Minnesota Having purchase*d a farm between two lakes we find that, the farmhouse is not suited for remodeling and we need to build a new house. We? are determined to preserve the natural environment of the Fjroperty. After meeting with various contractors, we have been advised that the most appropriate site for building lies within the normal 200' setback requirement. It does not seem to be reasonable or practical to set back from the lake the 200 ft distance due to the practical limits of the shorelands. The limits being that the waters involved are bounded by natural topographic divides which extend landward from the waters. ( see Shoreland Management Ordinanced Otter fail County Minn, item 35 "shoreland") The unique topography of this lakeshore places the 200' line in a valley, making it unsuitable for drainage. To maintain the environmental integrity of the lake we would like to have the septic as far away from the lake as possible. By movin the building forward, we will be able to take advantaqge of the natural slope of the land and direct our drainfield away from the lake. The only other property on the lake is a seasonal dwelling on the west end of the lake. Otherwise, we own the majority of the shoreline around the lake. According to Shoreland Management Ordinance, Ottertail County, MN Section VI, Part 5, Item C: "The granting of the variance will not. be contrary to the public interest or damaging to the rights of other persons or to property values in the neighborhood". In fact, it would increase the value of the new construction while maintaining the natural environment. We are therefore requesting the variance of iOOft. The audience was not polled as there was no one in attendance at the time of this hearing other than the applicants. After consideration, motion was made by John Everts, seconded by Victor Petterson and unanimously carried, to deny this variance request as no adequate hardship had been shown and the granting of this variance would establish a precedent. After additional discussion a motion was made by Victor Petterson, seconded by John Everts and unanimously carried to reconsider the variance request. After reconsideration, motion was made by Victor Petterson, seconded by Cecil Femllng and unanimously carried, to approve the construction of the bathroom as requested up to the string test, with the condition that the string test be applied as follows: from the southeast corner of the existing house of the applicant to the southeast corner of the house on the lot to the north and also the old outhouse must be removed. Due to a death In the family the applicant requested that his variance request be tabled until the October 1991 meeting. After consideration, motion was made by Dan Oehler, seconded by John Everts and unanimously carried, to table this request. It has been tabled until the October 10th, 1991 meeting. ■I NORMAN KUBELA - APPROVED .’f Norman Kubela, Wahpeton, ND, requested a variance to be approximately 46' from the river with his dwelling. The property is described as Lot 14, Channel View, Otter Tall River In Otter Tall Township, Tom Kubela appeared along with Mr. and Mrs. Norman Kubela to represent this variance request. The audience was polled with Marty Eltrelm speaking to this application, After consideration, motion was made by John Everts, seconded by Cecil Femllng to approved this variance request with the condition that the new trailer with the addition cannot be any closer to the river than the dwelling on Lot 15. After additional discussion this motion was amended to allow the new trailer with the addition to be placed up to the string line, with the string line being applied from the trailer house on Lot 15 to the yellow house to west, also the 8' by 20' trailer, the 8' by 30' trailer and the boathouse must be removed and when the new trailer and construction Is completed on Lot 14 the trailer house on Lot 15 will be removal. This motion carried unanimously.
