Printers • Fergus Falte.-i MN • V800-346-4870BK — 0599 — 029 ♦ I , Otter Tail County Variance Board Otter Tail County Courthouse 121 West Junius Suite 130 Fergus Falls, Minnesota 56537 We have been issued a Site Permit for an addition extending the dwelling on our East Battle Lake property by 12 feet. The site permit application used the "string test" to adjacent properties and measurements indicated that the 50-foot required setback from the Ordinary High Water Level would just barely be met. Because it is so close and the OHWL is a challenging line, I have been working with the Land and Resource Management staff to verify the Ordinary High Water Level before we proceed. They have agreed to do a site inspection and will confirm whether we meet the setback requirement. I believe I will have information from tiiem very soon. I am submitting this Application for Variance now in order to meet the deadline for consideration at the September 6* meeting. If the Land and Resource Management opinion is that we do not meet the requirement we will request a variance from the 50 foot OHWL setback as described in the attached application. It should be noted for the record that the applicants failed to appear at the public hearing. After consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to table the applicants’ request until the October 4, 2001 meeting of the Board of Adjustment. A letter from Grace and Francis Rabary in support of the variance request was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, second by Linda Bergerud and unanimously carried, to approve a variance of 53’ from the required ordinary high water level setback of 100’ for a 12’ by 24’ addition 47’ from the ordinary high water level. Bradley Klimp - Denied as requested. Bradley Klimp, Battle Lake, MN, requested a variance to have a .14 acre lot north of South Eagle Lake Road declared/considered a buildable lot for non-dwelling structures. It should be noted that the proposed non­ dwelling structure would meet all setback requirements. The property is described as part of Government Lot 3, Section 15 of Eagle Lake Township by Eagle Lake. Terry Braun and June LaValleur represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by David Holmgren and unanimously carried, to deny the variance as requested as the granting of the variance would create a substandard lot. Marty and Nancy Hanson - Approved as modified. Marty and Nancy Hanson, Pelican Rapids, MN, requested variances of 43’ and 18’ from the required ordinary high water level setback of 75’ for the placement of a structure 32’ from the ordinary high water level on the south side and 57’ from the ordinary high water level on the east side. The property is described as part of Government Lot 4, Section 27 of Lida Township by Lake Lida. September 6, 2001 Meeting (Tabled) - The audience was polled with no one speaking for or against the request. September 13, 2001 Meeting - As previously requested the applicants presented a revised plan. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling, and carried with Linda Bergerud and Randall Mann abstaining, to approve variances of 25’ and 37.5’ from the required ordinary high water level setback of 75’ and a variance of 3’ from the north side lot line setback of 10’ for the placement of dwelling as depicted on the applicants’ drawing 37.5’ from the ordinary high water level on the south side, 50’ from the ordinary high water level on the east side and 7’ from the north side lot line.
