The property Is described as Lots 45 and 46, Girard Beach, West Battle Lake In Girard Township. The audience was polled with Harrison Schmitt speaking to the applicant request. After consideration, motion was made by Craig Anderson, seconcted by John Everts and unanimously carried, to approve construction up to what the string line test would allow at the mid point when applied from the point of the bluff on the (north side of the applicant's lot) developed lot to a point setback 30' from the top of the bluff on the (south side of the applicant's lot) adjacent undeveloped lot. It should be noted that the applicant's property slopes away from the bluff. Joseph and Beverly M. Elliott - Tabled Joseph and Beverly M. Rustad, Moorhead, MN, requested a variance of 5' from the required side lot line setback of 1 O' and a variance cf 1' from the required 1 O' drain field setback from a non-dwelling structure for the construction of a 16' by 24' garage 5' from the side lot line and 9' from the drain field. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance of 5' from the required side lot line setback of 10' and a 1' variance from the required 1 O' drain field setback from a non-dwelling structure for the construction of a 16' by 24' garage starting 5' from the tree and extending 24' towards the road and being 9' from the drain field and 5' from the side lot line. Hardship being a substandard lot of record and the curve in the road past the applicant's property. It should be noted that adequate area exist for the maintenance of the drain field, Cecil H. Poss - Denied Cecil H. Pass, Pelican Rapids, MN, requested a variance to subdivide a parcel of less than 2.5 acres from an existing parcel. Arlie Steen - Denied Arlie Steen, Clitherall, MN, requested a variance of 10' from the required side lot line setback of 10’ and a variance of 10.5' from the required ordinary high water level setback of 100' for the enclosure of a 10' by 12' portion of an existing 1 O' by 23' car port located on the side lot line and 89.5' from the ordinary high water level. The Board of Adjustment did not feel that it would be prudent to grant a variance that would permit construction on a lot line due to the difficulty in maintaining the structure and the increased risk to the public due to fire. Arlin Johnson - Approved Arlln Johnson, Verges, MN, requested a variance to subdivide a parcel of less than 2.5 acres. The tract will be approximately 200' by 1 50' and will be attached to Lots 14 and 15, Maplehurst. The property is described as part of Government Lot 2, Section 26 of Lida Township on Lake Lida. Betty Johnson represented the applicant at the hearing. A letter from Joyce Dinnell addressing this variance request was read for the record. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and carried with Carl Johnson abstaining, to approve a variance to subdivide a parcel of less than 2.5 acres with the conditions that the new parcel cannot be used for the construction of a residential dwelling, the parcel will be permanently attached to Lots 1 4 and 1 5, and that a registered surveyor’s drawing will be provided at the time of recording.
