(6:36 p.m.) After consideration and discussion, Paul Larson made a motion, seconded by Michael Conlon to approve the variance as requested with the condition that the storm shelter area could be no larger than 72 square feet. This motion failed with Frank Lachowitzer, Randall Mann and Steve Schierer voting no. After additional discussion and consideration, Steve Schierer made a motion, seconded by Frank Lachowitzer and unanimously carried, to approve variances of 40’ and 60’ from the required ordinary high water level setback of 100’ and to deny the requested variance of 3’ from the required vertical separation above the ordinary high water level for a 12’ by 28’ addition 60’ from the ordinary high water level of the lake and 40’ frorn.the ordinary high water level of the creek. Minnesota MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, August 5, 2004 The Otter Tail County Board of Adjustment met Thursday, August 5, 2004, with the following persons in attendance: Michael C. Conlon Frank Lachowitzer Randall Mann Mark Ronning, Land and Resource Management Kurt Mortenson, County Attorney Cecil Femling Paul Larson Steve Schierer Called to Order - Chairman Mann, called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The membership of the Board of Adjustment approved the minutes of the July 1, 2004 meeting as mailed. The Board of Adjustment considered the following applications for variance: Layna Greenwood - Approved as requested. (6:32 p.m.) Layna Greenwood, part of Government Lot 4, Section 4 of Dane Prairie Township by Wall Lake, requested a variance of 10' from the required ordinary high water level setback of 75’ for a 16’ by 28’ addition located 65’ from the ordinary high water level. Randall Mann, Chair, polled the audience with Ordean Huus speaking in support of the variance as requested. After consideration and discussion, Steve Schierer made a motion, seconded by Cecil Femling and carried with Paul Larson voting no, to approve a variance of 10’ from the required ordinary high water level setback of 75’ for a 16’ by 28’ two story addition located 65’ from the ordinary high water level. Hardship is the terrain of the appiicant’s property. The Board noted that proposed addition would not obstruct the view from the adjacent properties. ichael Shaw - Approved ordinary high water level setback as requested. (6:36 p.m.) Michael Shaw, part of Government Lot 7, Section 2 of Nidaros Township by East Battle Lake and an unnamed lake, requested a variance of 40’ from the required ordinary high water level setback of 100’, a variance of 60’ from the required ordinary high water level setback of 100’ and a variance of 3’ from the required vertical separation above the ordinary high water level for a 12’ by 28’ addition 60’ from the lake, 40’ from the creek and with less than the required 3’ vertical separation. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, seconded by Michael Conlon to approve the variance as requested with the condition that the storm shelter area could be no larger than 72 square feet. The Board also noted that the proposed addition would be no closer to the lake than the existing structure.
