V.- -.•■•■ • - MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, September 4, 2003 The Otter Tail County Board of Adjustment met Thursday, September 4, 2003, with the following persons in attendance: Cecil Femling Randall Mann Richard Sha Kyle Westergard, Land and Resource Management Bill Kalar, Director Land and Resource Management Cherie Clark, Assistant County Attorney Paul Larson Steve Schierer Mark Steuart Call to Order- Randall Mann, Chairman, called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - Hearing no corrections or additions the minutes of the August 14, 2003 meeting was approved as mailed. The following variance requests were heard: Collene C. Barnick - Approved as requested. (6:30 p.m.) Collene C. Barnick, part of Government Lot 1, Section 8 and part of Government Lot 3, Section 17 of Dead Lake Township by Dead Lake, requested a variance of 69’ from the required ordinary high water level setback of 200’ and a variance of 15 to 20’ from the required side lot line setback of 50’ for the placement of a garage 13T from the ordinary high water level, 30 to 35’ from the side lot line and 5’ from the public access easement. Joyce, the applicant’s daughter represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 69’ from the required ordinary high water level setback of 200’ and a variance of 15 to 20’ from the required side lot line setback of 50’ for the placement of a garage 13T from the ordinary high water level, 30 to 35' from the side lot line and 5’ from the public access easement as depicted on the applicant’s drawing. It was noted that this is a significant improvement. Hardship is a substandard lot of record. d Christopherson - Approved as requested with a condition. (6:37 p.m.) Ed Christopherson, part of Government Lot 7, Section 2 of Nidaros Township by East Battle Lake, requested a variance of 14’ and a variance of 16’ from the required ordinary high water level setback of 100’ and a variance of 5’ from the required road right-of-way setback of 20’ for the construction of 24’ by 26’ garage 86’ from the ordinary high water level of the lake, 84’ from the ordinary high water level of the creek and 15’ from the road right-of-way. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, motion was made by Paul Larson, second by Steve Schierer and unanimously carried, to approve a variance of 14’ and a variance of 16’ from the required ordinary high water level setback of 100’ and a variance of 5’ from the required road right-of-way setback of 20’ for the construction of a 24’ by 26’ garage 86’ from the ordinary high water level of the lake, 84’ from the ordinary high water level of the creek, 15’ from the road right-of-way and meeting the required setback from the septic tank with the condition that an existing shed must be removed before a site permit can be issued for the proposed garage. Hardship is the terrain and shape of th^^pplicant’s property.
