subdivide a 2.34 acre tract into two parcels for the purpose of permanently attaching these two tracts to two lake lots

registered surveyor’s drawing must be provided at the time of recording.

Ray and Alice Deel - Approved
Ray and Alice Deel and Gerald and Joy Benjamin, Richville, MN, requested a variance to subdivide an
existing 5.7-acre parcel into two tracts. One parcel would be approximately 3.09 acres and the other
parcel would be approximately 2.85 acres. Both tracts exceed the minimum size requirements for
platted lots on a natural environment lake. The property is described as part of Government Lot 2,
Section 26 of Dead Lake Township by Dead Lake. The audience was polled with one person speaking
to the applicants’ request. After consideration, motion was made by David Holmgren, seconded by
Cecil Femling and unanimously carried, to approve the subdivision of a 5.7 acre parcel into two tracts
as identified in the applicants' application with the condition that those structures stated for removal on
the applicants’ registered surveyor’s drawing must be removed. It was noted that both tracts would
have public road access and adequate area to support two on-site septic systems. It was also noted
that no other variances are required at this time for development purposes. Both tracts exceed the
minimum size requirements for platted lots on a natural environment lake.

identified on the registered surveyor’s drawing as Parcel B, into two parcels of equal size. The property
is described as a 2.34 acre tract in Government Lot 3 easterly of North Minni Acres and of North Minni
Acres First Addition, Clitherall Lake in Clitherall Township. Lynn Hansen represented the applicants at
the public hearing. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried,
to approve a variance to subdivide a 2.34 acre tract into two parcels for the purpose of permanently
attaching these two tracts to two lake lots with the condition that no residential living structure can be
placed on these back lots and with the condition that a registered surveyor’s drawing must be provided
at the time of recording.
Scott and Julie Wenzel - Approved
Scott and Julie Wenzel, Brooklyn Park, MN, requested a variance of 25’ from the required ordinary high
water level setback of 100’ for the construction of a proposed 40’ by 40’ dwelling, including a deck, 75’
from the ordinary high water level. The property is described as Lot 2, Block 1, Mabuhay, East Spirit
Lake in Dora Township. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Cecil Femling, seconded by Mark Steuart and unanimously
carried, to approve an ordinary high water level setback, for the construction of a proposed dwelling, in
the same manner as was used to determine the ordinary high water level setback for Lot 1, Block 1,
Mabuhay. The ordinary high water level setback for Lot 1, Block 1 was established by a variance
granted in October of 1994. The granting of this variance is consistent with past decisions of the Board
of Adjustment.
