Justice 2 Conditional Use Permit Considerations From Section V.3.I - Administration My wife and I wish to re-open the general store of Old Clitherall under its original name of Justice 2. We will have general grocery store items as well as what you would find in a convenience store. We will serve ice cream, hot dogs pizza, nachos and otiier fast food items. There will be seating downstairs for approximately 20 people as well as seating upstairs for the same. There is a pool table upstairs. We also propose to have a 15’ by 20’ patio sitting area off the SE comer of the store. Seating outside will be for approximately 16 people. Compatibility with the surrounding area; both on land and water. There is a resort that is directly west of the proposed store as well as a church directly south. 1. Environmental impact, including soils, topography, vegetation (land and water), fish, and wildlife. There will be minimal impact to the soil due to a parking lot and driveway access to the property. Paridng lot changes are attached in the surveyors drawing of the property. 2. Any hazards that may be created; both on land and water. I do not know of any hazards that will be created by the proposal. 3. Density and location of development. Proposal is not for a development. 4. Suitability of the area, in its existing state, for the proposed use. A general store is suitable for the area with residents in the area shopping for convenience as well as purchasing some prepared items. This is a century old general store that has been renovated. 5. Near shore water depth - N/A6. Sensitive Areas may be protected through the use of Natural Environment Standards. Not sure if this would be a sensitive area. 7. Adequate parking and traffic control. Parking would be to the north and east of the building. There will be over 7200 square feet of parking. Amount of noise generated There will be minimal noise generated from music or TV’s inside the eating area of the store as well as fi'om the upstairs pool table room. Out door seating to the south of the building may have some noise fi'om people talking. 8. 9. 10.Hours of Proposed use 6:00 Am until 10:00 PM. 365 days of the year. Lighting. There will be lights on the fiont porch as well as a couple of lights for the parking lot in back and on the north side of the building. 11. Signage (number, size, lighting, and location) There will be a sign on the fiont of the store that will be lighted. The sign will be 8 Foot long and 3 feet tall. 12. Time fixune and/or phasing13. Adequate lot area and water frontage for the proposed use. Lot area seems to be sufficient for proposal. 14. Minimal change in the existing topography necessary to allow for the proposed use The only change will be for the driveway and parking lot. 15. Any other possible adverse effects of the proposed Conditional Use Application and what additional requirements may be necessary to prevent such adverse effects. 1 do not know of any adverse effects as this used to be an operating store with the same foundation. 16. Since our headquarters are in Independence, Missouri, we are unable to make a personal appearance. Our forefathers settled the land where the store is located. We are in favor of the building being restored as a general store again. Including a drive and parking lot is a necessity for the customers. Mike and Laural Blaskowski are interested in the history of "Old Town" and restoring Justice 2 will bring the past alive for many folks who have ancestors that came to Clitherall Lake and settled Old Town in 1865. This beautiful area is in need of a place to buy groceries and other food items.
