MOTION AS FOLLOWS:
Motion was made by Randall Mann, seconded by Cecil Femling and carried with John Everts abstaining, to approve a
variance of 38’ from the required ordinary high water level setback of 100’ for the construction of a 30’ by 34’ 2-story
addition to an existing structure located 62’ from the ordinary high water level. Hardship is a substandard lot of record.
It was noted that the proposed addition will be no closer to the ordinary high water level than the existing structure and
the addition is within the existing building line.

After discussion and consideration, motion was made by Craig Anderson, seconded by Cecil
Femling and unanimously carried, to approve a variance of 70’ from the required ordinary high
water level setback of 150’ for the installation of a sewage system 80’ from the ordinary high
water level as described on the applicant’s drawing. Hardship is a substandard lot of record and
the terrain features of the applicant’s property. It was noted that the applicant’s plan was very
well engineered.

Roger L. and Janet C. Swenson, Madison, MN, requested a variance of approximately 38’ from
the required ordinary high water level setback of 100’ for the construction of a 30’ by 34’ 2-story
addition to an existing structure located approximately 62’irom the ordinary high water level.
The property is described as part of Lots 7 and 8, E-L-M Dale Beach, Clitherall Lake in Clitherall
Township. The audience was polled with no one speaking for or against the request. After
discussion and consideration, motion was made by Randall Mann, seconded by Cecil Femling
and carried with John Everts abstaining, to approve a variance of 38’ from the required ordinary
high water level setback of 100' for the construction of a 30’ by 34’ 2-story addition to an existing
structure located 62’ from the ordinary high water level. Hardship is a substandard lot of record.

Arlen Johnson - Approved
Arlen Johnson, Underwood, MN, requested a variance of 3’ from the required 18’ maximum
height of a non-dwelling structure for the replacement of existing barn, having a height of 30’,
with a 50’ by 100’ pole building having a height of approximately 2T. The property is described
as the Northeast Corner of Government Lot 7, Section 6 of Sverdrup Township by Pleasant
Lake. The audience was polled with no one speaking for or against the request. After
discussion and consideration, motion was made by Craig Anderson, seconded by Robert
Schwartz and unanimously carried, to approve a variance of 3’ from the required 18’ maximum
height of a non-dwelling structure for the replacement of an existing barn, having a height of 30’,
with a 50’ by 100’ pole building having a height of 2T. It was noted that the replacement of the
existing structure will not create run off into the lake and that the overall height of the new
structure will be 9’ less than the existing structure.
Dennis and Connie Loecken - Approved
Dennis and Connie Loecken, St. Joseph, MN, requested a variance of 120’ from the required
ordinary high water level setback of 200’ and a variance of 20’ from the required shore impact
zone setback of 100’ for the placement of a camper 80’ from the ordinary high water level. The
property is described as a 2.5-acre tract in Government Lot 2, Section 34 of Star Lake Township
by Dead Lake. The audience was not polled, as the applicants were the only persons in
attendance at this time. After discussion and consideration, motion was made by Randall
Mann, seconded by John Everts and unanimously carried, to approve a variance of 120’ from
the required ordinary high water level setback of 200’ for the continued use of a motorized
camper vehicle, with an unattached deck, as presently located 80’ from the ordinary high water
level with the condition that no permanent structure will be allowed at this setback location and
any permanent structure placed on this lot must be placed in a location that meets the setback
requirements of the ordinance. It was noted that the camper might be somewhat within the
building line at the 80’ setback.

This application is made for a variance to allow construction of a 30' x 34', 2-story addition to
my existing dwelling structure situated on Lake Clitherall E-L-M Dale Beach Addition. The
existing structure consists of a 26' x 28' cabin/garage which is set back approximately 62' from
the OHWM. It is paneled throughout and has a bathroom, kitchenette and a bedroom loft. The
addition would connect the loft areas of the two structures and the living/dining room areas of the
two structures. Both structures will have rough cedar exterior siding.
The variance is needed because the front line of the new (and existing) structures would exceed
the setback requirements of the ordinance using the "string test'. If the new structure were placed
behind the line established by the "string test", the new structure would have to be built on the
driveway, on top of the holding tanks, and/or on top of the existing utility shed. The view to the
lake would be obstructed by the existing structure. In addition, the E-L-M Dale Beach Restrictive
Covenants prohibit a third structure unless it is an addition to or part of one of two structures on
the property. Naturally, compliance with the ordinance would cause a "great hardship" and make
the lot virtually unbuildable and diminish the value of the property. Similar variances have been
granted or additions of the type we contemplate to other property owners along the beach. Our
lot is unfairly affected by the "string test" due to the adjacent lot being vacant.
We would appreciate being granted a variance to build the addition contemplated which will
provide increased value to not only our property, but adjacent properties. It will also add to the
esthetics of the area and will in no way affect the purposes of the new setback requirements
contemplated by the ordinance.

15th to attend the meeting, if possible. Otherwise, I will be available to attend the September 4th
meeting but would have to make a 200-mile round trip for that meeting. In any event, please let
me know the time, date and room where the meeting will be held.
