Dan and Joyce Petersen - Tabled
Dan and Joyce Petersen, Henning, MN, requested a variance of 10’ from the required 20’
dwelling setback and a variance of 9’ from the required lot line setback of 10’ for the placement
of a drain field 10’ from the dwelling and T from the lot line. The property is described as part of
Government Lot 1, Section 21 of Leaf Lake Township by West Leaf Lake. The audience was
polled with no one speaking for or against;the request. After consideration, motion was made
by Randall Mann, seconded by John Everts and unanimously carried, to table the applicants’
request until the August 6, -1998 Board of Adjustment meeting for the purpose of providing the
applicants with an opportunity to review and discuss their plans with the Minnesota Department
of Health.
!oger Johnson - Withdrawn
Roger Johnson, Battle Lake, MN, requested.a variance “to add a 10’ by 16’ deck with a
screened in porch to the front of our home. We request that the deck could be located 33’ off
the center of lot to the west. The porch would have a hip roof to meet the requirements of
height for this structure." The required side lot line setback for a water - oriented accessory
structure is 65’. The property is described as the East 60’ of Lot 11 and the West 70’ of Lot 12,
E-L-M Dale Beach, Clitherall Lake in Clitherall Township. Randall Mann informed the Board
that he would be abstaining from any action on this request as he owns property that is adjacent
to Mr. Johnson’s property. After discussion and, consideration the applicant informed the Board
of Adjustment of his desire to withdraw his request. The Board of Adjustment acknowledges the
applicant’s request and authorized a partial refund of ,the applicant’s application fee.
Scott and Jamie Stenseth - Approved
Scott and Jamie Stenseth, Fargo, ND, requested a variance “to build one story above a pre
existing sub-basement that had been built into a bluff. The project would be to build this
“ground-level” story the exact dimensions of the basement, and would involve no new
excavation or alteration of the bluff. The existing basement has a flat roof - consequently water
runoff down the face of the bluff is poor. One benefit to the proposed project would be improved
water runoff through .attached gutters to pre-existing “on property” concrete gutters to the lake.
The variance would allow the upper structure to be 53’ from the lake. Also, I am requesting a
variance to replace an existing 8’ by 26’ concrete slab (used as a deck) on the “lake side” of the
existing basemen structure. The slab is slowly moving away from the basement foundation and
down the face of the bluff. My request is to be able to remove the slab to prevent future
damage to the bluff. I would then stabilize the surface under the slab and replace the 8’ by 26’
slab with a “same - size” wooden deck on posts. The variance would allow me to replace the
deck in the bluff approx. .45’ from the lake.” The required ordinary high water level setback is
75’ and the required top of bluff setback is 30’. The property is described as Sub Lot 5 of
Government Lot 1, Section 26 of Lida Township by Lake Lida. The audience was polled with no
one speaking for or against the request. After consideration, motion was made by Randall
Mann, seconded by John Everts’and carried with Cecil Femling and Dick Sha voting no, to allow
the second story addition over the existing basement with the condition that before a site permit
for the addition can be issued the existing boat house must be removed with the exception of
the slab, which can be covered with a platforrh deck. After additional discussion and
consideration, motion was made by John Everts, seconded by George Walter and carried with
Cecil Femling and Dick Sha voting no, to grant the applicant the option of removing the 8’ by 26’
slab on the lakeside of the existing cabin and replacing the slab with a stabilized wooden
platform subject to the assistance, development, evaluation and approval of the applicants’ plan
by the Land and Resource Department.

Motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to approve the 24' by
34' addition to the existing structure as shown on the applicant's drawing. After additional consideration
motion was made by Craig Anderson, seconded by John Everts and carried with Cecil Femling and Randall Mann
voting no, to approve a water - oriented accessory structure that will conform to the requirements of the
ordinance with the condition that an existing shed will be moved behind the building line. The water - oriented
accessory structure must be centered on the lot and have a height of 10' or less.

Evelace Hanson - Approved
Evelace Hanson, Battle Lake, MN, requested a variance to split 25’ from Lot 1, Block 1 of Hanson's Addition to
Beverly Beach and to permanently attach the 25' to Lot 1 of Loomer's Addition. Lot 1, Block 1 of Hanson's
Addition to Beverly Beach will retain approximately 175' of frontage and over 40,000 square feet of area. The
required lot width for backlots on a general development lake is 200'. The applicant request that Lot 1, Block
1 of Hanson’s Addition to Beverly Beach be considered a buildable lot and that the applicant be permitted to
split the parcel without a surveyor's drawing. The property is described as Lot 1, Block 1, Hanson's Addition
to Beverly Beach, West Battle Lake in Everts Township. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Randall Mann, seconded by Carl Johnson and
unanimously carried, to approve the variance to split 25' from Lot 1, Block 1 of Hanson's Addition to Beverly
Beach and to permanently attach the 25'to Lot 1 of Loomer’s Addition. Lot 1, Block 1 of Hanson's Addition to
Beverly Beach will remain a buildable lot. Lot 1 , Block 1 of Hanson's Adoition to Beverly Beach will be in
substantial compliance with the ordinance and Lot 1 of Loomer's Addition will increase in size and also, this
additional area will provide access to a structure located on Lot 1 of Loomer's Addition.

setback of 100' for a 24' by 34' addition and for a 1 O' by 16' addition to an existing dwelling 55' from the
ordinary high water level. The property is described as the East 60’of Lot 1 1 and the West 70'of Lot 12,
E&M Dale Beach, Clitherall Lake in Clitherall Township. The audience was polled with no one speaking for or
against the request, After consideration, motion was made by Cecil Femling, seconded by Randall Mann and

Gaylan Thormodson - Approved
Gayian Thormodson, Dalton, MN, requested a variance of 9' from the maximum non-dwelling height
requirement of 18' for the construction of a 90' by 180’ free stall barn with a height of 27'. Depending upon
the location of the structure it will be approximately 450 to 550' from the ordinary high water level. The
property is described as Government Lots 2 and 3 and part of Government Lot 6, Section 6 of St. Olaf Township
on .Sommer Lake. The aucrence was polled with no one speaking for or against the request. After consideration,
motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance
of 9' from the maximum non-dwelling height requirerrient of 18' for the construction of a 90' by 180' free
stall barn with a height of 27'. It should be noted that the use of the property is agricultural.

CALL TO ORDER - The meeting was called to order at 6:00 p.m, by Chairman George Walter,

Hearing no corrections or additions the minutes of the April 7th, 1994 meeting were declared approved as
mailed.
The following variance requests were heard:

Thomas Kelly, Et, AL, Minneapolis, MN, requested a variance of 7' from the required side lot line setback of
1 O', a ■'Variance of 47’ from the required ordinary high water level setback of 75', a variance of 9.5’ from the
required shore impact zone setback of 37.5' and a variance of 1 1' from the required 20' road righi-of-way
setback for the placement of a Recreational Camping Unit under an existing roof 3' from the side lot line, 28'
from the ordinary high water level and 9' from the road right-of-way. The property is described as'part of
