John Anderson, Jr., Clitherall, MN, requests permission to construct a 14' x 22' garage addition to existing dwelling 7 3/4 feet from lot line on Lot 6, South Point, in Girard Township. Letters of objection were presented and H. E. Frisby, represen­ ting the Girard Town Board spoke in support of said project. After considerable dis­ cussion, motion was made by George Walter to approve variance, hardship being best place on lot for garage, variance request of only 2% feet, garages being reasonable enjoyment of property for protection of equipment from thieves, etc.. The motion was seconded by Craig Anderson and carried with John Everts abstaining. Bert Lovelace, Fergus Falls, MN, requests permission to place a travel trailer 50 from lake on a 6 acre parcel in G.L. 2, Section 15 of Friberg Township. A letter from the Friberg Town Board stated opposition to project. After discussion motion was made by Craig Anderson to table until issue is resolved by Town Board. The motion was seconded by John Everts and carried with Tom Stringer voting "no". ^^^^,^urice Anker, Omaha, NE.Bill Kalar of the office of Land & Resource Management appeared before the Board relative to Mr. Anker's denial at the May 6th meeting requesting clarification of the setback requirements.The consensus of the Board was the setback requirement of the 200' as spelled out in the Shoreland Management Ordinance. The following applications for variance were considered; Mt.-rhle L. Messer, Fergus Falls, MN requested permission to construct an earth home on a 33 acre tract of land in the SE^SW'a of Section 11, Buse Township, 75 feet from the shore of an unnamed lake, tabled from the April 1st meeting, considerable discussion, motion was made by Tom Stringer, seconded by Craig Anderson and carried, to deny approval, no proven hardship shown. After Maurice Anker, Omaha, Nebraska, tabled from the April 1st meeting, requested a variance from the setback requirements on Lot 2, Block 1, Anchors Bay, Nidaros Township.After discussion, motion was made by Craig Anderson, seconded by Wilfred Estes and carried, to deny approval , no proven hardship shown. After considerable discussion, motion was made by Craig Anderson to approve construction at a point no closer to the lake, on a measure of line drawn from nearest point to the lake from dwelling on either side.. The motion was seconded by Tom Stringer and carried. Daniel S. Dear Mr. Anker: On June 3, 1982, the Otter Tail County Board of Ad:Justment indicated that when they denied your request for a LOO foot setback, they wanted your structure 200 feet from the ordinary high water mark. Since this is the case, our office's recomnendation of a set­ back of 150 feet from the lake has been overruled which means any building on this lot will have to be 200 feet from the ordinary high water mark. Please inform our office whether or not you would like your site permit issued for a lake setback of 200 feet as soon as possible so that this matter can be finalized. Since you were not present at the February 4, 1982 meeting of the Board of Adjustment your application for a variance was tabled until such time as either you or your designated representative can appear before the Board of Adjustment to discuss your application for a 100 foot variance. The Board of Adjustment meets the first thursday of each month which means that you should Inform our office which meeting you could attend so that we can schedule your application with the Board of Adjustment. Enclosed please find a copy of Otter Tall County's Shoreland Management Ordinance. Please note Section VI. 1. b. which states that before a site permit can be Issued all terms of this ordinance including setbacks mus be complied with.
