Motion by Johnson, second by Froemming, and unanimously carried to approve a Conditional Use Permit

Conditional Use Permit - Timberline Properties:
Motion by Lindquist, second by Johnson, and unanimously carried to accept the withdrawal of the
application and approve a refund of the application fee, for a Conditional Use Permit for the Timberline
Properties’ project because it was determined that a CUP is not necessary for this project as it should go
through the County Ditch process. The project is located in all GLS 4, 5, 7 & 8, NW% SE% & PT GLS 2 &
3 & Sublots D, K, L & H & M (244.59 AC), Section 22 of Elizabeth Township; Devils Lake (56-882), NE &

Motion by Froemming, second by Huebsch, and unanimously carried to approve a Conditional Use Permit

Dalton Association LLP, John E. Fullerton - Denied:
The Commission took action regarding the Dalton Association LLP Conditional Use Permit
Application. At this time, the Applicant had not yet arrived.
Motion: Motion by Trites, second by Maske to deny the Application for the following
reasons: 1. The Applicant has not provided the material requested at the December 14,
2011 meeting. 2. The applicant has not provided a formal request to table the Application.
3. The Commission does not have adequate material to make an informed decision.
Voting: All Members in favor.
Break: At 7:05 p.m., the Commission took a 25 minute break.
Alan & Barbara Syverson- Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Request to fill
in low point of driveway. The way driveway is now makes garage unaccessible. The
amount of fill needed is approximately 500 yards. Area to be filled 80’ perpendicular to
drive, 60’ parallel to driveway & 8’ at center point to be graded to nothing on all sides. The
project is located in Maple Acres Lot 6 BIk 2 & vac rd adj and Lot 5 BIk 3, Section 34 of
Girard Township: Stuart Lake (56-191), RD.
Tom Koep (contractor) Represented the Application.
Motion: A motion by Gill, second by Schwartz to approve as presented. Voting: All
Members in favor.
Mike & Laural Blaskowski - Approved As Requested:
A Conditional Use Permit Application (as stated by the Applicant on the Application): We wish to
reopen a general store and sell miscellaneous grocery items as well as serve ice cream and
other food items under the store name Justice 2. Earthmoving to include resurfacing of
existing driveway and proposed parking lot. Total cubic yards of 146. The project is located
at Old Town Acres Lot 2 BIk 1, Section 12 of Clitherall Township; Clitherall Lake (56-238),
RD.
Mike & Laural Blaskowski represented the Application. Mike Blaskowski requested to
increase the total cubic yards to 300.
Motion: A motion by Trites, second by Wilson to approve as requested, increasing the total
cubic yards to 300. 'Voted: All Members in favor.
Adjourn: At 7:45 P.M., Chairman Olson set the Meeting. The next Meeting is scheduled
for 6:30 P.M. on August 8, 2012.

Conditional Use Permit Considerations
From Section V.3.I - Administration
My wife and I wish to re-open the general store of Old Clitherall under its original name of Justice 2. We will have general grocery store
items as well as what you would find in a convenience store. We will serve ice cream, hot dogs pizza, nachos and otiier fast food items.
There will be seating downstairs for approximately 20 people as well as seating upstairs for the same. There is a pool table upstairs. We
also propose to have a 15’ by 20’ patio sitting area off the SE comer of the store. Seating outside will be for approximately 16 people.
Compatibility with the surrounding area; both on land and water.
There is a resort that is directly west of the proposed store as well as a church directly south.

Environmental impact, including soils, topography, vegetation (land and water), fish, and wildlife.
There will be minimal impact to the soil due to a parking lot and driveway access to the property.
Paridng lot changes are attached in the surveyors drawing of the property.

Any hazards that may be created; both on land and water.
I do not know of any hazards that will be created by the proposal.
3.
Density and location of development.
Proposal is not for a development.
4.
Suitability of the area, in its existing state, for the proposed use.
A general store is suitable for the area with residents in the area shopping for convenience as well as purchasing some prepared
items. This is a century old general store that has been renovated.

Near shore water depth - N/A6.
Sensitive Areas may be protected through the use of Natural Environment Standards.
Not sure if this would be a sensitive area.

Adequate parking and traffic control.
Parking would be to the north and east of the building. There will be over 7200 square feet of parking.
Amount of noise generated
There will be minimal noise generated from music or TV’s inside the eating area of the store as well as fi'om the upstairs pool
table room. Out door seating to the south of the building may have some noise fi'om people talking.

There will be lights on the fiont porch as well as a couple of lights for the parking lot in back and on the north side of the

There will be a sign on the fiont of the store that will be lighted. The sign will be 8 Foot long and 3 feet tall.

Lot area seems to be sufficient for proposal.

The only change will be for the driveway and parking lot.

1 do not know of any adverse effects as this used to be an operating store with the same foundation.

The members of The Church of Jesus Christ would like to submit a letter in favor of the
Conditional Use Permit Application Request by Mike & Laural Blaskowski.
Since our headquarters are in Independence, Missouri, we are unable to make a personal
appearance. Our forefathers settled the land where the store is located. We are in favor
of the building being restored as a general store again. Including a drive and parking lot
is a necessity for the customers.
Mike and Laural Blaskowski are interested in the history of "Old Town" and restoring
Justice 2 will bring the past alive for many folks who have ancestors that came to
Clitherall Lake and settled Old Town in 1865. This beautiful area is in need of a place to
buy groceries and other food items.
