Conditional Use Permit - Bryan A. & Pamela J. Odeaard: Motion by Lindquist, second by Froemming, and unanimously carried to approve a Conditional Use Permit to build a permanent structure on East Lost Lake (Sec. 1, Twp. 133, R. 41, Sverdrup Township, Lake #56-378) with conditions as recommended by the Planning Commission. Conditional Use Permit - Jim Anstadt: Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional use Permit to put in a retaining wall on Lake Lida (Sec. 14, Twp. 136, R. 42, Lida Township, Lake #56- 747) with conditions as recommended by the Planning Commission. Conditional Use Permit - Ronald & Kathleen Barth: Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use Permit to repair and remove an existing wall on Clitherall Lake (Sec. 6, Twp. 132, R. 39, Nidaros Township, Lake #56-238) with conditions as recommended by the Planning Commission. s Pomme de Terre Watershed Mr. Kalar reported on a recent meeting with several entities regarding the Pomme de Terre Watershed District. Fie provided a handout of statistics (suspended soils, phosphorus & nitrate levels, etc.) relative to the Minnesota River Basin. Discussion followed regarding a previous Joint Powers agreement and a need for Otter Tail County to either rescind or re-sign the agreement by July 1, 1999. Sewage Abatement List Request Motion by Lee, second by Lindquist, and unanimously carried to approve the request from the Jewett Lake Association that Jewett Lake be placed on the sewage system abatement list. Edna Township - High Water Mr. Kalar presented a map showing several areas where water is flooding the roads. There is no immediate chance of the water receding. Edna Township requested permission to go ahead with raising the road levels before the Planning Commission meeting on June 16^^. Discussion followed. No action was taken. Service Fee Appeal Service Fee Systems Administrator, Michele Petterson, presented a request from the Evangelical Lutheran Church in Parkers Prairie to appeal the annual service fee assessment for refuse of $22.50. Motion by Froemming, second by Lindquist, and carried to uphold the recommendation of the Solid Waste Advisory Committee to deny the appeal because other churches are being charged based on the same formula and and the church does generate garbage. Planning Commission May 19. 1999 Page 4 Laura Johnson - Approved With Conditions: A Conditional Use Permit Application to eliminate a berm and fill a hole that was built several years ago to eliminate run-off from cattle into the lake. The cattle were sold approximately 5 years ago. Details of the project are on file at the Land & Resource Management Office. The property is described as GL 3 & 4 Ex Tracts (14.23 Ac), Section 30 of Corliss Township: Little Pine Lake (56-142), GD. Laura Johnson & Peggy Johnson represented the Application. Elaine Johnson indicated that there has never been any manure placed into the manure pit. Motion: A motion by Zimmerman, second by Lachowitzer to approve allowing an extension beyond Tract 11 provided: 1. A berm remains adjacent to the lake. 2. The land slopes away from the lake. 3. The area is stabilized with sod or seed. 4. Approval from the MPCA is obtained for abandoning the manure pit (the MPCA’s requirements must be followed). 5. All concrete is removed from the site and disposed of off-site. Voting: All members in favor. Replace rotting posts and tin which is pushing in toward lake with treated timber. Remove dirt fill that was hauled in when original wall was built and replace with natural sandy fill. We now request that the Dunvilla Restaurant be replaced with 4 new units. This most likely would be accomplished by building two (2) new duplex units to be compatible with the other buildings now existing at Dunvilla Villas Condominium complex. The net result will be the same as authorized by CUP #5215, which allows for four (4) condo units and four (4) boat slips. The property is described as Pt of Gov.
