COMPLAINT The Complainant being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the above-named Defendant committed the offense described below. The Complainant states that the following facts establish PROBABLE CAUSE: Complainant, Malcolm K. Lee, is the duly acting and appointed Administrator for the Otter Tail County Department of Land and Resource Management, who investigated and received information regarding the below-described offense. That during a meeting of the Planning Commission held on August 1, 1984, complainant became aware of a grading and filling project which had previously been performed on Lot P of Auditor's Subdivision No. 110 in Government Lots 7 and 8 of Section 4, Nidaros Township, in Otter Tail County, Minnesota. In the process of building a road a cut had been made in a bank within 1,000 feet of Stuart Lake. As part of his investigation complainant spoke with Mike Froslee, of Vining, Minnesota, who^ confirmed that he did the excavating for Roscoe Raining. Complainant spoke to Roscoe Raining on August 7, 1984, and Roscoe Raining said that he had the work done during the summer of 1983 when he o\med the property. The above-facts constitute the Complainants basis for believing that the above-named Defendant, <5lk during Nidaros Township (location) ,19^the summer in the above-named County, committed the following described OFFENSE GRADING AND FILLING IN SRORELAND AREA WITROUT A CONDITIONAL USE PERMITCharge: In violation of Tail Co. Shoreland Mgmt. Ordinance Section IV. 2.a. and VI. 7.b. Penalty: 0-90 days and/or $500.00 fine That at the above stated time and place and within the jurisdiction of this Court, one ROSCOE RAINING, then and there being, hereinafter referred to as the defendant, did willfully, wrongfully and unlawfully grade and fill in a shoreland area or alter the natural topography where the slope of the land is toward a public water, without first obtaining authority by a conditional use permit, contrary to the form of said statute made and provided and against the peace and dignity of the State of Minnesota.
