ATTEMPTS TO AVOID VARIANCE FROM LOT LINE
This property is going to be my principle residence when I retire in three years or
less. My desire was to build a three-stall garage to accommodate my two
vehicles and my pontoon boat. I also need storage (because the existing shed
will be removed) and I want a shop to do my woodwork and other hobbies. I
understand that I do not have enough property to build the size garage that I
want so I looked for some way to get what I wanted and did the following;
1. I tried to purchase adjoining lot from Kurt and Jodi Peterson on numerous
occasions.
2. I considered purchase of additional land across the road from our lot to serve
as a back lot to build the garage. The deeded owner did not wish to sell any
portion of the land.
ONLY OPTION AVAILABLE
When additional land was not an option, I realized I needed to downscale my
garage because I am limited by my lot size (70 ft x 150 ft). If permitted to build a
28 X 28 garage, I will be very close to the maximum square footage of impervious
coverage on the lot as shown below:

JUSTIFICATION FOR REQUESTING THIS VARIANCE
In order to place a 28 x 28 foot garage on my lot I need to place it as close to the
south lot line as possible and, therefore, I am requesting a 5 foot variance from
the south lot line for the following reasons;
1. The sewer line from the house to the holding tank is approximately 35 feet
from the lot line. If I have to dig up or replace the septic system in the future, I
will need room to dig down to the sewer line alongside the garage. By building
closer to the lot line I will have room to do so if necessary. The sewer line angles
to the northwest but I can not move the garage further west because of the 20
foot setback requirement from the road. The further east I place the garage, the
closer to the septic line it gets.

2. Making the garage smaller will not allow me to incorporate the existing
storage space (12 x 16 ft shed) into the garage or allow for the storage of my
pontoon boat. I need the storage space and will remove the shed when the
garage is built. I need as big a garage as possible and 28 x 28 feet is the biggest
garage I can put on my lot.
3. The existing driveway lines up with the placement of the garage being closer
to the lot line. Moving the driveway further north will require significant changes
to the current ditch embankment and would require the removal of one or more
trees.
4. My neighbors, Kurt & Jodi Peterson (who own the lot south of me where I am
asking for the 5 foot variance) have no objection to the variance and I believe you
may have a letter to that effect on record. I do understand that this doesn't
permit the variance, but I feel it is worthy of mention.
5. It is not practical to make the garage deeper either because of the septic line
and the existing house.
With the variance of 5 feet, I will be able to; (1) build as large a garage as I can
without changing the contour of the existing ditch and driveway, (2) build without
removing any trees, and (3) provide the necessary space for future excavation if
there are any problems or required changes with the current septic system. The
variance will also allow me to incorporate the existing storage space in the new
garage and allow for the garaging of my two vehicles. I do plan on using rafter
space for storage so that I can have space for a shop area in the garage.
The garage will be a one-story structure and be shingled and sided to match the
existing house. It will increase the property value of my lot as well as the
surrounding lots in the area. I believe that the granting of this variance will not
only be beneficial for me, but my neighbors and the environment as well.

10’ and a variance of 98’ from the required ordinary high water level setback of 200’ for the placement of a 28’
by 28’ detached garage 5’ from the side lot line and 102’ from the ordinary high water level. The property is
described as Lot 10, Stewarts’s Oak Harbor, Belmont Lake in Clitherall Township. Letters from Dale and
Audrey Marcus and Kurt Peterson in support of the applicants’ request were read for the record. The
audience was polled with no one speaking for or against the request. After discussion and consideration,
motion was made by Randall Mann, second by David Holmgren and unanimously carried, to approve a
variance of 100’ from the required ordinary high water level setback of 200’ for the placement of a 28’ by 28’
detached garage 100’ from the ordinary high water level and to the deny the variance as requested from the
side lot line as adequate area does exist for the placement of the proposed garage 10’ from the lot line. It was

Jon and Darlene Gunderson - Approved with conditions.
Jon and Darlene Gunderson, Ottertail, MN, requested a variance of 80’ from the required ordinary high water
level setback of 150’ for the placement of a 14’ by 16’ addition 70’ from the ordinary high water level (canal)
and a variance of 94’ from the required ordinary high water level setback of 150’ for the placement of an 8’ by
12’ storage shed 56’ from the ordinary high water level (canal). The property is described as part of
Government Lot 7, Section 4 of Otter Tail Township by the Otter Tail River. The audience was polled with no
one speaking for or against the request. After discussion and consideration, motion was made by Cecil
Femling, second by David Holmgren and unanimously carried, to approve a variance of 80’ from the required
ordinary high water level setback of 150’ for the placement of a 14’ by 16’ addition 70’ from the ordinary high
level (canal) and a variance of 90’ from the required ordinary high water level setback of 150’ for the
placement of an 8’ by 12’ storage shed 60’ from the ordinary high water level (canal) with the following
conditions:
1. the area between the canal and the river cannot be used in the calculation of the total lot area
when determining impervious surface coverage, and
2. the 8’ by 12’ shed must be turn so that the 12’ side faces the garage and canal/river.
It was noted that the applicant’s proposed development is behind the existing building line.
Secretary’s note - The applicant’s application notes that the shed as proposed will be 56’ from the canal. The
applicant’s drawing notes that the shed as proposed will be 59’ from the canal. The bases for the motion
stated above assumes that the setback stated in the application is correct, therefore, turning the shed as
required by condition two should place the shed 60’ from the canal. If the setback as noted on the drawing is
correct then turning the shed as required in condition two would place the shed 63’ from the canal and would
require a variance of 87’.
John Snowberg - Approved.
John Snowberg, Foxboro, Wl, requested a variance of 20’ from the required setback of 50’ for the placement
of a holding tank 30’ from a wetland. The property is described as part of Government Lot 1, Section 14 of
Star Lake Township by Star Lake. The audience was polled with no one speaking for or against the request.
Dan Barry represented the applicant at the public hearing. After discussion and consideration, motion was
made by David Holmgren, second by Cecil Femling and unanimously carried, to approve a variance of 20’
from the required ordinary high water level setback of 50’ for the placement of a holding tank 30’ from a
wetland. Hardship is the terrain of the applicant’s property. It was also noted that this would be an
improvement over the existing situation.J
