After discussion and consideration, Paul Larson made a motion, seconded by Darren Newville and unanimously carried to
approve the variance as requested in the application dated September 19, 2017 and as depicted on the drawing submitted with the
application with the condition that if the foundation requires work and/or cannot support the second story then the variance as
granted cannot be utilized by the applicant. It was noted that the proposed development will not obstruct the view from the
adjacent properties and that the variance as approved is consistent with past actions of the Board of Adjustment. The variance as
approved does not directly or indirectly grant any other variances for the proposed development or for future development.
Martin Knoll LLLP - Variance application approved as requested. (7:21 p.m.)
Martin Knoll LLLP, part of Lots 3 and 4, Martin Knoll, Pelican Lake in Scambler Township, requested the following: Transfer
11.84’ from owner of Parcel (C) 55-000-99-0479-001 to owner of Parcel (B) 55-000-99-0479-000 (Jon Martin) between the two
houses. This will expand Parcel (B) 55-000-99-0479-000 bluff line from 64.36’ to 76.2’. This will also give Parcel (B) 55-000-
99-0479-000 more room for a new proposed septic tank. Variance is requested for five feet from lot line to house on Parcel (C)
55-000-99-0479-001 instead of the normal ten feet. Move lot line in the back by garage/sheds to the west to allow for a drain
field for Parcel (B) 55-000-99-0479-000. Variance is requested of three feet from structures instead of the normal ten feet. All
three structures are to be removed. Removal of the structures will decrease impervious surfaces for both Parcels (B) 55-000-99-
0479-000 and (C) 55-000-99-0479-001. Richard Gabe appeared with the applicant at the public hearing. The audience was polled
with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion,
seconded by Jack Rosenthal and unanimously carried to approve the variances as requested in the application dated September
20, 2017 and as depicted on the certificate of survey dated September 20, 2017. The variances as approved are consistent with
past decisions of the Board of Adjustment. The variances as approved do not directly or indirectly grant any other variances for
proposed or future development.
Steven and Patricia Ahlschlager - Variance application approved with modifications. (7:28 p.m.)
Steven and Patricia Ahlschlager, Lots 12 and 13 Birchwood Shores First Addition and part of Government Lot 4, Section 14 of
Maine Township by Pickeral Lake, requested the following; Currently Lots 12 and 13 of Birchwood Shore First Addition are
substandard contiguous lots under the same ownership. We are proposing to split Lots 12 and 13 on their original platted lot line
and split parcel 38-000-14-0095-000 and attach a portion to each of Lots 12 and 13. This will create a Tract A, which will be
1.68 acres and a Tract B which will be 3.73 acres. We are also proposing to have both tracts buildable for single family residential
use. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration.
Jack Rosenthal made a motion, seconded by Chris McConn and unanimously carried, to approve the proposed subdivisions with
the following modifications; 1.) per the certificate of survey submitted with the variance application. Lots 12 and 13 Birchwood
Shores First Addition contains 174.81 ’ of frontage on Birchwood Shore Drive of which 150’ must be permanently attached to
Tract B with the remaining 24.81’ being permanently attached to Tract A, 2.) the common lot line between Tract A and Tract B
can be shifted easterly 25’ and 3.) Tracts A and B will be considered buildable lots for single family residential use/development.
The variances as approved do not directly or indirectly grant any other variances for proposed or future development.

G. Lois Ringquist, part of the Reserve Lot, Camp Corliss, Clitherall Lake in Clitherall Township, requested the following:
Request for exemption of need for driveway and parking on lot. Will meet other requirements to bring impervious surface
requirements as allowed in previously allowed variance to add second story to cottage. Impervious will cover 22.18%. The
audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Thomas
Lee made a motion, seconded by Chris McConn and unanimously carried, to deny the variance as requested as no adequate
hardship/practical difficulty unique to the property had been shown that would allow for the granting of the variance as requested
and the consensus of the Board is that the applicant can obtain a reasonable use of her property without the granting of the
variance as requested.
Gerard and Laurie Thompson - Variance application approved as requested with conditions. (8:15 p.m.)
Gerard and Laurie Thompson, Lot 15 of the Survey Lots of Government Lots 5 and 6, Section 33 of Tordenskjold Township by
Stalker Lake, requested the following: Proposing to construct a new dwelling being 9’ 1” from East and West Lot lines at the
closest point. Required is setback of ten feet. Greg and Bonnie, Gerard’s in-laws along with Donny Schommer, Contractor
represented the applicants at the public hearing. The audience was polled with Marjorie Knudson expressing concerns with the
lot line location and drainage from the applicants’ property unto her property.

Victoria Winters, Champlin, MN, requested a variance to have a substandard back lot declared a buildable
lot for residential purposes. The property is described as Lot 9, Block 2, Woodland Acres, Loon Lake in
Candor Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Paul Larson, second by Steve Schierer and unanimously carried, to
declare Lot 9, Block 2, Woodland Acres a buildable lot for residential purposes. It was noted that this is a
very large lot that had been residentially developed prior to the 1992 ordinance change that required back
lots created after 1972 to be double the size of a front lot in order to be a buildable lot. Hardship is a back
lot which, was platted in 1980 and which met the minimum size standards when platted, but has since been
declared a non buildable lot because of a 1992 ordinance change.
Harley L. Olson -Approved as requested. (6:53 p.m.)
Harley L. Olson, Fergus Falls, MN, requested a variance of 3 to 5’ from the required ordinary high water
level setback of 75’ for the placement of a new roof on an existing structure located 70 to 72’ from the
ordinary high water level. The property is described as Lot 1, Sunset Beach and part of Government Lot 3,
Section 24 of Elizabeth Township by Jewett Lake. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Steve Schierer, second by Paul Larson and
unanimously carried, to approve a variance of 3 to 5’ from the required ordinary high water level setback of
75’ for the placement of a new roof on an existing structure located 70 to 72’ from the ordinary high water
level. It was noted that the proposed project is a roof replacement project and not a roof repair project,
thereby, requiring a variance since the structure is ahead of the string line, however the roof replacement
project is necessary maintenance for this structure. Hardship is a substandard lot of record.
Luverne and Barbara Lovaasen - Approved as requested with a condition. (6:56 p.m.)
Luverne and Barbara Lovaasen, Verges, MN, requested a variance to subdivide a 2.5-acre tract from and
existing 60.25-acre parcel. The property is described as part of Government Lot 2, Section 11 of Dora
Township by Sybil Lake. Letters from Burnell and Scott Lovaasen, Tom, Falk. Bertha Sonnenberg, Donald
Greenwood and John and Janet Turgeon in support of the applicants’ request were read in summary for
the record. The audience was polled with no one speaking for or against the request. After consideration,
motion was made by Randall Mann, second by Steve Schierer and carried with Mark Steuart voting no, to
approve the proposed subdivision of a 2.5 acre parcel from an existing 60.25 acre tract with the condition
that a registered survey must be presented at the time of conveyance. It was noted that the proposed
parcel does have room for two onsite septic systems and does have access to a public road. It was also
noted that the granting of the variance would allow the applicants the ability to separate there home from
the remaining building on this farm site and that the granting of this variance is consistent with previous
actions of the Board of Adjustment in similar situations.
Lois Ringquist, Minneapolis, MN, requested the following: “In order to build a second floor on my cottage,
using the identical footprint, I request: 1. Lot be declared buildable, 2. Setback from OHWL, neighboring
structure and lot line and perhaps, road right-of-way variances, 3. Impervious surface variance.” It should
be noted that the structure is 13’ from the ordinary high water level, 19.5’ from the Northeast lot line, 0’ from
the southwest lot line and 25’ from the road right of way. It should also be noted that currently 29% of the
total lot area is covered with impervious surfaces. The property is described as the Northeast 55’ of the
Reserve Lot, Camp Corliss, Clitherall Lake in Clitherall Township. The audience was polled with Donald
Myers speaking in support of the variance as requested. After consideration, motion was made by Steve
Schierer, second by Cecil Femling and unanimously carried, to declared the lot a buildable lot and to grant
the variances as requested from the ordinary high water level, the lot lines and the road right-of-way for the
construction of a second floor within the existing footprint, which will increase the overall height of the"
existing structure by no more than 8', with the condition that no more than 25% of the total lot area can be
covered with impervious surfaces, as determined by the Land and Resource Department, after completion
of the proposed development. Hardship is a substandard lot of record. It was noted that the impervious
surface coverage is the only issue that can be brought into compliance with the ordinance.
