As we discussed, the Conditional Use Permit allows the relocation of the Church. However, prior to constructing any structures (i.e. cabins) a Site Permit is required, as well as a Sewage Treatment Installation Permit for the installation of a sewage system. As we discussed, the Shoreland Management Ordinance does not require Site Permits for the placement the Recreational Camping Units approved under this Conditional Use Permit. As you requested. This PUD does not meet the Ordinance requirements and is not compatible with the existing use in the surrounding area. 2. This request could not be implemented without variances. 3. Marsha Bowman Recording Secretary 1^7'Cutler’s Cottage’s Conditional Use Permit Considerations From Section V.3.I - Administration My wife, Laural and I, would like to build 6 cabins and operate a resort on a piece of property that we are purchasing from The Church of Jesus Christ. We would join this property with our Justice Two property where we would like to build 5 RV spots for seasonal rentals. We would join the propaty we are purchasing from the church with our Justice Two property and have a total of 13 units on the two properties. We are also asking to be able to move the church that is currently on the west side of the parcel the church is splitting to the piece that we are purchasing from the church. We would maintain the historic nature of the church and in time use it for weddings. Compatibility with the surrounding area; both on land and water. There is a resort directly to the west of the property and a multi-unit rental property to the north of this property so this is very compatible with the current area. 1. Environmental impact, including soils, topography, vegetation (land and water), fish, and wildlife. There will be some change to the landscape for the foundations of the buildings. My estimate is that the max earth or class 5 that would need to be brought in would be 500 yards for the buildings and RV spots. The contractor thinks that we may not need to do this as we can change the landscape a little and not have to bring in but minimal class 5. There will be a 10 foot wide road for vehicles to travel from the store parking lot to the parking for the cabins. We will need to bring in approximately 330 yards of class 5 for the construction of the road and parking lot. 2. 3.Any hazards that may be created; both on land and water. 1 do not know of any hazards that will be created. 4.Density and location of development. The six cabins will be spread out on the property and will not obscure the view of the lake for any neighbors. The middle part of the property will maintain most of its green space. 5.Suitability of the area, in its existing state, for the proposed use. The Tier Calculations do support 6+ cabins down by the lake as well as 5 RV spots and an existing cabin on the northern edge of the property and a cabin in the middle tier. The total number of units for the property in regard to tier calculations is over 20 and we are proposing 13 units. 6.Near shore water depth There will be a dock that goes out approximately 36 feet and will have 6 slips for boats. The depth at the end of the dock is approximately 3 feet during normal lake levels. The resort to the west has no issues with water depth for its dock’s. 7.Sensitive Areas may be protected through the use of Natural Environment Standards. There are no sensitive areas on this property. Adequate parking and traffic control. Parking would be to the north of the cabins. There will be 2 parking spots for each cabin as well as overflow parking for the church. The RV spots on the north side of the property would have a parking lot to the northeast of the Justice Two parking lot. Enough for two spots per unit. Amount of noise generated There will be noise levels consistent with a resort atmosphere. In the event of a wedding at the church the noise levels will be moderate with people standing outside the church. If there is an outdoor event, like a reception the noise levels would be consistent with a reeeption. The hours for this could be from 9:00 am until 11pm, depending on the event. 8. 9. Hours of Proposed use There is the potential for Cutler’s Cottage’s to be open 365 days of the year. 10. Lighting. There will be outdoor lights on each cabin as well as a couple of lights between the store and the cabins for security. Lights will be located along roadway between Justice Two and Cutler’s Cottage’s cabins. See map attached. Signage (number, size, lighting, and location) There will be a sign on the front of the store that will be lighted. The sign will be 8 Foot long and 3 feet tall. Time frame and/or phasing We will start building cabins on the lake by the fall of 2020 with the first to be completed by the spring of 2021. We plan to build one per year. The RV spots to the north will be built with pads starting the fall of 2016 and complete for the 2017 season. The cabin in Tier 2 will be complete the spring of 2017. The fish cleaning house and the storage / laundry and bathroom will be complete once the cabins are all built. Adequate lot area and water frontage for the proposed use. Tier calculations do support 6+ units. Our lots start approximately two blocks from the entrance to the proposed resort to the west along North Clitherall Lake road. One lot has a home on it currently and the additional two lots are platted for single family homes that we hope to pass down to our children. Mike and Laural Blaskowski have done a nice job with Justice II and we were interested to hear they might be considering putting in cabins at some point in the future. The Justice II store has been a nice addition to the area. My children and our company at the lake enjoy going down to the store. Many people along the lake and in the area have commented how nice the Justice II store is. There are a few more cars that frequent the area and also a few more people walking along the road to go to the store, but we believe it is manageable and adds charm to the area. We do have concerns with the current proposal of 8 total cabins, 5 RV sites, and an event center for possible weddings. 1. Event Center for Weddings/ Receptions / Reunions The added traffic and noise for an event like a wedding/ reception/ reunion will be substantial. We envision the cabins rented out by the wedding party and a reception afterward. Consumption of alchohol, bands, loud conversations by people that are there just for the event....all things that go along with this type of event and are not consistent with the area. We are concerned with traffic from people not staying at the resort coming to the event and the added noise. This will create a lot of day traffic coming and going to and from the event and will end up being loud and add a lot of late night traffic. The area is not suited to this type of venue. Lots of families with small children and older people in the area will not appreciate the amount of traffic and noise at an event like this going on till 11 pm or later. We are concerned that there will be substantial amounts of traffic and noise after 10 pm. 2. Overall Plan for expansion: 8 cabins with 5 RV sites Going from a plan 3 cabins and a store to a total of 8 cabins, 5 RV sites, store, and event center is quite a change. A: Excessive Traffic and People: Assuming two cars per cabin/RV site, the proposal adds 26 cars that would be coming and going every day to and from the resort. This does not include the people and cars that already come to the store. Assuming 4 to 5 people per location, there could be 52 to 65 additional people in this space. There is already a resort with 9 or 10 cabins and 8 or 9 trailers and another trailer park with 5 trailers right next to this proposed resort that has a lot of traffic associated with it. Boat / Watercraft Traffic:B: This change also would increase the boat and recreation traffic on the lake. The drawing and application show 6 boat slips, yet there are 13 sites total? Where will all the extra boats and watercraft be stored? If it is in the water, then the 6 boat slips as shown will have to increase substantially. If they are not stored on lifts in the water, will they be put in and taken out every day? There is an existing boat ramp 160' from the east edge of from our lot that is owned by Old Town resort. Will all the boats from this new resort also be coming and going from that location? This will result in more traffic on the road and more traffic on the lake just from putting the boats in and out. We are concerned that the area will be overcrowded and congested with boat traffic. We are concerned with the safety of adding 13 or more watercraft in this area of the lake where there is already a dense population of boats and watercraft from the existing resort and mobile home sites that are present currently. C: Safety of the existing Residents: People from up and down North Clitherall Lake Road walk, jog, ride bike in quite large groups all along North Clitherall Lake Road. The additional traffic caused by 13 sites, event center, and store/restaurant will create additional hazards for all of the people using this road and further jeopardize the safety of the existing residents. 5 RV Sites.D; It is unclear if these are campers or larger mobile home type units. The application listed 12 x 20 pads but the drawings show a much larger footprint. Having these right next to the road at the North end of the property will cause constant traffic and people in this space. Expansion of traffic in the area already. Please keep in mind that there are currently 6 empty lots in "Moe Farm estates" just to the west of this proposed resort. Our home sits in this area. North Clitherall Lake road cuts through these lots along the lakeshore and the road has to be crossed to access the lake. These lots are already platted and approved and will eventually add more cars and people to the area. D: Summary: We are opposed to the changes of the conditional use permit as listed as it is not consistent with the area. We believe the added noise, people, and late night traffic endanger the safety and enjoyment of the area residents. We believe the added noise, people, and late night traffic that will go past the front of our home will devalue our property. We believe the added boat traffic will further congest an already congested part of the lake and will endanger the safety of the current residents that use the lake in this area. We believe the original plan of 3 cabins is in line with the area. We would even support the 6 cabins proposed along the lake as they will be far enough into the property that they will be contained and consistent with the area. The event center and the RV sites will create too much traffic and noise along the road that people use and enjoy. The event center as proposed is not consistent with the area. During that time we have watched the traffic on the road. Most of the residents who live on the road are very mindful of cars speeding and we have attempted many times to get the cars to slow down. The posted speed limit is 20 mile per hour and that limit is not followed by the majority of people using the road. If you check the rneeting records of Clitherall Township you will notice that on more than one occasion residents have petitioned the township to allow us to Install seasonal speed bumps. Our thinking was they would be portable and not interfere with snow removal efforts. The requests were denied because of liability concerns of motorcyclists having accidents as they went over them. Apparently they did not care as to the liability of the risk of children being struck by cars speeding on the road. We along with many of our neighbors have small children and grandchildren staying at our homes. Since the road is between the homes and the beach area/they are at risk of being struck by a passing car. Many times the cars are speeding so if a child were to dart onto the road they would be seriously injured or killed. This risk of speeding vehicles concerns the children, walkers. Joggers and bikers,who use the road. Asa matterof fact a vehicle known to bepwned by the Justice Two has been observed exceeding the speed limit when it goes in front of our home on a regular basis. This road was originally platted as a cart way which is to basically provide access for the residents. It was not planned to be a throughway for all kinds of traffic. With the proposed development of 13 cabins and ; an event center, the increase in traffic will be immense. Since the opening of the commercial property. Justice Two, we have noted an increase of traffic and can only imagine the increase of traffic including large campers and trucks going to the campground. We understand that the County is encouraging development for economic purpose of increased tax revenue and are hopeful that this would not be the reason you would pass such a conditional use permit. We residents of this road must cross this road to access the lake. Visitors often don't realize how many pedestrians cross this road regularly and they speed through, endangering the residents and visitors. Increasing this traffic with a resort and event center would also increase boat traffic and potentially accidents on the lake. We will have a grandchild next year and would like to keep this road as safe as possible. Our sisters, also cabin owners on North Clitherall Lake Road also have small grandchildren, in total, we will have 5 grandchildren under 5 years old. Our biggest concern is always to keep them safe. Clitherall Lake has always been a family retreat and has a great relaxing atmosphere. Commercializing this lake for personal profit will destroy the atmosphere and drive down property values. I have many reasons for opposing this development, including a blatant disregard for the preservation of one ofTFlE most historic significant sites in Otter Tail County ... the very location of the county’s first permanent settlement, along with the county’s first post office and an offshoot of the Mormon movement in the late 19'*’ century. As stated in the purpose of the Otter Tail County Shoreland Management Ordinance ... “to maintain historic values of significant historic sites.” Granting this permit request would forever change the character and historical significance of the old townsite of Clitherall, MN. Population density within a quarter mile stretch of North Clitherall Lake Road either side of the proposed new resort currently includes 10 cabins, five trailers and two houses at Old Town Resort, 11 trailers and a house across the street from the resort and a 24-bed Vacation Rental By Owner just north of the proposed development. By adding 13 more living units, the likely traffic flow from both east and west could easily become even more of a hazard than it already is. This is a particularly vexing issue for those of us who own property along the north shore of Clitherall Lake where a legally posted 20 mph speed limit is regularly ignored by vehicles traveling in excess of 35-50 mph, especially coming off the steep slope to the east (from the Old Town area). The lives of our children, grandchildren, elderly and pets are at risk whenever crossing the road between cabins and the beaeh/dock area. In response to this permit application, a number of property owners between Old Town Resort and the private drive connecting North Clitherall Lake Road with Bonnie Beach Resort have expressed dismay and concern about the potential impact. Not only are we concerned about road traffic, but also about the increase in boat traffic with the broader issues of Aquatic Invasive Species (AIS) and water safety ... a topic that is fresh on many minds after the accident this summer involving a young person requiring hundreds of sutures to close the wounds from a blow by a high powered boat under the control of a negligent operator. This group of property owners is united in our opposition to this permit application. We stand to gain nothing while giving up a style of lake life that some of us have enjoyed for over seven decades. I’m a member of The Church of Jesus Christ as well as the secretary to the church. I live in Independence, Missouri where our headquarters are located. I understand there are some folks who oppose the moving of the church building in Old Town, Clitherall, Minnesota to a location east of the present ground where it now sets. I would like to address this concern. My ancestors, the Whiting’s on my mother’s side and the Fletcher’s on my father’s side of my family were among the first settlers in Otter Tail County, Minnesota. The settlers traveled from Manti, Iowa where the church was reorganized, in 1853, to Minnesota. Alpheus Cutler the prophet and president of The Church of Jesus Christ received a revelation to move north. Cutler had often spoken to his people of a place he had seen in a vision where there was grassland and beautiful lakes. In the summer of 1865, the long line of wagons belonging to church members who left Manti, Iowa arrived on the shore of beautiful Lake Clitherall. A log schoolhouse was erected in the fall of 1865 and in 1866 a log church was built and dedicated on New Year’s Day, 1867. The place where the church was built was pointed out by the Lord. The elders of the church had been told, through the gifts, to unite in prayer to God. Therefore, church leaders Lewis Whiting, Sylvester Whiting and James Badham knelt down in front of where the church now stands and offered up a special prayer. Very soon Brother James Badham received a revelation that this was the appointed place for the church to settle on; and as a witness that it was true, the rest of the people would be pleased when they saw the location. And indeed they did agree when they arrived at the spot chosen for the building site. Over the years the log church crumbled in ruin. In 1912, a new frame church was constructed on the site of the first log building. This is the church that is still standing in Old Town today. Although the site of the church is significant to the area, today it is an empty unused building. It should be respected for the history it holds. Only people have the rights and authority of the church to teach the doctrine and beliefs. The church remains a small white frame building. The last member of the Old Town church moved to Independence, Missouri in 1996. Meetings had not been conducted in the building since the mid 1950’s with the exception of two special conference meetings. We were very happy when Mike and Laural Blaskowski purchased parcel B of our land, east of the church. They are interested in keeping the history of Old Town alive as evident by the restoration of the store. Justice Two, once owned by The Church of Jesus Christ. The church membership here in Independence is very small and most members are in their “golden” years making it hard to maintain property in Minnesota, so far from Missouri. It is the intent of the church to eventually sell the remaining land. Parcel A, of the Old Town property. We don’t know who will purchase the last portion of our land. So, to insure that the church will not be misused as a garage or storage shed or even tom down, the church members approved the sale and eventual move of the building onto the Blaskowski property. They plan to use it for weddings, renewal of vows and other small celebrations that are considered appropriate in an old historic church. We tmst them to be good caretakers of this building. The Blaskowski’s are very aware of the concerns their neighbors have about the future plans for their resort. They are making every effort to establish a great place for upcoming generations to make lasting memories, like your families have enjoyed over the years, in this close knit lake community. We would join this property with our Justice Two property where we would like to build 5 RV spots for seasonal rentals. We would join the property we are purchasing from the church with our Justice Two property and have a total of 13 units on the two properties. We are also asking to be able to move the church that is currently on the west side of the parcel the church is splitting to the piece that we are purchasing from the church. We would maintain the historic nature of the church and in time use it for weddings. Compatibility with the surrounding area; both on land and water. There is a resort directly to the west of the property and a multi-unit rental property to the north of this property so this is very compatible with the current area. I. Environmental impact, including soils, topography, vegetation (land and water), fish, and wildlife. There will be some change to the landscape for the foundations of the buildings. My estimate is that the max earth or class 5 that would need to be brought in would be 500 yards for the buildings and RV spots. The contractor thinks that we may not need to do this as we can change the landscape a little and not have to bring in but minimal class 5. There will be a 10 foot wide road for vehicles to travel from the store parking lot to the parking for the cabins. We will need to bring in approximately 330 yards of class 5 for the construction of the road and parking lot. 2. Any hazards that may be created; both on land and water. 1 do not know of any hazards that will be created. 3. Density and location of deveiopment. The six cabins will be spread out on the property and will not obscure the view of the lake for any neighbors. The middle part of the property will maintain most of its green space. 4. Suitability of the area, in its existing state, for the proposed use. The Tier Calculations do support 6+ cabins down by the lake as well as 5 RV spots and an existing cabin on the northern edge of the property and a cabin in the middle tier. The total number of units for the property in regard to tier calculations is over 20 and we are proposing 13 units. 5. eNear shore water depth No issue with water depth near shore for doeks. There will be a dock that goes out approximately 24 feet and will have 6 slips for boats. The resort to the west has no issues with water depth for its dock's. 6. Sensitive Areas may be protected through the use of Natural Environment Standards. There sbwtkhhc no sensitive areas on this property. 7. Adequate parking and traffic control. Parking would be to the north of the cabins. There will be 2 parking spots for each cabin as well as overflow parking for the church. The RV spots on the north side of the property would have a parking lot to the northeast of the Justice Two parking lot. Enough for two spots per unit. 8. Amount of noise generated There would bemnima^oise from the cabins and RV spots. 9. There are also numerous trees between the cabins and surrounding neighbors. Time frame and/or phasing We will start building cabins on the lake by the fall of 2020 with the first to be completed by the spring of 2021. We plan to build one per year.
