Johnson Cecil Femling Tim Greip, Land & Resource Management Wally Senyk, Assistant County Attorney Chairman Walter called the meeting to order at 6:00 p.ra., and hearing no changes or corrections to the minutes of the July meeting, declared same approved as mailed. CALL TO ORDER MINUTES APPROVED Douglas Kramer, Henning, MN, requested permission to construct home with walk-out basement, 35' to 45' from lake, on Lot 4, Rainbow Lodge, East Battle Lake in Girard Township, was made by Craig Anderson to approve, hardship being unique situation, with no established building line, construction in said spot would help erosion problem. The motion was seconded by John Everts and car­ ried unanimously. Richard D. Bergseth, Fargo, ND, requested permission to build an ex­ panded shed, 16' X 12', in place of existing 8' x 8' shed, 4 feet farther from the lake, on Lot 5, Block 2, Engstrom Beach 1st Add'n, on Big McDonald Lake in Edna Township. After consideration, motion was made by Craig Anderson to deny, no adequate hardship shown, the fact the building is there has no bearing, permission wduld not have been granted prior to construction, allow until November 1 , 1989 to remove. The motion was seconded by John Everts and carried unanimously. William L. Weitzel, Wahpeton, ND, requested permission to construct a 14' X 22' storage building approximately 145 to 150' from Beauty Shore Lake, in G.L. 2, Section 20, Girard Township. After consideration, motion was made by John Everts to approve, hardship being a unique lot, being impossible to place shed in compliance with set-back of either lake. The motion was seconded by Cecil Femling and carried unanimously. DOUGLAS KRAMER APPROVED After consideration, motion RICHARD BERGSETH DENIED WILLIAM L. WEITZEL APPROVED Kenneth W. Hanson, Fargo, ND, requests permission to allow existing three sheds to remain as located 72' from water line, on Lot 23, Block 1, Echo Ranch Riviera, on Long Lake in Otter Tail Township. After consideration, motion was made by Carl Johnson to approve, hardship being a substandard lot of record with the topography of the land not allowing any other spot for a storage shed. The motion was seconded by Cecil Femling and carried unanimously. KENNETH W. HANSON APPROVED #AUL H. BOYUM %NIED Paul H. Boyum, Battle Lake, MN, requested permission to place a camper trailer 50' from highwater mark in Lot 4 of Subdivision of G.L. 1, 2, 3 & 4, Section 14, Clitherall Lake, in Clitherall Township. Allen Riess and William Taylor speaking to the issue, with letters also'read. After consideration, motion was made by Craig Anderson to deny, no adequate hardship shown, allowing 90 days to remove the camper. Motion seconded by Cecil Femling and carried7 with Jo^n Everts abstaining. Kenneth Albertson, Breckenridge, MN, requested permission to remove a 12' X 12' batrtouse and replace with a 16' x 24' garage, storage and bathhouse, in same location, less than 10' from property line, on Lot 16 & prt of 17, Jonelsa Beach, Amor Township on Otter Tail Lake. After consideration, motion was made by Craig Anderson to deny, lot large enough to find a more favorable location. Box 54 Battle lake, MN 56515 Board of Adjustment Otter Tail County Courthouse Fergus Falls, MN 56537 July 31, 1989 Dear Sirs, This letter is to advise you that CLITHERALL LAKE ASSOCIATION, made up of more than 50% of the property owners, as well as 1 business owner in Battle Lake and 1 resort owner on the lake, oppose the variance request by Paul H. Boyum, to be heard by the Board of Adjustment, August 3, 1989. Two specific reasons exist: 1)The precedent established by granting this variance would automatically apply itself to Lots 1, 2 and 3. 2)The likelihood that a subsequent variance would be requested for waste disposal, or problems that would be related to the question of where and how waste would be disposed of. Management ordinance standards for even a sealed tank require 75' setback from the lakeshore. Shore land Much conversation by Clitherall property owners has taken place about this variance request: the perception is that it has been common knowledge for a long time that these government lots were not buildable, otherwise they certainly would have sold at an earlier date, just to the other hundreds of property owners, taxpayers and Otter Tail registered voters who live on this lake, that an individual first buys the lot then must plead for a variance. The question of the variance should have been settled first. It does not seem fair or We became aware early this year, only by chance, that a road had been cut into the bluff of the lot in question. We wondered if this had been approved by Shoreland Management prior to the work starting, or after the fact when nothing could be done to remedy the potential problems of erosion above a good walleye fishing area? Was this approached in the same fashion as the current variance request? Again, the CLA opposes this variance request and we respectfully ask that it be denied. Yours truly. Bergerud, Secretary Ottertall County Board of Adjustment Ottertall County Courthouse Fergus Falls, MN 56537 RE I PUBLIC NOTICE, BATTLE LAKE REVIEW OF JULY 26 PAUL BOYUM VARIANCE REQUEST 1989 Dear Board Memberst As you know Clltheral Lake Is designated a recreational development lake which requires a 100 foot setback for buildings. Appropriate setbacks are established to protect the lake from pollution caused by erosion, runoff and sewage; and also protect adjacent properties. In this case there does not appear to be a particular hardship or practical difficulty in meeting the setbacks in the ordinance; therefore the Shoreland Regulations in the County Ordinance should be upheld. The Board of adjustment did uphold the Regulations when the previous owner applied for a variance and was denied. If Mr. Boyum is granted the 50 foot variance for his camper, would he subsequently need a variance for the septic system? Thank you for your consideration in this matter.
