EXPLAIN YOUR PROBLEM HERE: I am asking for a variance on my property because about 3 years ago, I built a 30 ft. long picnic table approximately 25 to 30 ^ft. from the lake. Last summer I put a temporary enclosure around and over the picnic table. I did this not knowing I needed a building permit and this I apologize for. When we are using the property, we have a removable screen and a removable vinyl roof that we put over the enclosure; and when we are not using the property, we remove the sides and roof. We only use the property 2 to 3 times a year. I would appreciate it very much if you would grant me a variance to use this enclo sure. The property directly to the south of me is owned by Byron Johnson, who helped build the enclosure. He does not mind it being there. The property to the north is owned by Bill Maruska, and Jao does not mind either. Bergerud Otter Tail County Board of Adjustment Otter Tail County Courthouse Fergus Falls, Minnesota 56537 Dear Ms. Bergerud: It will not be possible to attend the meeting December 2nd, in reference to the attached, ment office and was told I could submit my views in writing, which follow: I telephoned the Shoreland Manage- • I do not approve of this variance, and request that it be denied by the Board of Adjustment. There is a considerable amount of flat land available, more than would be needed, to erect this 20' x 40' build ing in full compliance with Shoreland Management ordinances. • Removal of plastic top and sides do not solve the problem; that a 20' x 40' building is sitting about 15' from the shoreline. The appearance of this obtrusive structure has not been improved by removal of its skin. Compliance with the ordinance would turn adverse usage of the shoreline into something more palatable by main taining the natural appearance of the lakeshore. • I don't accept the petitioner's lack of knowledge about building permits as a valid excuse for either the request or grant of a variance. These are obligations of property owners. If you don't know what your obligations will be, get a lawyer. He can also explain restrictive covenants which also exist on the whole of Crystal Beach Development, • Many of us have major investments on Lake Clitherall, pay taxes and respect the ordinances and covenants. We don't use the property only a few times a year. We consider our selves fortunate to enjoy it just as often as we can; for weekends, vacations. Thanksgiving and Christmas, for more than eight (8) months of the year. We respect this land, the lake and our resident and non-resident neighbors; and we abide by the rule that whatever is left at the end of a visit goes back in a trash bag where it came from. • This variance request is an incredibly thoughtless imposi tion on those of us who value Lake Clitherall and who make significant economic contributions to the school system. Ms. Sylvia Bergerud November 19, 1982 Page two to the retail trade of Henning, Clitherall, Battle Lake and Fergus Falls, and to Otter Tail County. • I again state my strongly held view that this variance should be denied, and that all existing and future construc tion, electrical and sewer/water installations, be performed in accordance with Shoreland Management ordinances. These ordinances were established to protect our lake environment for the benefit of property owners and visitors. I was out-of-town hunting. I was unaware that I needed permits for temporary facilities. We only use the lot two (2) times a year. I do intend to install a permanent sewage system in the spring of 1983. That is the time I thought I needed to obtain a permit. I would appreciate it if you would possibly know some reliable contractor I could get a price from. Regarding the temporary enclosure I have over my picnic table, I was unaware I needed a permit for this structure also, permit is needed, please advise, and I will pay the necessary fees.
