Name Clltherall Lake Name Clltherall Class RD Lot 19, County Estates The hearing for the requested variance has been scheduled at a time when I will be out of State. I would like to have my comments om this request submitted to the hearing for consideration by way of this letter. I am opposed to the granting of the request for the following reasons: 1. The request states that the 82' setback would be in line with the lots to to the east but says nothing about the lots to the west. If there are not any structures existing at the present then any future ones will have to make a similar request or have their sight line obscuired by the building at the 82' distance of Lot I9. This is unfair to those owners who might not wish to set their building that far ahead. Also, the 82' distance might force them to destroy trees that they would want to save. It is also unfair to those of us who have already conformed to the 100' setback and could eventually have neighboring structures far in front of them. 2. '^he granting of such variances is setting of precedence that is legally difficult to refute or refuse such future requests. In my case the lot to my west could request such a variance and put a structure right in the sight line of my building which was built with the setback requirements as a determining factn-r for location. If the lot owner wishes to save those trees so badly There is nothing to prevent him from Lot 19 is 500 feet long, he could set his structure behind them. 3. using a setback greater than 100 feet. 4. The setback ordinance was established for the greater good of the public as opposed to individual desires. It was established to preserve the beauty of the lake and the natural appearance of th© shoreline. The rest of us have conformed to this requirement and so should this lot owner. The preservation of the few trees for the sake of the individual lot owner certainly does not outweigh what the requirement for setback seeks to preserve and establish for the public. I realize that there are situations that, at times, make necessary the granting of such variance or at least permissable since it does not defeat the purpose of the requirement. However, in my opinion, this request does not meet these criteria and should be denied. The owner should have to conform to the 100 foot setback. If it should work out that I am back in time for the meeting I will be in attendance. However, I am scheduled to be in Nebraska at the time of the meeting. We base our opposition on the following- facts: 1. When one builds on a wooded lot, it is logical that some trees may have to be cut. . ' I had to remove 3 trees including one large Oak tree. If Mr. Colton adjusts the shape of his building he can avoid the clump of Basswood Or build behind them about 125 feet from the lake The cottages and-home^to the east and west of lot 19 are all more than 100 feet from the lake. 2. Most important to us. is the logical effect .this will have on the eventual builder on lot #18. If MR. Colton is permitted to build 82' from the lake, it would be logical for this unknown builder to be in line with Mr. Colton. Because the shore line is dropping back to the south rather quickly on lot # 16,17, £ 18, we are going to stand behind the eventual building on lot #18. If he should be allowed to build even closer than 100 feet, it will have an adverse effect on our existing cottage. 3.
