Vergas, MN. requested a variance of 80’ from the required ordinary high water level setback of 200' for the construction of a 12’ by 12' furnace room. The property is described as part of Government Lot 5, Section 14 of Candor Township on Medicine Lake Lodge. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Bert Olson and unanimously carried, to approve a variance of 80' from the required ordinary high water level setback of 200' for the construction of a 12' by 12' furnace room with the provision that no variance request be brought in the future for a water oriented accessory structure. Stewart Mensing - Tabled Stewart Mensing. Ottertail, MN. requested a variance of A' from the required drain field setback of 20' and a variance of 2' from the required side lot line setback of 1 O' for the construction of a 2A' by 36' garage. The property is described as Lot 12 of Riverview Beach and a part of Government Lot 5, Section 34 of Rush Lake Township on Otter Tail River. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to table this variance request until the August 6th meeting. The applicant will determine the location of the side lot lines and the location of the road right-of-way for the next meeting. j Frank and Esther Kara - Tabled Frank and Esther Kara, Pelican Rapids. MN, requested a variance to allow Lot T and Lot U, which have the same ownership and are contiguous, to remain as individual lots even though they do not meet the minimum requirements of the shoreland ordinance and according to the present ordinance are considered one lot for the purposes of development and conveyance. The property is described as Lot T and Lot U of Government Lot 7, Poss Survey Lots, Lake Lizzie in Dunn Township. Appearing along with the applicant at this hearing was Stephen Kantrud, Realtor. After much discussion and consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried to table this variance request until the Board of Adjustment members have an opportunity to discuss with and receive advice and legal counsel from Wally Senyk, Otter Tail County Attorney. Sherman - Approved Neil Sherman, Independence, MO, requested a variance to construct a small vacation cottage on a lot with 50' of lake frontage. The required lake frontage for a general development lake is 100'. All other setback requirements will be met. The property is described as part of Government Lot 1, Section 2 of Clitherall Township on West Battle Lake. Everett Sherman represented the applicant at this hearing. The audience was polled with Robert Sherman and Wayne Tucker speaking in favor of this variance request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve the variance as requested. The lot has adequate square footage and the granting of this variance will not increase the pressure on this lake. The granting of this variance will not establish a precedent in the immediate district, The tract was originally recorded as agricultural farmer land as it was separated from the lake by railroad property. The railroad property has since been acquired by the applicant.
