MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT June 6th. 1991 The Otter Tail County Board of Adjustment met Thursday, June 6th, 1991 with the following persons in attendance: Craig Anderson John Everts Cecil B. Femling Dan Oehler Victor Petterson George Walter Bill Kalar, Land and Resource Man^ment Wally Senyk, County Attorney CALL TO ORDER The meeting was called to order at 7:00 p.m. by Chairman George Walter. MINUTES APPROVED-May Chairman George Walter inquired of the Board if there were any corrections or additions to the May 2nd, 1991 minutes. HearingnoneChairman Walter declared the minutes approved as mailed. The following variance requests were heard: James I. Swenson - Denied James I. Swenson, Fergus Falls, MN, requested permission to construct a 15’ by 30' boathouse with a 15’ X 15’ structure and attached screen porch on its roof. Structure will be approximately 15‘ from the ordinary high water mark. Property is described as Government Lots 1 and 2 except tracts. Section 7 of Nidaros Township on Clitherall Lake. Four letters against the requested variance were read from the following individuals: L^ Ann Beckman, Dale Peppel, R. A. Molitor, and Richard Dale, President Clitherall Lake Association. The Audience was polled with no one speaking for or against this request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to deny the variance request as no hardship had been shown and it would be setting a precoJent. Boathouses have been controversial and the ordinance does allow one water orientated structure, but this Board has not varied from the required size and height of those structures as defined in the ordinance. Swenson VarianceRE: In March, 1990, I appeared before the Variance Board regarding remodeling of an existing Lighthouse on the northeast shore of Clitherall Lake. Due to the restrictions placed on us, the Lighthouse could not be used as the boathouse as was intended. Also a 6' X 10' fish cleaning house which was in very good condition had to be moved off the property. In view of these restrictions placed on us, I believe these building codes should be upheld by all lake shore property owners. Any change in the existing code will allow future builders to deviate from this code thereby endangering the preservation of the lake. Received Ott«r TaH Go. Box 54, Battle Lake, MN 56515 MAY 3 0 1991 May 28, 1991 To; Otter Tall County Board of Adjustment From: Richard Dale, President, Clitherall Lake Association SUBJECT: VARIANCE REQUEST BY JAMES I. SWENSON This Request for Variance was considered carefully at our last Board of Directors meeting, Saturday, May 25, 1991. Motion was made, seconded, discussed thoroughly and passed to oppose this variance request. The position of the 12 members of the board was 100% in agreement that 1) the rules laid down governing this type and location of a structure were written for an appropriate and valid reason and should be followed; 2) the 12 members could not see any hardship involved, and 3) the issue of greatest concern to each Director is that an approval would establish a precedent for all time. Such a precedent could, it is believed by the Directors, be a long range disaster for Clitherall Lake. The subsequent effects of such a precedent are not warranted by the vast majority of property owners who respect and obey the rules of conduct that have been laid down by our representatives. The Clitherall Lake Association, Inc. has a membership of 200 property owners, out of approximately 260 total pieces of property on the lake. This is a good indication of a very active and interested community for the well-being of Clitherall Lake. Approval of this variance request would not be consistant with the concerns of this community. Again, to restate: The Clitherall Lake Association, Inc. opposes this Request for Variance. Thank you.
