Walsh, Watertown, MN, requested a variance to file a plat having 100’ of water frontage and having 100’ of width at the building line. The required water frontage and lot width is 150’. The property is described as part of Sublots A, B, C, D, E, F, G, and H, Section 12 of Clitherall Township by Clitherall Lake. Clem Hendrickson, Surveyor, represented the applicant at the public hearing. The audience was polled with Jack Planting stating that he had no objections to the applicant’s request. After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to approve a variance to file a plat having a lot containing only 100’ of water frontage and having 100’ of width at the building setback line. It was noted that all other requirements for platted lots on a recreational development lake have been or will be met. It was also noted that the applicant only has 100’ of frontage and is unable to obtain any additional water frontage. Allen and Norma Braun - Denied Allen and Norma Braun, Frazee, MN, requested a variance to construct a 24’ by 24’ garage 40’ from the middle of the roadway or 28’ from the existing traveled surface. The required road right-of-way setback is 20’. The property is described as Lots, 2, 3, and 4, Sky Blue Water Beach, Lake Six in Hobart Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, to approve a variance of 4’ from the required road right-of-way setback of 20’ for the construction of a 24’ by 24’ garage 16’ from the side lot line. This motion died for lack of a second. After additional discussion and consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. It was noted that the applicants have a large lot, which should allow for the placement of a garage that would provide the applicants with a reasonable use without requiring a variance. Public safety concerns with the applicants’ proposed location were also expressed. Bruce M. and Ann L. Ostern - Denied/Tabled Bruce M and Ann L Ostern, Minnetonka, MN, requested a variance of 5’ from the required ordinary high water level setback of 75’ for a 10’ by 27’ addition to an existing structure 70’ from the ordinary high water level. The property is described as Lot 5, Block 1, Quiet Waters Development, Rush Lake in Otto Township. The audience was not polled as no public hearing was held due to the absence of the applicant. After consideration, motion was made by John Everts, seconded by David Holmgren and unanimously carried, to deny the applicant’s request, for failure to appear, unless the applicant submits, by April 9, 1999, a written request to have his application tabled until the May 6 meeting of the Board of Adjustment. If a request to table is received by this date consideration will be given to the applicant’s request. Marc Shannon - Denied Marc Shannon, Frazee, MN, requested a variance of 4’ from the required holding tank setback of 10’ for the placement of a 34’ by 20’ garage 6’ from the holding tank. The property is described as Lot 6, Jerry-Marg Beach Second Addition, Lake Seven in Hobart Township. The audience was polled with an individual, speaking on behalf of Sharon Cook, against the variance as request. After consideration, motion was made by Cecil Femling, seconded by Mark Steuart and carried with Leona Zimmerman voting no, to deny the variance as requested noting that a variance approved on September 3, 1998 called for a 10’ separation from the holding tank.
