Joseph and Elizabeth Merz - Approved as requested.
Joseph and Elizabeth Merz, Underwood, MN, requested a variance to subdivide an existing 8.01 acre parcel
into three tracts approximately 2.6 acres in size. Proposed Parcel A contains a wetland at the backside.
Proposed Parcel B does not contain a wetland and is not within the shoreland area. Proposed Parcel C does
not contain a wetland and is within the shoreland area. The minimum size for metes and bounds parcels
within the shoreland area and for those parcels containing a wetland is 5 acres. The property is described as
the North 947’ of the East 367.99’ of the West 417.99’ of the Southwest Quarter, Section 28 of Sverdrup
Township by Onstad Lake. The audience was polled with Robert and Cory Pourrier speaking in support of the
variance as requested. A letter from Steve Jorgerson, PJ Excavating, noting adequate area for a septic
system was read for the record. After consideration and discussion, motion was made by Cecil Femling,
second by David Holmgren and unanimously carried, to approve a variance which would allow for the metes
and bounds subdivision of an existing 8.01 acre parcel into three tracts of approximately 2.6 acres as noted on
the applicant registered surveyor’s drawing. It was noted that all three parcels have access to a public road,
have room for development not requiring additional variances and the property will not be subdivided into any
additional lots. Hardship is the terrain of the applicant’s property.
Linda and Tom O’Donnell - Approved with conditions.
Linda and Tom O’Donnell, Richville, MN, requested a variance of 15’ from the required ordinary high water
level setback of 75’ and a variance of 5’ from the required road right-of-way setback of 20’ for the placement of
an 11’ by 19’ addition 60’ from the ordinary high water level and 15’ from the road right-of-way; a variance to
place an 8’ by 12’ addition 3’ into the road right-of-way and 12’ from the drain field and a variance to place a
21’ by 42’ addition IT into the road right-of-way, 7’ from the drain field and 65’ from the ordinary high water
level. The property is described as Lots 2 and 3, Klein Adams Point, Marion Lake in Dead Lake Township.
The audience was polled with no one speaking for or against the request. After consideration and discussion,
motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve the
variances necessary from the ordinary high water level and from the road right-of-way for the proposed
development as depicted on the revised drawing submitted at the public hearing with the following conditions:
1.) a letter from the township approving the setback from the road right-of-way must be obtained, 2.) no more
than 25% of the total lot area can be covered with impervious surfaces, and 3.) the proper setbacks from the
septic system (tank and drain field) must be maintained. It was noted that none of the proposed development
would be any closer to the ordinary high water level than the existing structure. Hardship is a substandard lot
of record.
Eniest Roberson - Denied
Ernest Roberson, Clitherall, MN, requested a variance to allow an existing holding tank to remain 8’ from the ■
corner of an existing 26’ by 38’ garage. The required setback is 10’. In 1989 the garage was considered a
non-dwelling structure and was placed 8’ from the holding tank. The applicant will be connecting the existing
garage, with sleeping loft, to the existing house changing the status of the garage from a non-dwelling
structure to a dwelling structure. The property is described as Lots 30 and 31, Robinson’s Addition to
Clitherall, Clitherall Lake in Nidaros Township. The audience was polled with Debra Biederman speaking
against the variance as requested. A letter from Rubye Y. Biederman opposing connecting the existing
garage to the existing house was read for the record. After consideration and discussion, motion was made
by Cecil Femling, second by Steve Schierer and unanimously carried, to deny the variance as requested
noting public health concerns and noting that no adequate hardship unique to the property had been shown
that would allow for the granting of the variance as requested.

Re: Variance for Ernest Roberson
Dear Otter Tail County Board;
My property is adjacent to Mr. Roberson‘s property. I do not want the variance to go thru for the
following reasons;
By his connecting the existing garage to the existing house, my view will be obstructed to the east
of my property more than it already is. My view to the west is already completely gone and I do not want
this to happen to the east of my property as well.
Also, when I built my garage which was built before Mr. Roberson’s garage, the County informed
me that 1 could not put in there additional living arrangements for my children when they came to visit. So if
this is expectable for Mr. Roberson, then I feel that I should be able to do the same to accommodate my
family as well.
