Steve & Lisa Eystad - Variance Application Approved with Condition (6:04 p.m.)
After consideration and discussion, Thomas Lee made a motion, seconded by Michael Donoho by roll call vote with all
members in favor except Rick Wilson voting no to approve the variance request to construct an addition to the existing
dwelling & addition to the existing deck being 3’ from the RROW (alley strip) with the condition that the septic tank
be moved/replaced to meet the 10 setback to the structure which will require a compliance inspection on the septic
system. This decision is based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the
Board’s finding have been attached to and incorporated as an official part of the minutes which have been placed on file
with the Land & Resource Management Department. The variance as approved does not directly or indirectly grant any
other variances for future development.

determination that a practical difficulty exists is based upon consideration of the following criteria:

a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

The meeting was held via GoToMeeting due to the health pandemic and declared emergency in accordance with Minn. Stat. Sec.
13D.021 Subd. 1(1).
Called to Order - Thomas Lee, Chair called the meeting of the Board of Adjustment to order at 6:01 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the April 9, 2020 meeting.
The Board of Adjustment considered the following application(s) for variance:

Steve Eystad, property owner represented the variance application via GoToMeeting. The audience was polled with Robert & Wendy
Changstrom speaking in favor of the variance request. They indicated that they have a plan (future) to retire to their property as well
which is located on the other side of the alley.

I am requesting a variance to add an addition to our cabin to build to the lot line
of an Alley. The reason I would like to build to the lot line of the Alley is that my
lot is Sub Standard and I am out of room. No one will be effected by building to
the Alley line because no one has used the Alley since 1960 and possibly since its
conception in 1906. There is also a Public beach 200 feet east of said Alley.

We have not met, but I'm Barry's sister, Pam Trites. I'm writing to verify his note to you.
My parents purchased their lot on the north shore on Clltherall Lake In 1959 In order to build a
year-round home. We moved into our newly built home in January of 1960. My parents
mowed the alley from the day they bought their lot until 2007 when Mom could no longer
maintain her home and yard and needed to move.
I know from living there for years, and living the rest of my years within a radius of 25 miles
from there, from daily talks with Mom and Dad, and from visiting there 2-3 times a week that
the "alley" as we called it was never once used by anyone else. No one inquired about it and it
was maintained and respected as if it were part of our yard.
I truly hope this helps you and your wife, and the alley gets vacated.
