(6:50 p.m.) DeWayne and Edna Hoium, Lot 11, Alberg’s Survey Lots of Government Lot 1, Section 13 of Clitherall Township by Clitherall Lake, requested a variance of 35’ from the required ordinary high water level setback of 100’ for the purpose of screening the 10’ by 20’ area under the existing second level enclosed porch and a variance of 25’ from the required ordinary high water level setback of 100’ for the construction of a wrap around deck. The maximum size of the deck on the north will be 15’ by 25’ and on the east 12’ by 35'. The audience was polled with no one speaking for or against the request. The applicants noted the following change; the maximum size of the deck on the north will be 10’ by 24’ instead of the requested 15' by 25’ and the maximum size of the deck on the east will be 8’ by 24' instead of the requested 12’ by 35’. The Board of Adjustment accepted these revisions to the application. After consideration and discussion, motion was made by Randall Mann, second by Joe Maske and unanimously carried, to approve a variance of 35’ from the required ordinary high water level setback of 100' for the purpose of screening the 10' by 20' area under the existing second level enclosed porch and to approve a variance of 25' from the required ordinary high water level setback of 100' for the construction of a wrap around deck which will have a maximum size on the north of 10' by 24’ and a maximum size on the east of 8’ by 24’. It was noted that none of the proposed development would be any closer to the ordinary high water level than the existing development and that none of the proposed development will obstruct the view from the neighboring properties. Hardship is a substandard lot of record. Bob Cox - Approved as modified. (6:54 p.m.) Bob Cox, Lot 20 of Sanda’s Beach, East Battle Lake in Girard Township, requested a variance of 7’ from the required side lot line setback of 10’ for the construction of 16’ by 28’ garage 3' from the side lot line. The audience was polled with no one speaking for or against the request. An email from Bill Thompson in support of the variance as requested was read for the record. After consideration and discussion, motion was made by Cecil Femling, second by Steve Schierer and unanimously carried, to approve a variance of 3’ from the required side lot line setback of 10’ for the construction of a garage 7' from the side lot line, 20’ from the road right-of-way and 10’ from the septic tank. Hardship is a substandard lot of record. Sunshine Resort - Denied. (7:07 p.m.) Sunshine Resort, Steven Halstensgaard, part of Government Lot 1, Section 22 of Pine Lake Township by Pine Lake, requested a variance of 50' from the required 75’ setback in order to reconstruct the old portion of our house. We will reconstruct this portion of our house on the exact footprint that it now sits on. When the work is completed the roofline on the old part of the house will be the same height as the roofline on the other part. We would like to do this project without needing a conditional use permit. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Cecil Femling, second by Steve Schierer to table this variance hearing for clarification from the office. After additional discussion this motion was withdrawn. After additional consideration, motion was made by Randall Mann, second by Steve Schierer to approve the reconstruction of the old portion of the house with the condition that no portion of the reconstructed dwelling can be any closer to the ordinary high water level than the newer part of the existing dwelling, with the condition that no other variances would be granted for this proposed development and with the condition that, if required, the applicant proposed development must also receive Planning Commission approval. This motion was also withdrawn when it became unclear as to exactly what the applicant wanted to do. It appeared from the application that the applicant desired to reconstruct the entire older portion of the existing dwelling in the footprint of the existing older dwelling, however, the applicant seemed to indicate that his proposed project would consist only of a repair to the roof. After additional discussion and consideration, motion was made by Joe Maske, second by Cecil Femling and carried with Paul Larson voting no, to deny the variance as requested as this is a new cluster development/plat which should not require variances for development. \ Notice of Hearing for Variance Otter Tail County Courthouse 121 West Junius Ave. Fergus Faiis, MN 56537 (218) 998-8030/998-8041 Email - wstein@co.ottertail.mn.us www.co.otter-tail.mn.us Applicant must be present at the scheduied hearing.
