board of Adjustment as a
private landowner wishing to express his concerns with the applicant’s request and was not
representing or speaking on behalf of the Nonwegian Grove Township Board. After consideration and
discussion, motion was made by Cecil Femling, to approve the variance as requested. The motion died
for lack of a second. After additional consideration and discussion, motion was made by Randall Mann,
seconded by Mark Steuart and carried with Cecil Femling abstaining, to deny the variance as requested
as the applicants have an alternative to a metes and bounds subdivision.
Wayne Sorem - Denied
Wayne Sorem, Ottertail, MN, requested either a variance of 58’ from the required ordinary high water
level setback of 200’ and a variance of 2’ from the 18’ maximum allowable height of a non-dwelling
structure for the location of a 26’ by 48’ structure, with an overall height of 20’, 142’ from the ordinary
high water level or a determination that the body of water is actually a river instead of a lake having a
structure setback of 100’. The property is described as part of Government Lots 5, 6 and 7, Section 35
of Gorman Township by Mud Lake. January 7,1999 meeting - The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Cecil Femling, second by
Randall Mann and unanimously carried, to table the applicant’s request until the April 1, 1999 Board of
Adjustment meeting for additional information concerning the ordinary high water level of Mud Lake.
April 1,1999 meeting - Tabled until the May 6, 1999 meeting for a determination of the ordinary high
water level by the Department of Natural Resources. May 6,1999 meeting - A letter from the Land
and Resource Department in cooperation with the Department of Natural Resources establishing the
ordinary high water level and also establishing the setback of the applicant’s structure at 120.5 feet
from the ordinary high water level was read for the record. After discussion, motion was made by
Randall Mann, seconded by Cecil Femling and carried with Rod Boyer abstaining, to deny the variance
as requested as no adequate hardship had been shown and there is adequate room on the applicant’s
property for the location of this structure. After this action had been taken the applicant indicated that
he had not been given an opportunity to fully address the board. Randall Mann then offered to
withdraw his motion and allow the applicant an additional opportunity to be heard. Cecil Femling
agreed with Randall Mann’s offer. After additional discussion and consideration, motion was made by
Randall Mann, seconded by Cecil Femling and carried with Rod Boyer abstaining, to uphold the site
permit as issued on June 16, 1998. After additional consideration, motion was made by Cecil Femling,
seconded by David Holmgren and unanimously carried, to allow the applicant until September 1, 1999
for the placement of the structure in a location that complies with the requirements of the ordinance.
