Motion: A motion by Schwartz, second by Erickson to approve the fill as requested,
allowing the 20’ height requirement of the Shoreland Management Ordinance be met,
with the following conditions: 1. The second dwelling (cabin) is removed from this parcel
by a transfer of land. 2. The Applicant must ensure the drainage goes east & south to a
ponding area on his parcel. 3. The project and conditions must all be completed by
October 1, 2005. Reasons for approval are the Applicant has removed 4 buildings
replacing them with one (1) and that this structure is for storage only since there is a
dwelling (cottage) onsite.

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, July 26, 2005, at
11:02 a.m. at the Otter Tail County Government Services Center with Commissioners
Bob Block, Chair; Roger Froemming, Vice-Chair; Dennis Mosher, Malcolm Lee, and
Syd Nelson present.
Approval of Agenda
Motion by Mosher, second by Lee, and unanimously carried to approve the County Board
agenda of July 26, 2005, with the following addition:
West Central Initiative Jail and CD/Meth Treatment Space Needs Study
Approval of IVlinutes
Motion by Froemming, second by Nelson, and unanimously carried to approve the County
Board minutes of July 19, 2005, as presented.
Approval to Pay Bills
Motion by Nelson, second by Lee, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
Planning Commission Recommendations
Conditional Use Permit-Marin Bay Condominium Assn. Inc:
The Conditional Use Permit Application for Marin Bay Condominium Assn, was
recommended for withdrawal as requested by a letter received by the Planning Commission
from John Bunnell, Treasurer of the Association. The Board of Commissioners accepted the
withdrawal as requested. The property is described as Marin Bay Condominium,
Community 30, Section 31 of Corliss Township; Big Pine Lake (56-130).
Conditional Use Permit - Northern Lights Resort/ChervI Harris:
Motion by Froemming, second by Nelson, and unanimously carried to approve a Conditional
Use Permit to replace cabin #10 and an addition, and replacement of three storage sheds as
presented, with the reason for approval as documented in the July 20, 2005, Planning
Commission minutes. The property is described as GL 9 Com S % Cor Section 25...,7.81
Acres, Section 25, Dead Lake Township; Dead Lake (56-383).
Conditional Use Permit - Leon C. Boehland:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional
Use Permit for a topographical restoration project with conditions as recommended by the
Planning Commission. The property is described as Pt of Lots 4, 5, 6 Camp Nirvana,
Section 3, Nidaros Township & Lot 1 & Pt. of Lot 2, Thomas Addition, Section 34 in Girard
Township; East Battle Lake (56-138).
Conditional Use Permit - S. Harold & Marilyn R. Vorvick:
Motion by Lee, second by Nelson, and unanimously carried to approve a Conditional Use
Permit for a driveway relocation project as presented. The property is described as Pt of
GL 6, Section 1, Norwegian Grove Township; Grove Lake (56-952).

The restoration would extend 14 inches up the side of the building at the highest point and
taper out. Total area involves approximately 750 square feet. The property is described

5. Harold & Marilyn R. Vorvick - Approved As Presented:
A Conditional Use Permit Application (as staled by the Applicant): Current multi-residence
private driveway routes close to our house and machine shed/shop building. For improved
safety, security and privacy as well as reduced environmental nuisance (dust and noise
control) we propose to construct a new segment of driveway 500ft. long that routes the
driveway further N.E. of our residence. Contractor JL Trucking, Excavating & Grading will
strip of black dirt, take base material from portion of existing road & replace black dirt over
portion of old section of driveway (cross-section of new driveway construction available for
viewing at the Land & Resource Office). Vacated driveway segment will be quit claimed
back to us & easement transferred to new segment. Driving surface of roadway will be 16'
wide. Additional load bearing base and gravel top surface will be brought in to supplement
materials removed from old roadway as necessary. The property is described as Pt of GL
6, Section 1, Norwegian Grove Township; Grove Lake (56-952), NE.
Harold Vorvick represented the Application.
Motion: A motion by Wilson, second by Maske to approve as presented, since the
driveway will be moved away from the Applicant's house. Voting: All Members In favor.
David & Tammy Mortenson - With A Condition:
A Conditional Use Permit Application (as stated by the Applicant): Replace existing damaged
drain tile with 12” drain tile in stated location on drawing (drawing on file with Land &
Resource Management). Total length will be approximately 300' long, original drainage tile
was approved with S U P. #1050, 9-4-74. The property is described as Lot 18 & Pt of 19,
Heilberger Lake Estates, Section 10, Friberg Township; Heilberger Lake (56-695), RD.
Dave Mortenson represented the Application.
Gordon Hanneman (Friberg Townboard Member) indicated that he has never seen the
water flow over the road.
Motion: A motion by Schwartz, second by Erickson to approve as presented, provided the
pipe drains into a rock spillway. Voting: All Members in favor.
Pleasure Land Estates / Rick & Laura Heinie - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): This request to allow for a 20
unit single family community (Pleasure Land Estates) on 16.5 acres with common ground
and services. Project to include a 5.5 acre park on lakeside of property. This request is
also to regrade old borrow area, (approx. 400 yd. dirt movement) The property is
described as S12 Rods of SW1/4 NW1/4 & N 221.8' of GL 3, Section 23, Rush Lake
Township; Rush Lake (56-141), GD.

Meeting of the Otter Tail County Planning Commission was held on July 20, 2005 at 6:30
P.M. in the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Jim Arno, Rod Boyer, Ken Erickson, Joe Maske, Bert Olson, Robert
Schwartz, Rick Wilson and Leona Zimmerman.
Members Absent: Les Estes and David Trites.
Nicole Hansen represented the County Attorney's Office and Bill Kalar represented the
Land & Resource Management Office.
Minutes of July 13. 2005: A motion by Maske, second by Erickson to approve with a
clarification on the motion for Teigen Bros Partnership; condition number one (1) should
state: 1. The “ditch side” s/ope"s”from the cul-de-sac to the westerly culvert must be 3 to
1 and be vegetated (i.e, hydro seed or coconut blanket).
Marin Bay Condominium Ass'n. Inc. - Withdrawn:
A Conditional Use Permit Application (as stated by the Applicant): To change docking
configuration (Exhibits on file for viewing at Land & Resource Mgt.). The property is
described as Marin Bay Condominium, Community 30, Section 31 of Corliss Township; Big
Pine Lake (56-130), GD.
A letter from John Bunnell, Treasurer, Marin Bay Condominium Association, Inc. was read
into the record. The letter requested their Application be withdrawn.
Motion: A motion by Boyer, second by Maske to accept the request to withdraw the
Conditional Use Permit Application. Voting: All Members in favor.
Northern Lights Resort / ChervI Harris - Approved As Requested:
A Conditional Use Permit Application (as stated by the Applicant): Replace current cabin #10
mobile home & addition with a 40' x 40' stick-built cabin. Replace three storage sheds
measuring a total of 254 square feet with one storage shed measuring 240 square feet.

Com S VS Cor Section 25.,., 7.81 Acres, Section 25, Dead Lake Township; Dead Lake (56-
383), NE.
Cheryl & Mike Harris represented the Application.
Motion: A motion by Erickson, second by Amo to approve as requested since this
proposal will reduce the Impervious surface onsite. Voting: All Members in favor.
Ahead of Schedule: The Commission got ahead of schedule, therefore. Bill Kalar gave
an update on the Shoreland Management Ordinance Revision process.
Leon C. Boehiand - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): Request permission to
partially restore the normal contour of the hill abutting the northeast and southeast side of
,,..the garage shop building under construction. This topographical restoration would
comprise approximately 35 yards of black sandy loam and rock to establish grass/flowers.
