Wayne Stein Board of Adjustment Secretary September 22, 2017 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, October 12, 2017 The Otter Tail County Board of Adjustment met Thursday, October 12, 2017, with the following persons in attendance: Thomas Lee Jack Rosenthal Chris McConn Steve Schierer Paul Larson Darren Newville Alexander Kvidt, Land and Resource Management David Hauser, County Attorney Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the September 14, 2017 meeting as mailed. The Board of Adjustment considered the following applications for variance: Eric and Renee Sholl, Steve and Liz Sholl and Dan and Lisa Sholl - Tabled. (6:32 p.m.) Eric and Renee Sholl, Steve and Liz Sholl and Dan and Lisa Sholl, Lots 33, 34, 35 and 36 Summer Haven Beach and Lot 3 Block 3 Summer Haven Beach First Addition, Pelican Lake in Scambler Township, requested the following: Requesting that the above riparian lots be sub-divided into three lots instead of the current four. These three lots would then be 66’ instead of the current 50’. Also request to have lots buildable for single family use. Once approved a new survey would be completed. Also requesting to sub-divide Parcel # 55000990720000 into three lots 50’ each to be permanently attached to a riparian lot and buildable for non-residential purposes. In attendance for the applicants were Eric and Renee Sholl, Liz Sholl and Lisa Sholl. Also appearing on behalf of the applicants was David Johnson their agent. It was noted that granting the variance as requested would establish precedence and would establish substandard lots. Minnesota Statute 394.36 Subdivision 5 was also discussed. The discussion focused on whether the provisions of this statute pertain to existing contiguous substandard lots as platted or if it this provision allow for the reconfiguration of existing contiguous substandard lots to meet the 67% rule. After additional discussion the previous motion was withdrawn. After additional consideration, Thomas Lee made a motion, seconded by Paul Larson and unanimously carried with the verbal permission of the applicants to table this public hearing until the November 9,2017 meeting of the Board of Adjustment so that the applicants will have an opportunity to consider the variance being offered and to do additional research regarding the reasons why their original request should be approved. Lepetomane Properties LLC - Denied. (7:00 p.m.) Lepetomane Properties LLC, part of Lots 44 and 45 Provan Beach, Pelican Lake in Dunn Township, requested the following: The statue is about 5’ over allowed height - 20 feet. Statue also needs to be closer than the shore line limit - 75’. To be visible from lake. Being 25’ in height, 10’ from the ordinary high-water level and 0’ from the top of the bluff (roadside of existing park bench.) The applicant was represented by Dirk Lenthe. After discussion and consideration, Paul Larson made a motion, seconded by Steve Schierer and carried with Jack Rosenthal abstaining and with Thomas Lee voting no, to deny the variances as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variances as requested. It was noted that the granting of the variance as requested would establish precedence and the applicant does have a reasonable use of the property without the granting of the requested variances. Martin Knoll LLLP - Variance application approved as requested. (7:21 p.m.) Martin Knoll LLLP, part of Lots 3 and 4, Martin Knoll, Pelican Lake in Scambler Township, requested the following: Transfer 11.84’ from owner of Parcel (C) 55-000-99-0479-001 to owner of Parcel (B) 55-000-99-0479-000 (Jon Martin) between the two houses. This will expand Parcel (B) 55-000-99-0479-000 bluff line from 64.36’ to 76.2’. This will also give Parcel (B) 55-000- 99-0479-000 more room for a new proposed septic tank. Variance is requested for five feet from lot line to house on Parcel (C) 55-000-99-0479-001 instead of the normal ten feet. Move lot line in the back by garage/sheds to the west to allow for a drain field for Parcel (B) 55-000-99-0479-000. Variance is requested of three feet from structures instead of the normal ten feet. All three structures are to be removed. Removal of the structures will decrease impervious surfaces for both Parcels (B) 55-000-99- 0479-000 and (C) 55-000-99-0479-001. Steven and Patricia Ahlschlager- Variance application approved with modifications. (7:28 p.m.) Steven and Patricia Ahlschlager, Lots 12 and 13 Birchwood Shores First Addition and part of Government Lot 4, Section 14 of Maine Township by Pickeral Lake, requested the following: Currently Lots 12 and 13 of Birchwood Shore First Addition are substandard contiguous lots under the same ownership. We are proposing to split Lots 12 and 13 on their original platted lot line and split parcel 38-000-14-0095-000 and attach a portion to each of Lots 12 and 13. This will create a Tract A, which will be 1.68 acres and a Tract B which will be 3.73 acres. We are also proposing to have both tracts buildable for single family residential use. Jack Rosenthal made a motion, seconded by Chris McConn and unanimously carried, to approve the proposed subdivisions with the following modifications: 1.) per the certificate of survey submitted with the variance application. Lots 12 and 13 Birchwood Shores First Addition contains 174.81’ of frontage on Birchwood Shore Drive of which 150’ must be permanently attached to Tract B with the remaining 24.81’ being permanently attached to Tract A, 2.) the common lot line between Tract A and Tract B can be shifted easterly 25’ and 3.) Tracts A and B will be considered buildable lots for single family residential use/development. The variances as approved do not directly or indirectly grant any other variances for proposed or future development. G. Lois Ringquist - Denied. (7:57 p.m.) G. Lois Ringquist, part of the Reserve Lot, Camp Corliss, Clitherall Lake in Clitherall Township, requested the following: Request for exemption of need for driveway and parking on lot. Will meet other requirements to bring impervious surface requirements as allowed in previously allowed variance to add second story to cottage. Impervious will cover 22.18%. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a motion, seconded by Chris McConn and unanimously carried, to deny the variance as requested as no adequate hardship/practical difficulty unique to the property had been shown that would allow for the granting of the variance as requested and the consensus of the Board is that the applicant can obtain a reasonable use of her property without the granting of the variance as requested. Gerard and Laurie Thompson - Variance application approved as requested with conditions. (8:15 p.m.) Gerard and Laurie Thompson, Lot 15 of the Survey Lots of Government Lots 5 and 6, Section 33 of Tordenskjold Township by Stalker Lake, requested the following: Proposing to construct a new dwelling being 9’ 1” from East and West Lot lines at the closest point. Required is setback of ten feet. Greg and Bonnie, Gerard’s in-laws along with Donny Schommer, Contractor represented the applicants at the public hearing. The audience was polled with Marjorie Knudson expressing concerns with the lot line location and drainage from the applicants’ property unto her property.
