(6:58 p.m.) Julie Baumler, Lots 76 and 77 Nedberg-Nye Survey Lots of Government Lots 1, 2 and 3, Section 1 of Edna Township by Devils Lake, requested a variance of 9’ from the required road right-of-way setback of 20’ for the placement of a 24' by 24' garage 11' from the road right-of-way. Jeff Hanna represented the applicant at the public hearing. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Cecil Femling made a motion, second by Robert Schwartz to approve a variance of 9' from the required road right-of-way setback of 20' for the placement of a 24’ by 24’ garage IT from the road right-of-way. The motion to approve failed with Paul Larson, Randall Mann and Steve Schierer voting no, therefore, the application is denied. After additional discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to direct that the applicant place the 24’ by 24’ garage in a location complying with the setback requirements of the ordinance on or before October 1, 2005. Daniel and Frances Gleason - Approved the variance request as modified. (7:12 p.m.) Daniel and Frances Gleason, part of Government Lot 3, Section 10 of Edna Township by Rusch Lake, requested a variance of 120’ from the required ordinary high water level setback of 200’ for the construction of a 28' by 32’ storage building 80’ from the ordinary high water level. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Cecil Femling made a motion, second by Paul Larson to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. The motion to deny failed with Michael Conlon, Steve Schierer and Robert Schwartz voting no. Those voting in favor of the denial noted that a reasonable use of the property can be obtained without the granting of the variance as requested and the granting of the variance as requested would establish precedence. After additional discussion and consideration, Steve Schierer made a motion, second by Robert Schwartz and unanimously carried, to approve a variance of 100’ from the required ordinary high water level setback of 200' for the construction of a 28’ by 32’ storage building no closer than 100' from the ordinary high water level. Hardship is the terrain and topography of the applicant’s property. The variance as granted will keep the proposed structure out of the shore impact zone. Donald B Meyer - Withdrawn prior to the meeting. Donald B Meyer, Et Al, Lots 1, 2 and 3 Block 1, Big Pine Haven, Big Pine Lake in Pine Lake Township, requested the following: to allow the total square foot area of first tier on Lots 1, 2 and 3 of Big Pine Haven to be used for purpose of calculating boat slips for a proposed 8 units planned development verse total square footage less bluff area. (Proposed: Common Interest Community Number 37 - Big Pine Villas) Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. A letter from Thomas A Piehl and from Jayne Adams Borsenberger in opposition to the variance as requested was noted for the record. A letter from Rick Heinie withdrawing the application was noted for the record. Larry and Kim Charest -^^proved the variance application as requested. (7:26 p.m.) Larry and Kim Charest, part of Government Lots 3 and 4, Section 2 of Clitherall Township by an unnamed lake, requested a variance of 100' from the required ordinary high water level setback of 200’ for the placement of a 30’ by 50’ building 100’ from the ordinary high water level. John Christenson, Contactor appeared with the applicant at the public hearing. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Michael Conlon and carried with Cecil Femling voting no and with Randall Mann abstaining, to approve a variance of 100’ from the required ordinary high water level setback of 200’ for the placement of a 30’ by 50’ building 100’ from the ordinary high water level.
