Motion
Edward and Barbara Haubrich - Denied. (7:45 p.m.)
Motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to deny the variance as
requested noting that the variance application had been signed by Edward and Barbara Haubrich and not the
individuals requesting that the variance application be withdrawn. It should be noted that John E. and Pamela J.
Winkler do have an agreement with Edward and Barbara Haubrich to act as their agent in this matter, but that the
Board of Adjustment Secretary felt that for the purpose of the records it would be best to deny the variance as
requested and note for this action the letter received from the Winklers.

To whom it may concern:
Please find enclosed my Application for Variance on back lot property located on Stuart
Lake in Ottertail County, as identified above. I am applying to have the property deemed
build able prior to my purchasing the lot.
It is my intention to purchase this property, currently owned by my sister and her
husband; Barbara Joan Haubrich & Edward Terry Haubrich and build a small cabin and
adjacent garage for seasonal use.
Enclosed you will find a signed Agreement Between Owner and Agent, so I may act on
behalf of my sister and her husband in obtaining this variance. I will only purchase the
land once I know if I can build on it, as planned.
I am submitting the plot drawing along with other required information, as stipulated in
the paper work I received from your office, so this may be reviewed in the July 3*^^
meeting. Please notify me if this application will be scheduled for the July 3'^'*, meeting,
as I plan to attend this meeting.

AGREEMENT BETWEEN OWNER AND AGENT

This agreement is hereby made and entered into this day of January, 2003,
by and between; Edward 'Terry' & Barbara Joan Haiibrich, of Maple Grove Minnesota,
hereafter called; Owner, and John Edward & Pamela Jean Winkler, of Crystal, Minnesota,
hereafter called; Agent.
The said parties, for the considerations hereinafter mentioned, hereby agree to
the following:
1. Owner agrees to allow Agent to represent his/her interest in obtaining
variance to build on seasonal property from Land Management of Ottertail
County. This includes, but not limited to, acting as agent in securing
approved variance on property, preparation of plot drawings, attendance of
meetings pertaining the application, etc.
2. The Agent agrees to provide all of the documentation, drawings and fees to
County, and to act as representative for Owner at applicable meetings
required to perform the following:
Obtain Variance, from Land Management in Ottertail Covinty, Minnesota, that approves
bvilldlng on Property ID: 41000030019008 (seasonal bade lot to Stuart Lake) , located in
Ottertail County, Nldaros Township.

And as shown in the attached drawing(s) and described in the specifications prepared

variance to Agent. Agent has the right to assign any sums due, or to become due, to
him under the provisions of this agreement.
4. This agreement shall be interpreted under laws of the State of Minnesota.
