MINUTES OF THE MEETING OFTHE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, May 5, 2011 The Otter Tail County Board of Adjustment met Thursday, May 5, 2011, with the following persons in attendance: Rod Boyer Thomas Lee Mark Ronning, Land and Resource Management David Hauser, County Attorney Michael Harris Randall Mann Paul Larson Steve'Schierer Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the April 14, 2011 meeting as mailed. The Board of Adjustment considered the following applications for variance: Daniel and Rhonda Antrim - Denied (6:30 p.m.) Daniel and Rhonda Antrim, Lot 1 Block 1 Wall.Lake Development No. 3, Wall Lake in Aurdai Tovynship requested a variance of 4’ from the maximum allowable non dwelling height of 20’ for the construction of a structure having-a height of 24’. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Michael Harris and carried with Thomas Lee ■ voting no, to deny the variance as requested as no adequate hardship/practical difficulty had been shown that would allow for the granting of the variance as requested and noting that the applicants can obtain a reasonable use their property without the granting of the variance as requested. It was also noted that the granting of the variance as requested would establish precedence in this immediate area that the Board does not want to establish. Dennis and Janet Klosterman - Approved the variance as request with a condition. (6:37 p.m.) Dennis and Janet Klosterman, part of Government Lot 2, Section 4 of Everts Township by Otter Tail Lake, requested a variance of 22’ from the required ordinary high water level setback of 75’ for the purpose of raising the existing house and deck elevation 16” and for the purpose of removing the existing concrete block walkout exterior wall and replacing with 2 by 6 insulated wood wall. The existing house is located 53’ from the ordinary high water level and the existing grade to top of roof is 15’ 6”. Also, requesting a variance of 32’ 10” from the required ordinary high water level setback of 75’ for the replacement of an existing deck with a new deck having a 9’ depth 42’ 2” from the.ordinary high water level. The existing deck has a depth of 7’ and is 44’ 2” from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, ' Michael Harris made a motion, second by Steve Schierer and unanimously carried, to approve the proposed development as described in the variance,application dated April 13, 2011 with the condition that none of the proposed development can be any closer to the ordinary high water level than the existing building or the existing deck. It should be noted that the building is currently 53’ from the ordinary high water level and the existing deck is currently 44’ 2” from the ordinary high water level. The proposed development consists of raising the existing house and deck elevation 16”, removing the existing concrete block walkout exterior wall and replacing with an insulated wood wall, replacing an existing deck and a 12’ by 20’ addition to the rear of the existing structure.' It should be noted that the variance as approved provides the applicant with the ability to tie the roof of the'new 12’ by 20’ addition into the roof line of the existing structure. ^^Randy and Kaeli Dorn - Approved the variance as requested with a condition. (6:50 p.m.) Randy and Kaeli Dorn, part of Government Lots 1 and 2, Section 3 of Clitherall Township by West Battle Lake, requested the following: Asking for variance to add on to current deck. Add on would make the deck a full rectangle expanding to the end of where the stairs currently end. This would make the deck 37’ from the lake. Currently, the neighbor to the east has a deck 36’ from the lake. This would make our deck very close to in line with our neighbors. We would like the same rights and privileges as they have. The audience was polled with Ronald Johnson questioning why his property was referenced in the applicants’ request. A letter from Keith and Martha Fletcher in support of the variance as requested was read for the record.
