After consideration and discussion, Steve Schierer made a motion, seconded by Randall Mann and unanimously carried, to
approve a variance of 22’ from the required ordinary high water level setback of 100’ for the construction of a 10’ by 18’ screen
porch on top of an existing deck located 78’ from the ordinary high water level. The proposed development will not change the
overall impervious surface coverage, will not obstruct the view from the adjacent properties, will not encroach on the bluff area,
and is not within the shore impact zone. The hardship/practical difficulty is the terrain features of the applicant’s property.

Peter and Karen Dzubay - Approved the variance application as requested with condition. (7:15 p.m.)
July 5, 2012 meeting - The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Steve Schierer, with the verbal and written agreement of the applicants made a motion,
seconded by Thomas Lee and unanimously carried, to table the applicants’ request until the next scheduled meeting
of the Board of Adjustment, which will provide the applicants with an opportunity to meet with a representative of the
Land and Resource Department and an opportunity to determine if the proposed development can meet the 3’ vertical
separation requirement. August 2, 2012 meeting - After consideration and discussion, Randall Mann made a
motion, seconded by Steve Schierer and unanimously carried, to approve the proposed development as outlined in
the variance application dated June 12, 2012 with the condition that the required 3’ vertical separation (between water
level and lowest floor) must be maintained. The variance as approved will provide the applicants with the ability to
enjoy the same rights and privileges as others in this immediate area.
Clifford McLain and Janeen Virnala - Approved the variance application as requested. (7:30 p.m.)
Clifford McLain and Janeen Virnala, Sub Lot 3 of Government Lot 1, Section 27 of Dunn Township by Franklin Lake,
requested a variance of 30’ from the required ordinary high water level setback of 100’ for the placement of a
proposed dwelling 70’ from the ordinary high water level. The audience was polled with no one speaking for or against
the variance as requested. After consideration and discussion, Paul Larson made a motion, seconded by Thomas
Lee and unanimously carried, to approve a variance of 30’ from the required ordinary high water level setback of 100’
for the placement of the proposed dwelling, as depicted on the drawing dated July 11, 2012, 70’ from the ordinary
high water level. The proposed development will not obstruct the view from the adjacent properties. The variance as
approved will provide the applicants with the ability to enjoy the same rights and priviieges as other in this immediate
area. The variance as approved does not directly or indirectly grant any other variances for the proposed
development.

Joseph Dean, Lot 13 Madison Beach, Clitherall Lake in Clitherall Township, requested the following: I am requesting
a variance from the 100’ structure setback. I would like to construct a 10’ by 18’ screen porch on top of an existing
deck that is 10’ by 46’ long on the front of my residence. The existing deck is 78’ from the high water mark. The
audience was polled with no one speaking for or against the variance as requested. An email from Ronald A. Molitor
in opposition to the variance as requested was read for the record. After consideration and discussion, Steve
Schierer made a motion, seconded by Randall Mann and unanimously carried, to approve a variance of 22’ from the
required ordinary high water level setback of 100’ for the construction of a 10’ by 18’ screen porch on top of an
existing deck located 78’ from the ordinary high water level. The proposed development will not change the overall

David and Gaylen Pirri - Approved/Denied. (7:42 p.m.)
David and Gaylen Pirri, Lot 5 Block 1 Oak Grove Summer Resort, Pelican Lake in Scambler Township, requested the
following: non-dwelling reduced setback due to lot line change. 8’ from property line and 6’ from drain field.
As depicted on my drawing, the proposed garage would replace the existing one and would be the same distance
(approximately 8 feet) from the new property line. The other side would be approximately 6’ from the end of the drain
field, (per phone conversation 7-11-2012 with David Pirri information copied from letter submitted along with
application). Bruce Danielson, Contractor represented the applicants at the public hearing. The audience was polled
with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer
made a motion, seconded by Michael Harris and unanimously carried, to approve a 2’ variance from the required side
lot line setback of 10’ for the placement of the proposed structure 8’ from the side lot line and at least 10’ from the
drain field. It was noted that the proposed development will be no closer to the lot line than the existing structure.
The variance as approved does not directly or indirectly grant any other variances for the proposed development.

My name is Ronald A. Molitor, I am the owner of the property at 38254 Antler Lane, Battle Lake, MN.
I am writing concerning the application for variance from Joseph Dean for the property legally described as Lot
13, Madison Beach, 38238 Antler Lane, Battle Lake, MN. My property (Lot 12 Madison Beach) is adjacent to
Mr. Dean’s.
It is my understanding that this e-mail will be considered by you in determining whether to approve Mr. Dean’s
variance request.
My request is that existing views to Clitherall Lake from my property not be obstructed including the view that
would exist if I added a second story or built a new home with a second story.
